GRADY WAY RENTON, WA 98057 RE: Cedar Falls Transmission Pole Replacement 3, LUA19-000008, CAE, SME Dear Ms. Dolbee: Thank you for the recent letters from your Department dated May 8, 2019 (“Off Hold” notice) and May 15, 2019 (“On Hold” notice). I understand that Mr. Jeffrey Taylor no longer works for the City of Renton. I have been working with Mr. Taylor since December 2018 on Shoreline and Critical Areas Exemptions/permits for the replacement of electric utility poles within your jurisdiction and am writing to you today to request an update on the status of the permits/project approval. Seattle City Light (SCL) needs to replace nine (9) transmission poles that are reaching their end of useful life in the right-of-way within this the City of Renton. Eight (8) of the nine (9) poles fall within a critical area, and of those, six (6) fall within a 100-year flood hazard area. Two requests for additional information have been made by your Department relevant to the poles within the flood hazard area – the first on March 5 and the second on May 8. SCL responded to these requests on March 29 and May 15, respectively. A summary of my communications with Mr. Taylor is provided below and in the enclosed to ease your review of the Project. 12/21/2018 In-person meeting to clarify requirements for Shoreline and Critical Areas Exemptions 1/18/2019 In-person meeting for submittal of Master Application and exemption requests 1/23/2019 Master Application accepted 3/1/2019 SCL emails Mr. Taylor to check on status of the exemption requests Mr. Taylor responds via email that the review is complicated, but a justification is being prepared 3/5/2019 Mr. Taylor sends an email requesting additional information – Professional Engineer-approved drawings with elevation data for the poles within the flood hazard area 3/6/2019 Mr. Taylor sends electronic “On Hold” notice letter Mr. Taylor and SCL exchange emails with clarifications to the request for additional information PAGE 2 OF 2 3/29/2019 SCL provides formal response to the request for additional information via letter/email 4/19/2019 SCL emails Mr. Taylor to check on status of the exemption requests Mr. Taylor responds that SCL’s 3/29/2019 submittal looks great and should get approval the following week 5/6/2019 SCL emails Mr. Taylor to check on status of the exemption requests 5/7/2019 Mr. Taylor responds via email that the project is awaiting approval from his supervisor 5/8/2019 Mr. Taylor sends email with second request for additional information regarding compensatory volume in a flood plain 5/14/2019 SCL receives a hard copy “Off Hold” notice letter dated 5/8/2019 5/15/2019 SCL sends response to second request for additional information via email/letter Mr. Taylor sends hard copy “On Hold” notice ~5/20/2019 SCL receives hard copy “On Hold” notice dated 5/15/2019 5/29/2019 SCL emails Mr. Taylor to check on status of the exemption requests Can you please confirm that this Project’s review is now “Off Hold” again? The second response letter from Seattle City Light demonstrates that the proposed project will increase the existing flood storage volume. We hope this response will lead to an expeditious approval from the City of Renton so the Project can proceed as soon as possible due to the status of the poles and the need for urgent replacement within this dry season. Sincerely, Maura Patterson Sr. Environmental Analyst /Enclosures ATTACHMENT A ""On Hold"Notice, First Request for Additional Information, and Email Clarification March 6, 2019 Maura Patterson 700 5th Avenue Seattle, WA 98124 SUBJECT: "On Hold" Notice Cedar Falls Transmission Pole Replacement 3, LUA19-000008, CAE, SME Dear Ms. Patterson: The Planning Division of the City of Renton accepted the above master application for review on January 23, 2019. During our review, staff has determined that additional information is necessary in order to proceed further. The applicant shall provide the actual elevation, in relation to mean sea level, the North American Vertical Datum of 1988 (NAVD 88), of the lowest floor (including basement) of all new or substantially improved structures, and whether or not the structure contains a basement where base flood elevation data is provided through the flood insurance study or required. For all new or substantially improved floodproofed structures: 1.The applicant shall verify and have recorded the actual elevation in relation to mean sea level, the North American Vertical Datum of 1988 (NAVD 88); and 2.Flood elevation certificates shall be submitted by an applicant to the Development Services Division prior to the building’s finished floor construction. Finished floor elevation should be verified by a preconstruction elevation certificate at the time of construction of a substantial structural element of the finished floor (i.e., foundation form for the concrete floor). An as-built elevation certificate will be provided prior to issuance of final occupancy. The applicant shall also provide information demonstrating the following standards are met by the proposal: In all flood hazard areas, the following standards are required: Anchoring – All New Construction: All new construction and substantial improvements shall be anchored to prevent flotation, collapse, or lateral movement of the structure. Nonresidential Construction: New construction or substantial improvement of any commercial, industrial or other nonresidential structure shall have the lowest floor, including basement, elevated a minimum of one foot (1') above the level of the base flood elevation, or, together with attendant utility and sanitary facilities, shall: 1.Be floodproofed so that below the minimum elevation required in this subsection G the structure is watertight with walls substantially impermeable to the passage of water; 2.Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; 3.Be certified by a registered professional engineer or architect so that the design and methods of construction are in accordance with accepted standards of practice for meeting provisions of this subsection based on their development and/or review of the structural design, specifications and plans. Such certifications shall be provided to the Administrator; 4.Nonresidential structures that are elevated, but not floodproofed, must meet the same standards for space below the lowest floor as described in this subsection G. At this time, your project has been placed “on hold” pending installation of the public information sign. The maximum time for resubmittal shall be within ninety (90) days of this written notice. You do not actually need a BFE certificate. To speak to your second question, the lack of an exemption just means we have to consider the items I put in your letter as part of our decision. If you were exempt, we would not need this information because we could just issue a letter of exemption in place of this consideration. I will be issuing a combo permit that will be an exemption from everything we can exempt the project from, but also include findings that we have looked at flood concerns and they will not be an issue. We can still approve the project under the replacement clause you mentioned, we just have to approach it slightly differently. The poles will be set at a minimum of 10 ft in the ground, in steel caissons filled with ¼” or less compacted rock. The weight of the poles, conductors, and hardware prevent floatation. I can provide the construction engineering plans, which will be signed off by a professional engineer (PE) employed by Seattle City Light, and we can look up or have a surveyor provide the NAVD 88 for the elevations of the poles within the flood plain. But we’re a little confused by the request for flood elevation certificates. We are replacing, existing utility poles that are nearing their end of useful life, before there are emergency conditions, not constructing new buildings with finished floors, basements, or foundations. Can you please clarify? Would the engineering drawings approved by a PE and NAVD 88 elevations suffice? Finally, just to better my understanding of the Cith of Renton Municipal Code, can you further explain the denial of the exemption request for Flood Plains? I see that Flood Hazard Areas are not included as exempt under RMC 43-5-030 g.i. or ii, nor under RMC 43-5-030 e.ii, iii or iv. But I thought that the pole replacements would be exempt under RMC 43-5-030 g.iv (Existing Activities) and/or RMC 43-5-030 g.iv (for the pole we are relocating outside of the shoreline buffer). Thank you for the clarification – this is the first jurisdiction I have come across that is more stringent than the State code WAC 197-11-800, which allows for the minor repair or replacement of structures even where undertaken wholly or in part on lands covered by water. As communicated previously, Seattle City Light (SCL) needs to replace nine (9) transmission poles that are reaching their end of useful life and that are present in the right-of-way within the jurisdiction of the City of Renton. Eight (8) of the nine (9) poles fall within a critical area, and of those, six (6) fall within a 100-year flood hazard area – the critical area for which additional information has been requested. I am pleased to provide the requested engineering drawings certified by an SCL Professional Engineer with elevation data as a component of the application. The six (6) transmission poles within a flood hazard area include (from West to East): 24/463, 24/404, 24/374, 24/337, 24/297, and 24/257 and are labeled and highlighted in red text in the enclosures to distinguish them from poles not to be replaced and/or not within a flood plain hazard area. The applicant shall submit evidence that the proposal is in compliance with the following code requirement: Compensatory Storage Required: Development proposals and other alterations shall not reduce the effective base flood storage volume of the floodplain. If grading or other activity will reduce the effective storage volume, compensatory storage shall be created on the site or off the site if legal arrangements can be made to assure that the effective compensatory storage volume will be preserved over time. Compensatory storage shall be configured so as not to trap or strand salmonids after flood waters recede and may be configured to provide salmon id habitat or high flow refuge whenever suitable site conditions exist and the configuration does not adversely affect bank stability or existing habitat. Effective base flood storage volume shall be based on the elevations shown in the flood hazard areas map, identified in subsection E3 of this Section or as determined through a study where no base flood evaluation information exists. At this time, your project has been placed "on hold" pending the submittal of the above information. The maximum time for resubmittal shall be within ninety (90) days of this written notice. Hi Maura, Management has reviewed the final decision and we are almost there, but the Current Planning Manager did not feel that we have adequately addressed this code requirement with the document you sent over: Compensatory Storage Required: Development proposals and other alterations shall not reduce the effective base flood storage volume of the floodplain. If grading or other activity will reduce the effective storage volume, compensatory storage shall be created on the site or off the site if legal arrangements can be made to assure that the effective compensatory storage volume will be preserved over time. Compensatory storage shall be configured so as not to trap or strand salmonids after flood waters recede and may be configured to provide salmonid habitat or high flow refuge whenever suitable site conditions exist and the configuration does not adversely affect bank stability or existing habitat. Effective base flood storage volume shall be based on the elevations shown in the flood hazard areas map, identified in subsection E3 of this Section or as determined through a study where no base flood evaluation information exists. She would like something in writing and signed by the engineer saying that you will not be changing the overall size of the pole within the flood plain. That is, your replacement pole will not be bringing in addition fill or losing fill as part of the proposal. A letter would suffice, stating that the poles are the same size and will not change the storage volume.
