MrMayorandcouncilmembers,Iamherebeforeyouagaintopleadformycarport.IhavegonethroughthepermitprocessasIwasadvisedbythecityattorneyaftermyhearingwherehetoldmethecouncilwantsmetogothroughthepermitprocess.OnFridayIreceivedadenialofmypermitandreasonableaccommodationrequest.Theirrulingiscompletelyflawed.TheyarenotacknowledgingthefactthatIamunabletogetbothvehiclesinthegarage(seeattacheddrawing)andbeabletogetmywheelchairandselfoutofthecar.Ihaveofferedtodemonstratethisfactandhaveofferedthemuseofawheelchairsotheycanshowmehowtodoit.Theydon’tseemtounderstandthenecessityofhavingimmediateaccesstotheelectricalpanel,hotwaterheaterandwatershutoftvalvewhichisdeniedmewiththevehiclesinthegarage.Everyhomeownershouldhaveimmediateaccesstothesecomponents.TheyclaimthatIhavechosentousemygarageasawoodshopandstorageareainsteadofaparkingarea.TheysaythatIcanbuildawoodshopinmybackyard.Thegarageistheonlypracticalplaceforthewoodshop.Icangetasheetofplywoodoutofmytuckandintothegarageandtothetablesaw.Ican’tgetasheetofplywoodallthewaytoashopinthebackyard.AgainIhaveofferedtheuseofawheelchairsotheycanshowmehowtodoit.Theyclaimthatitisnotnecessarytoallowthecarporttoencroachintothesetbacktoaffordmetheequalopportunitytouseandenjoymydwellinglikeeveryoneelseintheneighborhood,yetmostofthehouseholdsusetheirgarageforstorageandsuchotherthanparkingspace,whichtheyaredenyingme.ThepeoplewhousetheirdrivewaystoparktheirvehiclescangetoutandintotheirhomesinbadweathermuchquickerthanIcanandtheycanwalkthroughsnowwhenmorethan2”ofsnowisaproblemforme.Theyclaimthecarportconflictswiththecharacteroftheneighborhood,yetIsubmittedasurveyItookofmosteveryhousehold(22)withinablockofmyhomewhicheveryonerepliedthatthecarportisnotadetrimenttotheneighborhoodandagreewiththereasonableaccommodationrequest.Everyonelikesthelookofmyproperty.Iregularlygetcomplimentsonmypropertybythepeoplewhowalktheneighborhoodandpeoplewhodriveby.Ihavepaidthepenaltyforapplyingforapermitafterconstructingthecarportbypayingdouble,$626.37,Iexceptresponsibilityforthat.Ialsohadtopayanengineeringfirm$3,970toconfirmwiththemanufacturerofthecarport,Versatube,thatitcanwithstanda20psfsnowloadanda115mphwind.ThecitywouldnottakethewordofVersatube.Theywouldnottakemypermitapplicationwithouttheengineeringcalculations.IbelievetheCityofRentonisdirectlyresponsibleformyforcedmovefrom330ParkAveNinthatthecitywouldnotissuepermitstobuildtheSatoriElementaryschoolwithmyhousestillstandinginsistingtheschooldistrictmustpurchaseallthepropertiesonthatcityblock.IhadtogiveupmyhomeIspentmywholewheelchairlife(26years)in,andhadsetupformetoremainindependentfortherestofmylife,forthegoodofthecommunity.Thecityhastheabilitytograntthecarportbymeansofthereasonableaccommodationrequest.I’maskingthecounciltograntthepermitforthecarportandendthishorribleexperience.TheysayIcanappealthedecisioninwritingandpayafee,whichIwilldoifIhaveto.IwouldaskthecounciltowavethefeeasthepeoplewhomadethisdecisionhavecompletelynotconsideredmyreasonableaccommodationrequestorbelievewhatIhavesubmittedinthatrequest.Theyhavemadetheirdecisionwithoutdirectknowledgeofthesituation.Ioffertothecounciltocomesitinmyspatewheelchairandtrytoparkmyvehiclesinthegarageandgetthewheelchairinandoutandtransferintothechair,andthentrytomoveasheetofplywoodfromthedrivewaytothebackyardusingawheelchair.

GarageDrawingDescriptionBothvehiclesmusthavedriversdooropentothecenterofthegarage.Onevehiclepulledinfrontwayandtheotherbackedin.Totryparkingwithdriversdooropeningtothewallsideofthegaragewouldtrapmeonthesideunabletogetoutaroundthebiggaragedoor.Duetotheslopeofthe5’ramp(3/20slope,publiccodeforrampsis1/11)1requireroomtogetarunattheramptogetuptothelanding.Thereisnotenoughroomonthesidesofthelanding.Theremustbealandingatthegarage/housedoortoallowmetoopenthedooranditmustbebigenoughformetosafelyturnaround.WithbothvehiclesparkedinthegarageIamdeniedaccesstotheelectricpanel,hotwaterheaterandwatershutoffvalvewhichdoesnotaffordmethesameuseandaccessasablebodypersons.Havingimmediateaccesstothesethreecriticalcomponentsisarightofeveryhomeownerandasafetyissue.WithbothvehiclesparkinthegarageIcan’taccessshelvesonbothsidesofthegaragelikeablebodypeoplecan.Ican’tgettotherefrigerator.Thisdoesn’tprovidemeequalopportunitytouseandenjoymydwelling.Truckmeasurementsarefrompassengersidemirrortodriverssidedoor,width,andfrombumpertobumper,length.Thetruckdooris46”longandrequires39”toopenalltheway.TheFalconmeasurementsarethelengthofthebumper,width,andfrombumpertobumper,length.TheFalcondooris48”longandopensat42”alltheway.Allowing12”betweenthevehiclesandthesideofthegaragedooropeningisreasonableandsafe.Thedistancebetweenthevehiclesis30”.Thereisnotenoughroomtogetthedoorsopenallthewayasisrequiredformetogetinandoutofthevehiclesandbeabletotakeapartandassemblethewheelchair.Afterthinkingaboutit,Igotmydrawingalittlewrong.ThetruckshouldbepulledinfrontwaysontherighthandsideofthegaragesothatthetailgatecouldbeaccessedandIcouldunloadmyboxofgroceries.TheFalconwouldhavetobebackedinontheleftside.Itdoesn’tchangeanydimensions.
FactsandOpinionsthatIcan’texpressinfiveminutes.Money;Ireceivejustover$1,100SocialSecurityamonthincometoliveon.IqualifyfortheSeniorCitizenandDisabledLowIncomePropertyTaxExemptProgramwhichisdesignedtohelpusaffordtostayinourhomeswherethequalityoflifeisgreatest.Theprogramtakestheassessedvalueofyourpropertytheyearyouapplyandfreezesitforaslongasyouqualifyandliveinthehome.Ittakesthatvalueandeithertakes60%or$60,000off,whicheverisgreater.At330ParkAveNmyassessedvaluewas$75,500$60,000=$15,500taxable.BecauseIwasforcedtomoveforthegoodofthecommunityIlostthatvalue,itisnottransferabletoanewproperty.At10935SE182ndStmyassessedvaluewhenIboughtthehomewas$285,000-60%($171,000)=$114000taxable.Thisisa735%increaseIhavetosuffertherestofmylife.WhatdidIdotodeservethisfinancialpunishment.ThankYouRenton!!!Theexpensetobuildawoodshopinthebackyardisfargreaterthanbuildingacarportandusingthegarageasawoodshop.MygarageatParkAvewasmywoodshop.TheRentonSchoolDistrictdidnotgivemeanymoneytobuildawoodshopinmybackyard,noranymoneyforthecarportthatIhadortheoneIbuilt.Againit’snotpracticalorreasonabletohaveawoodshopinthebackyard,howdoIgetasheetofplywoodfromthedrivewaytoashopinthebackyardusingawheelchair?ThemoneythatIusedtobuildandnowhavingtospendtodefendmycarportiscomingoutofthemoneytheschooldistrictsettledonformetoremodelmykitchentomakeitmoteaccessibleandreplacetheG%#$%@*F&*%+?#carpetwithhardwoodflooring.Carpetandthewheelchairdon’tgetalongatall.Iamnowgoingtohavetosavemoneyforacoupleofyearstoaffordtoremodelandwillhavetodotheworkmyself.ThissetsmebacknowfiveyearsatleastgetbacktowhereIwasbecauseoftheforcedmoveforthegoodoftheRentoncommunity.CharacteroftheNeighborhood;Whatisthecharacteroftheneighborhood?Nooneintheneighborhoodhascomplainedaboutthecarport.Everysinglepersonthatregularlywalkstheneighborhoodhasstoppedandtalkedtome.TheyallpraisemeforwhatIhavedoneandcomplimentmeonhowmyplacelooks.SomepeoplehavesaidIhavethebestlookinghouseintheneighborhood.Mysurveywasansweredunanimouslythatthecarportisnotadetrimenttotheneighborhood.Noonefeelsitlowersanyonespropertyvalues.Allbutonelikesthelookofthecarport.OneresidentansweredN/Asayinghisopiniononthelooksofthecarportwasirrelevant.EVERYONEthinksitwouldbeareasonableaccommodationfortheCityofRentontoallowthecarportforthehandicappedtoaccesshisvehiclesduringinclementweather.Ihave100%supportofmyneighborhood.ThecarporthasbeenupnowfortwoyearswfthnocomplaintsandhasnotinterferedwiththefunctionoftheCityofRentoninanyway,shapeorform.Thecarporthasnoteffectedanyutilities,firedepartmentorpolice.Mymailboxisjustinsidethecarportbytheroadsothemailmandoesn’thavetocomeallthewaytomyfrontdoortodeliverthemail.IgethomedeliveryduetomycommunityboxisonthetoprowwhereIcan’treachit.EverythingIhavedoneat10935SE182ndSt,fromturningtheinaccessible1and3/4bathroomsintooneaccessiblebathroomlaidoutexactlythewaythe330ParkAveNbathroomwas,toinstallinghardwoodfloors,towideningdoors,tomakingtheyardaccessiblewithsidewalksandmakingraisedgardenbedssoIcanplayinthedirt,toplantingthesameplantsthatIhadbefore.I’mtryingtogetbacktowhereIwasbeforemyhouseot29years,26inawheelchair,wastakenfromme.IttookalongtimeformetogettheParkAvehouseset
upformetoremainindependent.Ifoundwhatworksformeandamjusttryingtogetbackthere.IfeellikeI’mbeingtreatedlikeacriminal.Remembermyhomewastakenfrommeforthegoodofthecommunity.ThecommunityinreturnshouldallowmetogetbackwhatIhad.Howisthatnotfair?Ifthishappenedtoyouoryourfamilymemberhowwouldyoufeel?Puffingupacarportthatharmsnooneoranything.Itdoesn’tdetractfromthecharacteroftheneighborhood,theneighborhoodhasspokeninfavorofthecarport.Thepeoplewhohavepassedjudgementonmeseemtohavenoconceptofwhatitisliketobeinawheelchair.Ihaveofferedawheelchairforthemtousetoshowmehowtogetmyvehiclesinthegarageandwoodtothebackyard,notakers.Theylackknowledgeandcompassion.Neveroncehasanyoneinthecompliancedepartmentofferedtohelpmefindawaytokeepthecarport.
DenisLawMayorCommunity&EconomicDevelopmentC.E.“Chip”Vincent,AdministratorJune21,2019JeffreyColee10935SE182ndRenton,WA98055VIAEmail:thejc63g.corn’SUBJECT:ReasonableUseAccommodationRequestforCarportat10935SE182St,RentonWA,98055DearMr.Colee:TheDepartmentofCommunity&EconomicDevelopment(CED)receivedyourResidentialAlterationBuildingPermitapplicationfortheconstructionofacarportat10935SE182St(B19001801)onApril5,2019.ThisletterservesasanofficialresponsetotheReasonableAccommodationrequestenclosedwithyourapplication.Thesubjectcarportwasconstructedwithoutapermitinthefallof2017.OnApril18,2018,aWarningofViolation(NOV)wasissuedforfailingtoobtainabuildingpermitforthestructure(CODE18-000191).AsecondNoticeofViolationwasissuedonMay10,2018.OnJune12,2018,aFindingofViolation(FOV)wasissuedduetothecontinuedlackofcompliancewiththeoriginalNOV.AftertheFOVwasissued,CurrentPlanningstaffperformedasitevisitinattempttodeterminewhetherornotthestructurewasincompliancewiththedevelopmentstandardsinRMC4-2-110.A.ThesubjectpropertyislocatedintheR8zoneandisthereforesubjecttoa20footfrontyardsetback.Duringthesitevisit,staffestimatedthattheunpermittedcarportencroachedapproximately15feetintothefrontyardsetbackzoneandwasconstructedlessthanfivefeetfromtheright-ot-way.OnJune27,2018,youfiledanappealoftheFOVdatedJune27,2018andonDecember11,2018theappealhearingwasheldwiththeHearingExaminer.OnJanuary11,2019,theHearingExaminerissuedanOrdertoCorrectwhichincludedtherequirementforyoutoeithersubmitabuildingpermitfortheunpermittedcarportstructureorcompletelyremovethestructure.InresponsetotheOrdertoCorrect,yousubmittedabuildingpermitapplicationforthecarportandincludedtherequestforareasonableuseaccommodation.Thereasonableuseaccommodationseekstoallowthecarporttoremaininitscurrentstateofencroachmentintothesetback.Accordingtothedocumentationyousubmittedforyouraccommodationrequest,youstatethatduetobeingawheelchairuser,thecarportisnecessaryinensuringthatyoucanenterandexityourvehicle
June21,2019Page2of3whileoutoftheelements.Youalsostatethatmaneuverabilityinyourattached,two-cargarageislimitedwhenbothcatsareparkedinthegarageandthatyoucannotaccesssystemssuchastheelectricpanelandwaterheater.Duetoyourinabilitytousethegarageasbothashopandparkingareaforyourvehicles,youclaimthatthecarportisnecessaryinordertoaffordyouthesameenjoymentoruseasAJ’O/U’C4tsITothers.gAftercarefulconsideration,staffhasdeterminedthatyourrequesttoallowthecarporttoencroachintopthesetbackisnotnecessarytoaffordyoutheequalopportunitytouseandenjoyyourdwellingandthereforethesetbackaccommodationdoesnotconstituteavalidreasonableuseaccommodationrequest.Thisdeterminationwasmadeforthefollowingreasons:1.TherequiredfrontyardsetbackfortheR-8zone,whereyourpropertyislocated,is20feet.Thecarportcurrentlyencroachesapproximatelyfifteen(15’)feetintothefrontyardsetback.Themajorityofsingle-familyhomesnearyourpropertywereconstructedinthelate1970sandalltwelveotherhomesonyourblockareinconformancewiththecurrentfrontyardsetbackrequirement.Inaddition,nostructureswithin300feetofyourpropertyencroachmorethanfive(5’)feetintothesetback.ThesignificantencroachmentofypurproppsedcarportfundamentallyconflictswiththecharacteroftheneighborhoodandisnotconsistentwiththezoningdevelopmentpatternthathasbeenestablishedTh2Sandinthesurroundingarea.2.Thepurposeofareasonableuseaccommodationistoallowforthealterationofcertaindevelopmentstandardstoensurepersonswithadisabilityareaffordedequalopportunitytouseandenjoyadwelling.Intherequestforaccommodationsubmittedwiththebuildingpermit,youstatethatthecarportisnecessaryinordertoallowyoutoaccessyourvehicleoutoftheelements.However,theexistingtwo-4/c!catattachedgarageonthepropertyalreadyallowsforthisandaffordsouthesamerihtasyourneighborswrioasoaveattachedtwo-cargarages.RecentGoogleStreetViewphotographytakenafterconstructionofthecarportshowsthatyouhaveessentiallyrepurposedyourgarageintoawoodshopandstoragearea,whichhascreatedtheneedforvehicleparkinginthedrivewayratherthanthegarage(Exhibit1).Likemostgarages,theintendedpurposeofyouraUarageasoriginallyconstructedp-ftLwastoaccommodatetheparkingoftwovehicles,Thelackofspacetoparkyourvehiclesisentirelyajy.)pfresultofyourdecisiontousethegarageforashopinsteadofitsintendedandmorecommonpurpose.UnderRentonmunicipalcode,alternativeaccessorystructuresandstorageoptionswouldallowforadditionalstoragethatwouldcomplywiththeCity’sordinancesandallowforyourexcessmaterialstobelegallystoredelsewhere.AccessorystructureswouldbeconsistentwiththeneighborhoodanddevelopmentpatterninthesurroundingareaandtheR-8zone.BasedonthematerialssubmittedtotheCommunity&EconomicDevelopmentDepartmentforreviewofbuildingpermitSf9001801,theabovefactsandcircumstances,aswellasthelegalrequirementsundertheRentonMunicipalCodeandstateandfederalLaw,theCityisdenyingyourapplication.Ifyouwishtoappealthisdecision,pleasesubmitawrittenrequestforappealandtheassociatedfeetothe

REASONABLEACCOMMODATIONIlivealoneandamresponsibleforthecareofthisproperty.Ineedthiscarporttoassureimmediateaccesstomyvehicles.Snowisamajorobstacleformeinmywheelchair.Myheelsandfootreststartplowingsnowatonlyacoupleofinchesthick.Icanpushverylittlesnowbeforemybackwheelsjuststartspinning.InordertogettothevehiclesdoorJwouldhavetoshovelthesnow.Itisextremelydifficulttoholdashovelfullofsnowandmoveawheelchairwithtwohandsonaslopeddriveway.Theotherproblemisgettingthesnowoffthewindshieldofthevehicles.WhenItrytoscrapethesnowoffitendsuponmylapandIstillcan’treachenoughofittofreeupthewindshieldwipers.Iwouldalsohavetoshovelmywaytothepassengersidetoattempttoclearthesnowofftheothersideofthevehicle.Itisnearimpossibleformetoscrapeiceoffthewindshield.IfI’mawayfromhomeanditsnowsmorethanthreeinches,whenIgethomeandgetmywheelchairout,puttogetherandgetinftIamstuckrightthereunabletomovecausemyfootrestandheelscan’tmovethesnowandthebackwheelsjustspin.I’mstuckandwillfreezetodeathandwillbeforcedtosuetheCityofRenton.AsofFebruary9,2019Ihave8”ofsnowandIhaveimmediateaccesstomyvehicleswithouthavingtoshovelsnow.IhaveexplainedthesituationofgettingwetterthanablebodiedpeoplewhengettingmeandmywheelchairinandoutofmyvehicleswhichseemstogarnernosympathyfromanycareeremployeesoftheCityofRenton.TheCityCouncil,whichiselectedandallowedtohavefeelings,seemstoempathizewithmysituation.WhenIgogroceryshoppingIbringineachbagoneatatimeonmylap,holdingthebagwithmyteethsoitdoesn’tfalloff,makingmoretripsintheweatherthusgettingwetterthananablebodiedperson.IthasbeensuggestedthatIcanparkmyvehiclesinthegaragetoavoidtheweather.Iamunabletoparkbothvehiclesinthegarageandgetmywheelchairoutandputtogetherthentransferintothechair,thedoorscan’topenenough.Withbothvehiclesinthegaragethereisnoaccessformetotheelectricalpanel,hotwaterheaterorwatershut-offvalveallofwhichshouldbeanabsolutemustforeveryhomeownertogettofast.IthasalsobeensuggestedthatIcanbuildashedinmybackyardtoputmywoodshopin.ThearrangementIhavenowmakesitsoIcangotothehardwarestoreandgetasheetofplywood,unloaditfrommytruck,slideitovertothetablesawandripitintostrips.Iwouldhavegreattroubletryingtogetasheetofplywoodtoashopinthebackyard.Ihaveasparewheelchairthatyoucansitinandshowmehowtodoit.Ialsoofferyoutheopportunitytogetinthewheelchairandtrytogetbothofmyvehiclesinthegarageandgetthewheelchairinandoutofthevehicles,showmehowitisdone.Thecarportisnotafirehazardasitismetal.Thereisnopoliceissueastheycaneasilyseeinsideandallaroundthecarport,thereisnoplaceforanyonetohideotherthanaroundthevehiclesthatarethereanyway.Thecarporthasalreadysurvivedacoupleofgoodwindstormswithoutanythinggettingblownoffandhurtinganyonein
theneighborhood.Wehavejusthadamajorsnoweventthatthecarporthandledthesnowloadjustfine.ThecarportissoundandposesnothreattothecommunityorthefunctionoftheCityofRenton.Beforetherewasacarport,thegaragehadtwogutterdownspoutsthatranoutontothedrivewayandthenrantothestreetandstormdrains.Thecarporthasgutterswiththewatercomingoffthegarageroutedintothem.Thedownspoutsonthecarportarelocatedclosesttothestreet.Allthewaterthatfallsonthegarageandcarportendsupinthesamestormdrainasbeforethecarportwasbuilt.Therearenowiresoverthecarport.Theincomingwaterisofttotheeastsideofthecarport.Theoutgoingsewerisfarofftothewestofthecarport.ThenaturalgaslinedoesgodiagonallyunderthecarportbutisnoconcernoftheCityofRenton.ThepowerlineisalsoburiedunderthedrivewayandcarportbutisnoconcernoftheCityofRenton.Ifeitherthegasorpowerlinesneedtobereplacedtheycanberoutedinfrontofandtotheeastofthecarport.Ihaveconductedasurveyoftheneighborhoodregardingthecarport.Iwenttoeveryhousewithinoneblockofmyhouse,oneblockeast,westandnorth.ItookmygrandsontoknockondoorsasIcouldn’tgettothedoorsmyself.Onemanwouldn’tcometalktome,onehouseholdhasaVietnamesecouplethatdoesn’tspeakenglish,onehouseisbeingrenovatedandthreeresidentsweren’thome.Alltherestansweredmysurvey.Ialsogotthreeladiesthatwalkandliveintheneighborhoodtoanswerthesurvey.Iaskedsixquestions,tryingtoaddresssomeoftheconcernsoftheCityofRenton;1.SafetyHazard:Doyoufeelthecarportisasafetyhazardtoyouortheneighborhood?Allanswered“No”.2.ObstructsView:Doyoufeelthecarportblocksorobstructsyourviewinanyway?Allanswered“No”.3.PropertyValue:Doyoufeelthecarportlowersthevalueofyourpropertyinanyway?Allanswered“No”.4.DetrimentToNeighborhood:Doyoufeelthecarportimpactstheneighborhoodnegatively?Allanswered“No”.5.ReasonableAccommodation:IsitareasonableaccommodationfortheCityofRentontoallowthecarportforthehandicappedtoaccesshisvehiclesduringinclementweather?Allanswered“Yes”.6.Appearance:Doyoufeelthecarportlooksgood?Oneanswered“N/A”,therestanswered“Yes”.Mostofmyneighborsmadecommentstotheeffectof“WhyistheCityofRentonharassingyouforyourcarportwhenyouaremakingyourplacelooksonice.Shouldn’ttheybegoingafterthehousesthataregarbagedumps?”Iseemtohave100%supportfromtheneighborhood.

eCitY0ettRecognizingConflictsMarch782014LO011’“tch”W”BetweenYourZoningOrdinanceandtheAmericansWithDisabilitiesActUkefTweetLastmonth,yourcommunity’sZoningBoardofAppealsconsideredanapplicationforavariancetoallowawheelchairramptoextendintoafrontsetbackarea.Therampwasnecessaryfortheapplicanttoentertheirhome,whichhadadoorthresholdseveralfeetabovegrade,requiringalongrampwithaturntomaintainthenecessaryslope.TheZBA,whilesympathetic,foundthattheapplicationdidnotmeetthestandardsforavariance—therequestwasnottheresultofanyuniqueconditionoftheproperty,butrathereacYthecircumstancesoftheapplicant.Intoday’smailyoureceivedanotificationfromtheUnitedStatesDepartmentofJustice,indicatingthatitwasinitiatinganinvestigationforallegedviolationsoftheAmericanswithDisabilitiesAct(“ADA”)andFederalFairHousingAct(“FFHA”),andthreateningpossiblefines,restitution,injunction,mandatorytraining,andongoingcompliancemonitoring.Manyyearsago,yourmunicipalityauditeditsbuildingsandfacilitiesandprogramstomakesuretheywereaccessibletopersonswithdisabilities.Whathadbeenmissed?PartIIoftheADAprohibitsdiscriminationagainstdisabledpersons,ordenialofthebenefits,servicesandprogramsoflocalgovernmentonthebasisofdisability.(Inessence,therequirementsoftheFFHAarethesameastheADArequirements).AccordingtotheregulationsimplementingtheADA:“Apublicentityshallmakereasonablemodificationsinpolicies,practices,orprocedureswhenthemodificationsarenecessarytoavoiddiscriminationonthebasisofdisability,unlessthepublicentitycandemonstratethatmakingthemodificationswouldfundamentallyalterthenatureoftheservice,program,oractivity.”These“policies,practicesandprocedures”includelocalzoningordinances.AccordingtotheTitleIITechnicalAssistanceManualpublishedbytheDepartmentofJusticeincludesthefollowingcommentary:“I1306000.Reasonablemodifications.
ll-361OOGeneral.Apublicentitymustreasonablymodifyitspolicies,practices,orprocedurestoavoiddiscrimination.Ifthepublicentitycandemonstrate,however,thatthemodificationswouldfundamentallyalterthenatureofitsservice,program,oractivity,itisnotrequiredtomakethemodification.ILLUSTRATION1:Amunicipalzoningordinancerequiresaset-backof12feetfromthecurbinthecentralbusinessdistrict.Inordertoinstallaramptothefrontentranceofapharmacy,theownermustencroachontheset-backbythreefeet.Grantingavarianceinthezoningrequirementmaybeareasonablemodificationoftownpolicy.”AnexampleofcourtcasesinwhichmunicipalitieswerefoundtohaveviolatedtheADAbynotwaivinggeneralordinancerequirementsisasituationinwhichadisabledhomeownersoughttobuildapavedparkingspaceinfrontoftheirhome.Anotherexampleinvolvedanordinancewhichprohibitedfrontorsidedriveways.Thefactthattheremightbeotheralternativeswhichcomplywiththezoningordinanceisnotsufficient;thefocusisonwhetherthemodificationwouldaffordpeoplewithdisabilitiesthesameopportunitiesthosewithoutdisabilities.Thus,forexample,arequesttoexpandagaragetoaccommodateanindoorwheelchairramptoaninternaldoorcouldnotbedeniedmerelybecauseanoutdoorwheelchairramptothefrontdoorcouldbeconstructedincompliancewiththezoningordinance.Theabilitytohaveindooraccessfromavehicle,especiallyduringwintermonths,maybenecessarytoallowapersonwithadisabilitythesameenjoymentoftheirhomeasotherpersons.InordertoqualifyforareasonablemodificationofthezoningordinanceundertheADA,anapplicantneednotmeettherequirementsforavariance.Rather,theapplicabletestis:•Whetherthepersontobeaccommodatedhasadisability.•Whetherthemodificationrequestedisreasonablynecessarytoaccommodatethatdisability.•Whetherthemodificationwouldfundamentallyandunreasonablyalterthenatureorpurposesofthezoningordinance.Theburdenisonthemunicipalitytoprovethiswouldoccur.FewzoningordinancesincludeproceduresforevaluatingarequestforaccommodationundertheADAorFFHA.Thisleaveszoningadministratorsandzoningbodiesinaquandarybetweenfollowingtherequirementsoffederallaw,ortheprovisionsoftheirownzoningordinance.
Asimplesteptocovermanysituationswouldbetoamendthezoningordinancetopermittheextensionofwheelchairrampsandliftsintosethackareas.AmorecomprehensiveordinancecouldincludeaprocedureformakingapplicationforanaccommodationundertheADA,assignmentofthedecisiontoazoningofficialorbodysuchastheZoningBoardofAppeals,andthestandardsfordecision.Anordinancemay,insomecases,providethattheaccommodationisnottransferrabletoanewowner,andmustberemovedifnolongernecessary.ItisimportantthatyourzoningofficialsrecognizethattheADAandFFHAcanrequiremodincationofthezoningordinance,understandardsdifferentthanthosewhichapplytoarequestforavariance.Inaddition,werecommendthatyouconsideramendingyourzoningordinancetoprovideaproceduretoconsiderrequestsforaccommodationundertheADAandFFHA.
