E. “Chip” Vincent, CED Administrator STAFF CONTACT:Paul Hintz, Senior Planner SUBJECT:Increasing Allowed Shopping Cart Deferrals In 2005 the City Council adopted an ordinance that declared shopping carts located on any property other than that of the cart’s owner to be a public nuisance. Regulations were developed in response to shopping carts being left in public right-of-ways and upon private property, which created obstructions for motorists, bicyclists, and pedestrians, as well as contributing to visual blight. The regulations reduced the nuisance of blight upon the community, but only nominally. In early 2016, more stringent regulations were adopted. The revisions to RMC enabled City staff to immediately impound any lost, stolen, or abandoned carts and issue a $100 fine for each impounded cart. Weekly shopping cart collections began in mid-April of 2016; however, in order to provide stores substantial notice, fines were not issued until early July. The blight of stray shopping carts was significantly reduced as a result of the more stringent regulations. On June 12, 2017, amendments to the regulations were adopted to allow up to three (3) fine deferrals in any given month if the store has implemented at least one approved security measure (e.g., electronically-activated self-braking wheels, utilization of a cart recovery service, etc.) and has affixed the required identification sign to each of their carts. If a business meeting these criteria “loses” four (4) or more carts in a month, fines are issued for all carts lost in that month. A representative of several stores recently requested the City to expand the fine deferral program to allow up to ten (10) shopping carts to be “lost” within a month before fines are issued. City staff is not supportive of such a high threshold; however, staff is supportive of increasing the threshold. Staff proposes to allow up to eight (8) carts of any store to be collected by the City each month before fines will be issued. On the following page are the number of carts the City collected for each month of 2018.
