Mr.RobertWilsonMarch27,2019Page2priorsixyearsinwhichtheWilsonPark2platcouldhavebeenmakingprogresstowardrecordingasitwasoriginallyapproved.Indeed,thepreliminaryplatandpreliminaryPUDwereapprovedin2012,andengineeringdrawingswereapprovedfiveyearsagoin2014.However,theengineeringdrawingshaveremainedinouroffice,theoutstandingconstructionpermithasnotbeenpaidfororpickedup,andnofurtherprogresshasbeenmadetowardconstructingallsiteimprovements—amandatoryprerequisiteoffinalplatrecording.Inadditiontoconsideringthepointsmadeinyourletter,CEDconsideredthefollowinginevaluatingyourrequestforaone-yearextensiontoWilsonPark?:•ThepreliminaryplatandpreliminaryPUDwereapprovedonJuly5,2012.•Theprojectwasprovideda7-yearapprovaltimeframe,basedonRentonMunicipalCodeandanextensiongrantedbytheWashingtonStateLegislature.ThereforetheprojectexpiresonJuly5,2019.•TheCivilConstructionPermithasbeenreadytoissuesinceJune17,2014waitingonlyforactionsfromyou:finalpermitfeestobepaid,aperformancebondtobesubmitted,andcontractorinformationalongotherconstructionrelateddocumentstobeprovided.•RevisionstoRentonMunicipalCodehaveoccurredsubsequenttotheapplication.InadditiontotherezoneofthesitefromResidential-8DwellingUnitsperAcre(R-8)toResidential4DwellingUnitsperAcre(R-4),revisionshaveoccurredtostormwaterregulations,fence/wallstandards,landscapingstandards,andtreeretentionstandards.•StaffmetwithyouandyourengineeronAugust4,2018inordertoprovideyouwiththreepotentialoptionsforyourconsiderationregardingapathforwardforWilsonPark1andWilsonPark2.IttookanadditionalsixmonthsforCEDtoreceiveanyformofformalapplicationpursuingtheseoptions.•TheCitysignedanagreementwithyouonAugust22,2018extendingtheperiodofvalidityofabuttingWilsonParkitoJuly5,2019.Inthosenegotiations,youassertedthatWilsonParkImustbeextendedtofollowthesametimelineasWilsonPark250thatthetwoplatscouldproceedtogether.Now,youassertthatWilsonPark2mustbeextendedpastWilsonParkl’sJuly5,2019expirationdate.Therepeatedattemptstoseesawthetwoplats’expirationdatesdiscreditargumentsofgoodfaith.•YouvisitedCityHallrequestingengineeringinformationforWilsonPark1and2onSeptember14,2018.TheCitysentyoualltheengineeringfilesonSeptember17,2018.Nevertheless,anothersixmonthswentbybeforeCEDreceivedaresubmittal.•CEDrepresentativesrecentlyvisitedthesiteandwitnessedfirst-handthattheplatremainsunimproved.Fromtheirextensiveexperienceinpermittingandwiththisplat,CEDrepresentativesconcludethatWilsonPark2wouldnotbereadytorecordonJuly5,2020evenifgrantedaone-yearextension.Basedontheabove,CEDhasdeterminedthatdespitetheadditionaltwoyearsofvalidityaffordedtheplatbytheLegislature,youhavenotmadeagoodfaithattempttoconstructtherequiredutilitiesandinfrastructureandtootherwisepreparetorecordtheplatpriortoits.1055SouthGradyWay,Renton,WA98057.rentonwa.gov
