property")shall at their own casC, operate,�77aintain,aa7d keep in goad repair,the Praperty's stonnwater
facilities and/or best rnarragement practices ("BMPs") constr�ucted as required in the approvec�
construction plans and specrfrcatians��t�����������on file with tlie City of Renton and submitted ta the
Crty c�f C�enton for the review and approva] af' pernnit�(s) �����y�q��� , '1`��
property's stannwater faciliries and/ar best management practices ("BMPs") are shown and/or listed on
F�►il�it A. The property's storm�rater facilities and/or BMFs shall be maintained in compliance with the
operation and�na�intenance schedule izlcluded and attaclaed herein as�xhibit B. Stormwater facilities
inciude pipes,swales,tanks,vauits,l�onds, and other engineered structures designed to manage a17dJor
treat stormwater on the Property. Stormwater F3MPs inchide dispersion and infiltratian devices,iiative
vegetated areas,penneable pavements,vegetated raofs,raimuater harvesting systeins,reduced impervious
surface coverage, and other measures designed to reduce the ainount of stornawater runaff on thc
Froperty.
2. City of Renton shall have the right to ingress and egress aver those partions of the Fraperty
necessary ta perforni inspectians of the stonnwater facilities and BMPs and c�nduct maintenance
activities specified in this Declaration of Covenant and in accordance with RMC 4-6-030.
3. If City of Renton deternlines that maintenance or repair work is required to be dane to any of
the stormwater facilities or BMPs, City of Renton shall give notice of the specific maintenance and/or
repair work required pursuant to RMC 4-6-030. The City shall also set a reasonable time in which such

work is to be completed by the Owners. If the above required inaintenance or repair is not completed
within the time set by the City,the City may perform the required rnaintenance or repair,and hereby is
given access to the Property, subject to the exclusion in Paragraph 2 above,for such purposes. Written
notice will be sent to the Owners stating the City's inte�ntion to perform such work. This work will not
commence until at least seven (7) days aiter such notice is mailed. If,within the solc discretion of the
City,there exists an imminent or present danger,the seven (7) day notiee period will be waived and
maintenance and/or repair work will begin immediately.
4. If at any time the City of Renton reasonably detennines that a stormwater facility or BMP on
the Propert.y creates any of the hazardous conditions listed in R:vIC 4-4-060 G or relevant rnunicipal
successor's codes as applicable and herein incorporated by reference,the City may take measures
specified therein.
5. The Owners sha11 assume all responsibility for the cost of any maintenance or repair wark
cotnplet:ed by the City as described in Parab aph 3 or any measures taken by the Crty to address hazardous
canditions as described in�'aragraph 4. Such res�onsibility shail include reimbursement to the City
within thirty(30) days af the receipt of tlle�invoice for any such work perforrr►ed. Overdue payrnents will
require pay�nent of interest at tlie�cui�rent l�gal ratie as liquidated darnages. if legal acticrn ensues,the
prevailing party is entitled to recover reasonable litigat�ion costs and attorney's fees.
6. The dwners are hereby required ta obtain written appraval froin City of Renton prior ta
fillin�?,pipin.g,cutting,or reinaving vegetatian(except in rnutine laiadscape maintenance) in open
vegetated storn�water fa�cilities(such as swales,cha�nnels,ditches,ponds, etc.),or perforniing auy
alterations or modifications ta the stonnwater facilities and BMPs referenced in this Declaration of
Covenant.
7. Any natice or consent required to be given or otherwise provided for by the provisions of this
Agreeinei�t shall be effective upon personal delivery, or three(3) days after mailang by Certified Mail,
return receipt requested.
8. With regard to t11e matters addressed herein,this agreemezlt canstitutes the entire agreement
between khe parties,and supersedes a11 prior dasaussions,negotiations, and all agreeinents wha�tsoever
whether oral or written.
9. Tlus Declaration of Covenant is intended to pi•o�ect the value and desirability of khe rcal
property described above,and shall inure to the benefit raf a11 ihe citizens of the City of l�.enton and its
successors and assigns. This Declaration af Covenant shall run with the land and be binding upon
Grantox•(s),and Grantor's(s') successars in interest, and assi�,ms.
10. This Declaration of Cavenant may be terminated by executiox�af a written agreeinent by the
Owners and the City that is recorded by King Caunty in its real property recards.

Operations & Maintenance Manual
Project Overview
This Operations and Maintenance Manual is for Sunset Court Apartments located at1144— 1156
Harrington Ave NE,Renton,Washington. The proposed project includes construction of four new
aparhnent buildings and associated improvements.
Stormwater System Overview
In summa_ry, sto_r_mwater runoff from the proposed development will be collected in under�round
conveyance pipe and routed to one of two detention facilities. Stormwater runoff from the parking
lo±will pass thro»gh one of foux StormFilter system(with ZYG cartridges) for water q�aality
treatment. The stormwater system also includes four bioretention areas for mitigation of a portion
of the new roof areas.
Each detention facility will have a designated flow control structure. Discharges from the flow
control structures will combine in an 8-inch conveyance pipe prior to leaving the site and entering
the 12-inch public storm drainage system in Harrington Ave NE.
Detention Pipe Maintenance
A 36 is diameter detention pipe with 3 associated access risers spaced at no more than 100 feet is
located along the southern and eastern boundaries of the parking lot drive aisle. Refer to the
attached maintenance requirements from Appendix A of the 2009 King County Surface Water
Design Manual(KC SWDM)for Detention Tanks and Vaults.
StormTech Chamber Maintenance
A StormTech Chamber system for detention purposes is located within the center of the
development with an approximate footprint of 20' x 40'.Maintenance associated with the
StormTech Chamber system includes regual inspection through a manhole to inspect the isolatar
row and sediment removal if sediment buildup in the isolator row has reached an average epth of 3-
inches. Inspection and maintenance guidelines for the StormTech isolator row chambers have been
included with this Operations and Maintenance Manual.
Flow Control Structure Maintenance
There are two flow control structures, one for the StomTech Chamber system at the center of the
development and one for the detention pipe beneath the parking lot. Each flow control structure
will be within a Type 2-54"diameter storm drain manhole with a solid locking lid.
The flow control structure for the StormTech Chamber system is located at the southwest corner of
the chambers. The flow control structure for the detention pipe is located at the west end of the
parking lot just south of Building 2.Refer to the attached maintenance requirements from Appendix
A of the 2009 KC SWDM for Flow Control Structures/Flow Restrictor.

StormFilter Treatment System
There are four StormFilter Treatment Systems located within the parking lot for water quality
treatment of the parking lot runoff. The Treatment systems will have 1 or 2 ZPG(Zeolite,Perlite,
and Granular activated carbon) StormFilter Cartridges. Refer to the attached maintenance
requirements from Appendix A of the 2009 KC SWDM for StormFilters.
Maintenance Responsibility
This (lperations and Maintenance Manual shall be kept in the Sunset Court Apartment main ottice,
and a copy shall be kept at the Renton Housing Authority office. This manual must be made readily
available for inspection by City of Renton personnel.

12.1 ISOLATOR ROW INSPECTION
Regular inspection and maintenance are essential to assure
a properly functioninq stormwater system. Inspection is
easily accomplished through the manhole or optional
inspection ports of an Isolator Row. Please follow local
and OSHA rules for a confined space entry.
Inspection ports can allow inspection to be accomplished
completely from the surface without the need for a con-
fined space entry. Inspection ports provide visual access
to the system with the use of a flashlight. A stadia rod
may be inserted ta determine the depth af sediment.
If upon visual inspection it is found that sediment has
accumulated to an average depth exceeding 3"(76 mm),
cleanout is required.
A StormTech Isolator Row should initially be inspected
immediately after completion of the site's construction.
While every effort should be made to prevent sediment
from entering the system during construction, it is during
this time that excess amounts of sediments are most
likely to enter any stormwater system. Inspection and
maintenance, if necessary, should be performed prior
to passing responsibility over to the site's owner. Once
in normal service, a StormTech Isolator Row should be
inspected bi-annually until an understanding of the sites
characteristics is developed.The site's maintenance
manager can then revise the inspection schedule based
on experience or local requirements.
12.2 ISOLATOR ROW MAINTENANCE
JetVac maintenance is recommended if sediment has
been collected to an average depth of 3"(76 mm) inside
the Isolator Row. More frequent maintenance may be
required to maintain minimum flow rates through the
Isolator Row.The JetVac process utilizes a high pressure
water nozzle to propel itself down the Isolator Row while
scouring and suspending sediments.As the nozzle is
retrieved, a wave of suspended sediments is flushed back
into the manhole for vacuuming. Most sewer and pipe
maintenance companies have vacuum/JetVac combi-
nation vehicles. Fixed nozzles designed for culverts or
large diameter pipe cleaning are preferable. Rear facing
jets with an effective spread of at least 45" (1143 mm)
are best.The JetVac process shall only be performed
on StormTech Rows that have AASHTO class 1 woven
geotextile over the foundation stone (ADS 315ST or
equal).
