The property is located within the R-8 zone and is developed with one single-family house. The applicant proposes a three-foot landscape strip located between the fence and the property line, rather than the required eight feet per RMC4-4-040D.3.e.ii (Exhibit 1). The proposed privacy fence would be constructed utilizing treated cedar boards, with the finished side facing the street. The posts would be spaced approximately 8-foot on center, except where restricted by available length. The applicant has proposed the installation of boxwood shrubs approximately 4 feet on center within the landscape buffer along the full length of the fence (approximately 65 feet). In addition, the top foot (1') of every other vertical fence board would be removed in order to mitigate for the "wall" effect of the fence and to promote visibility both into and out of the property (Exhibit 2). The applicant's justification for a reduced landscape strip is that due to the property being a corner lot and the existing house not meeting current setback standards, the reduction would allow for some landscaping while preserving their existing private yard area. City staff agrees with the applicant's justification for reduced setback and concurs that the proposed fence strikes an appropriate balance between preserving private space and protecting the safety and aesthetics of the neighborhood. Therefore staff recommends approval of this Special Fence Permit request as submitted. Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on June 06, 2019, together with the required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk’s Office, 425-430-6510. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame.
