RE: Request for Providing Emergency Access across Tract H
Dear Ms. Rastelli -Lee,
This correspondence is a formal request of the Winsper HOA to adhere to the stated
conditions on the Winsper Subdivision Plat Map for the transfer of Tract H to lot 28,
APN 12-000280 subject to the conditions of short -plat approval. These conditions are
being satisfied as final engineering is being completed in adherence of the Hearing
Examiner's conditions of approval.
Please let me restate where we are in this short -plat application process. Currently we are
proposing a two -lot short plat subdivision called Valley Vue for the properties addressed
at 3112 and 3106 Talbot Road S., Renton APN 12-000280. The subject parcel was
improved with two houses ((3106 -burned down in July of 2016) and 3112 Talbot Road S)
that access off of Talbot Road S. Under the proposed Valley Vue short plat, an additional
emergency access would be provided to the newly created lots over one of the recorded
easements, Tract H, planned for parcel APN 12-000280 and as shown on the recorded
Winsper subdivision map. As a point of information, these Tracts were created in King
County and annexed into Renton with existing covenants, conditions, restrictions,
recordings, and entitlements. The Tracts specifically stated their purposes as to provide
access, egress, and utility easement for the parcel no. 28 APN 12-000280, which is cited
by number on the face of the Winsper Subdivision Map (a copy is provided). Of the two
Tracts, the Tract to the west on Tract H would be improved for an emergency access to
the proposed two lots.
This Valley Vue project was processed through two extensive hearing examinations, and
the Hearing Examiner and Fire Chief have concluded as evidenced in the Final Decision
of the Preliminary Plat review LUA16-000272 that the most reasonable and consistent
manner in serving the two existing houses was from Talbot Road South and include the
emergency access through Tract H. This decision relied on considerable review and
input provided by the neighborhood, developer consultants, and the City of Renton
Planning and Fire Departments. More significant and notable is the probability that the
access will be rarely used, if ever; nevertheless, it would have served its purpose for the
mentioned house fire that resulted in one fatality. The transfer of Tract H to RAD
Holdings LLC, in addition to satisfying the final engineering details, is required by the
City of Renton.
Again, this access would allow only emergency access to the proposed two lots and
would be dedicated to the subject parcel when this short -plat is approved; moreover, the
creation of these two lots would create a conforming design for the two existing house
improvements. Furthermore, the steeper grade and 12 feet wide access off of Talbot
Road is not remotely feasible within the constraints of Renton's Codes. The emergency
access will be controlled by a locked barrier gate accessible by only Public Safety for fire
and police emergencies.
Troubling to consider is that the due -processing of the subdivision application of parcel
APN 12-000280 occurred and yet members of the Winsper HOA continue to resist the
adjudicated findings and terms of the Hearing Examiner? This process has been
protracted over three years as a result of an exhaustive Public Review Process—a process
that included an extraordinary two hearings examinations. My attempts to discuss this
project with the Winsper HOA were stopped at the HOA's J&M Management Company
level. It was communicated to me that they were prevented by Winsper HOA from
sharing contact mailing addresses and phone numbers. Approximately eight requests I
made in conversations with the J&M Management Company representative to discuss
this project with Winsper were never answered by the Winsper HOA. The
correspondence from Winsper HOA's attorney with Davis Wright Tremaine LLP cited
demands for conditions controlled and to be managed by the City of Renton; moreover,
these concerns were raised outside of the review period following the issuance of the
Final Decision? Given the history of this short -plat process and correspondence to date,
the non-compliance position the Winsper HOA has elected is an obstruction of the
Hearing Examiner's Final Decision.
From my observations, the primary concerns originate with a local resident that believes
their property possesses greater property rights over those of the neighbors, regardless of
the findings through the municipal due -process for regulating the fair application and
adherence to city and county codes, regulations, and rules. A personal interest campaign
that fails to address the greater best -interests of the collective neighbors is both expensive
and self-serving. If this neighbor desires to assert total control over parcel no. 28 APN
12-000280, I would suggest they purchase the property for their use and satisfaction.
Thank you for your consideration of this reasonable request for the releasing of Tract H
for purposes as described. When necessary, the processing of the transfer of Tract H to
RAD Holdings LLC will be provided by RAD Holdings LLC in accordance with the
requirements of the City Renton. I will also be forwarding this to those emails I have as
