of the state of Washington,that he/she(they)wilJ observe,�ortsent to, and abide by the tonditions
and obligations set fortf� and descrElaed in Paragraphs 1 through 9 below with regard to the
Property, and hereby grants (grant) an easement as described in Paragraphs 2 and 3. Grantor(s)
hereby grants(grant), covenants (covenant}, and agrees (agree) as follaws:
1. The Grantor(s)or his/her{their}successors in interest and assigns{"Owners")shall at their own
cost,operate, rnaintain, and keep in gpod repair, the Property's drainage facilities constructed
as required in the approved construction plans and specifications R—3 9 62 (Project
Plan#) on fiife with the City of Renton and submitted to the City of Renton for the review and
approval of permit(s) 170�2683 (ConstrLction/Building/UtilityPermit#J.Th�
Property's drainage faciiities are shown and/or listed on Exhihit A—Site Plan. The Property's
drainage facili#ies shaEl he maintained in compliance with the operation and maintenance
schedule included and attached herein as Exhibit B—Operations and Maintenance. Drainage
facilities include pipes, channeis, flow control facilities, water quality #acilities, on-site best
management practices (BMPs� and other engineered structures designed to manage and/or

#reat stormwater on th� Property. On-site BMPs include dispersion artd infiltration devices,
bioretention, perrneable pa�emen#s, rainwater harvesting systems, tree retention credit,
reduced impervious surface footprint,vegetated raofs and ather measures designed to mimic
pre-de�eloped hydrology and miniinize stormwater runoff on the Property.
2. City of Renton shal! have the right to ingress and egress o�er those portions of the Property
necessary to �erforrr� inspectians of the stormwater faciJities and BMPs and co�duct
maintenance acti�ities specified in #his a�e�aration of Co�enant and in atcordance with the
Renton MunicipaE Code. City of Renton shall provide at least thirty (3D) days'written notice to
t�e Owners that entry on the Property is planned for the inspe�tion of drainage facilities.After
the thirty (30) days,#he Owners shall allow the City of Renton to enter#or the sole purpose af
inspecting drainage facilities. In lieu of inspection by the City,the Owners may elect to engage
a licensed civil engineer registered in the state of Washington who has expertise in drainage to
inspect the drainage facifities and pro�ide a written report describing their condition. If the
engineer option is chosen,the Owners shall provide written natice to the City of Rertton within
fifteen(15)days of recei�ing the City's notice of inspection.Within thirty(30� days of giving this
notice,the Owners,or engineer on behalf of the Owners,shall provide the engineer's report to
the City of Renton. If the report is not pro�ided in a timely manner as spetified abo�e,the City
of Renton may inspect the drainage faciiitfes wit�out further notice.
3. If City of Renton determines fram its inspection, or from an engineer's report provided in
accordance with Paragraph 2,that maintenante, repair, restoration, and/or mitigation work is
required to be done to any of the drainage facilities, City of Renton shall notify the Owners of
the specifiic maintenance, repair, restoration, antt/or mitigation worf� ("Work") required
pursuant to the Renton Municipal Code. The City sfiall also set a reasonable cleadline for the
Owners to complete the Wark, or to provide an engineer's report tha#verifies campietion of
the Work. After the deadline has passed, the Owners shall allow the City access fo re-inspect
the drainage facilities unless an engineer's report has been provided �erifying compfetion of
• the Work. If the Work is nat tompleted within the time frame set hy the City, the C9ty rt�ay
initiate an enfarcement action and/or perform fihe Woric and hereby fs gi�en aecess #o the
Property for such purposes. Written notice wifl be sent to #he Owner5 stating the �ity's
intention to perform such Work.This Work wili not commente until at leas#se�en(7)days after
such notice is maiEed. It, within the sole discretion of the City, there exists an imminent or
present danger, #he seven (7) day notice periad will be waived and Wor[c will begin
imrr�ediately.
4. The Owners s�all assurr�e all responsibility far the cost of any Work,or any m�asures taken by
the City to acfdress conditions as destribad in Paragraph 3. Such responsibility shall include
reimbursernent to th�City within thirty(30)days of the re�eipt of the invoice€or any such Work
performed. Overdue payr'►'�eRts will require payrnent of interest at the maximum legal rate
allowed by RCW 19.52.020(currently twel�e per�en# (1Z%)}, If the City in9tiates legal actian to
enfarce this agreement, the pre�ailing party in such activn is entitlec� to reto�er reasonable
litigation costs and attorney's fees.
5. The Owners are required to obtain writt�n approva!frorn City of Renton �rior to filling, piping,
cutting, or remo�ir�g vegetation (excepC in routine landscape maintenance] in open vegetated
stormwater facilities (such as swales, channels, ditches, ponds, etc.), or performir�g any
alterations ar modifications to the drainage facilities referenced in this Declaration of Covenant.

6. Any notice or consent required to be gi�en or otherwise pro�ided for by the provis9ons of this
Agreement shall be effettive upon personal delivery, or three(3) days after mailing by Certified
Mail, return receipt requested.
7. W ith regard to the matters addressed herein,this agreement constitutes the entire agreernent
6etween the parties, and supersedes all prior discussions, negotiations, and all agreements
whatsoever whether oral or written.
8. This Declaration af Ca�enant is intended to protect the value and des�rabili�y and promote
efficient and effective management af surFace water drainage af the real property described
above, and shakl ir�ure to the benefit of a!1 the citizens of the City of Rentan and its successors
and assigns. This �eclaration of Covenant shall run with the land and be bir�ding upon
Grantor(s), and Grantor's(s') successors in interest, and assigns.
9. This Declaration of Co�enant may be terminated t�y execution of a written agreement by the
Qwners and th� City that is recorded by King County in its real property records.

ON-VEGETATED
Your property contains an on-site BMF(best manageznent practice)called"permeable pavement,"
which was installed to minimize t}�e stormwater quantity and quality impacts of some or all of the
paved surfaces on your property.
Permeable pavements reduce the amount of rainfall that becomes runoff by allowing water to seep
#hrough the pavement into a free-draining grave] or sand bed,where it can be infil#rated into the
ground. This on-site BMP shall b�tnaintained per Appendix A af the City of Renton's Surface Water
Design Manuai.

MAINTENANCE RESTRtCT10NS

maintained as permeable pavement and may not be changed without written approval fronn the City of
Renton or throup,�z a future development perniit from the City ofRenton.
INSPECTION FREQUENCY AND MAlNTENANCE GUIDELINES
+ Pe�rr►eable pavements xnust be inspected after oz�e major storm eac�year to make sure iE is
working properly. More frequent inspection is recornmended.
• Pralonged ponding or standing water on the pavement s�rface is a sign that tf�e system is
defective and may need to be replaced. If this occurs, contac#the pa�ement in,staller or the City
o�Renton for further instriictions.
• A typical permeable pavement system has a life expectancy of approximately 25 years. To help
. extend die useful life of the system,the surface of the permeable pavetnent should be kept
clean, stable and free of leaves, debris,and sediment through regular sweeping or vacuum
sweeping.Aggregate fill in modular grid pavement xnay need periodic surfacereplenishment.
• The owner is responsible for the repair of all ruts, deformation, and/or braken paving grids or
pavers.
+ Modular grid pavement and permeable pavers filled with gravel or with gravel in the joints
may need to be reflled periodically.
