1. The Grantor{s)or his/her(their)successors in interest and assigns("Owners°}sha(i at theirown
cost,operate, maintain, and keep in gooct repair,the Property's drainage facilities constructed
as required in the approved constructian plans and specifications R-3738 (Project
Plan#) on file with the City of Renton and submitted to the City of Renton for the review and
approval of perrr�it�s) U14000114 (ConstructionJBui/diny/UtilityPermit#).The
Pro�erty's drainage facilities are shown andJor listed on Exhibit A—Site Plan. The Property's
drainage facilities shall be maintained in compliance with the operation and maintenance
schedule included and attached herein as Exhibit B—Ciperations and Maintenance. �rainage
facilities inctude pipes, channels, flaw contro[ facilities, water quality facilities, on-site best
management practices (BMPs} and other engineered structures designed to rnanage and/or

treat stormwater on the Prc�perty. On-site BMPs include dispersion anc# infiltration devices,
bioret�ntion, permeabie pavements, rainwater harvesting syst�ms, tree retention credit,
reduced impervious surface footprint, vegetated roofs and other measures designed to mimic
pre-deveioped hydraingy and minimize stnrmwater runaff nn the Property.
2. City of Renton shall have the right to ingress and egress over those portions of the Praperty
necessary to perForm inspections of the stormwater faciliries and BMPs and canduct
maintenance activities specified in this Dec(aration ofi Covenant and in aecordance with the
Renton Mur�icipal Cade. City of Renton shalt provide at least thirty(30) days' �nrritten notice to
the Owners that entry on the Property is pianned for the inspection of drainage�acilities.After
the thirty(30j days,the Owners shall allow the City af Renton tv enter for the sole purpose of
inspecting drainage facilities. In lieu of inspectic�n by the City,the Qwners r�ay elect to engage
a licensed civil engineer registered in the state of Washirtgtan who has expertise in drainage to
inspect the drainage facilities and provide a written report describing their condition. If the
�ngineer option is chosen,the Owners shall provide written natice to the City of Renton within
�fteen(15}days of receiving the City's natice of inspection.Within thirty(30)days of giving this
nntice,the Owners,ar engineer on behatf of the Owners,shall pravide the engineer's report to
the City of Renton. If the re�ort is not provided in a timely manner as specified above,the City
of Renton may inspecE the drainage facilities witt�out further natice.
3. If City af Renton deterrnines from its inspection, or from an engineer's report provided in
accordance with Paragraph 2,that maintenance, repair, restoratian, and/or mitigation wor�c is
required to be dor�e to any of�he drainage facilities, City of Renton shall notify the Owners of
the specific maintenance, repair, restoration, and/or rnitigation work ("Wark") required
pursuant to the Rentan Municipal Code. The City shall also set a reasonable deadline far the
awners to complete the Work, or to provide an engineer's repc�rt that verifies completion of
the Wark. After the deadline has passed, the Owners shalt aliow the City access to re-inspect
the drainage facilities uniess an engineer's report has been provided verifying campletion of
the Wark. If the Wor� is not completed within the time €rame set by the City, the City may
initiate an enfo�cement action and/or perform the Wark and hereby is given access ta the
Property for such purposes. Written natice will be sent to the Owners stating the City's
intention tc,perform such Work.TMis Work urill not commence until at least seven{7�days after
such natice is mailed. If, wifihin the sole discretion c�f the City, there exists an imminent or
present danger, the seven (7) day notiee period will be waived and Work will begin
immediately.
4. The Owners shall assume all responsibifity for the cost of any Work, or any measures taken by
the C+ty to address canditians as described in Paragraph 3. Such respansibility shaH include
reimbursement to the City within thirty(30}days ofthe receipt of the invoice for any such Work
per�orrned. Overdue payments wi�l require payment of interest at the maximum fegal rate
allowed by RCW 19.52.1?20 (currentfy twelve percent (123'0)). If t�e City initiates legal action to
enforce this agreement, the prevailing p�rty in such action is entitled to recover reasanable
litigation costs and attorney's fees.
5. The Owners are required to pbtain written approual fram City of Renton prior ta filling, piping,
cutting, ar removing vegetation (except in routine landscape maintenance) in open vegetated
stormwater facilities (such as svvales, channels, ditches, ponds, etc.}, or performing any
alterations or madifications ta the drainage faci(ities referenced in this Deelaration of Covenant.

5. Any natice or consent required to be given or otherwise provided for by the provisions of this
Agreement shall be effective upon personal delivery,or three{3)days after rnailing by Certified
Mail, retur�r receipt requested.
7. V!lifih regard to the�atters addressed herein,this agreement constitutes the entire agreement
between the parties, and sup�rsec�es alt prior discussians, negc�tiatians, and a!1 agreements
whatsoever whether ora!or wrifiten.
8. This Decfaration Qf Carrenant is intended to prratect the va{ue and desirabifity and pramote
efFicient and effective management of sur€ace water drainage of the reai praperty described
above, and shali ir�ure to the k�enefit vf ail the citiaens of the City af Renton and its successors
and assigns. This �eclaration of Covenant shall run with the lanc� and be binding upon
Grantor(s�, and Grantor's(s') successs�rs in interest, and assigns.
9. This fleclaration of Cavenant may be terminated by exec�tion of a written agreement by the
4wners and the City that is recorded by King Caunty in its reat property records.

Your property contains an on-site BMP(best management practiee}called a"perforatet!'pipe
connection,"which was installed to reduce the stormwater runoff impacts of some or all of the
impervious surface on your property.
A perforated pipe connection is a length of drainage conveyance pipe with holes in the bottom,
designed to"leak"runof'�, conveyed by the pipe, into a gravei filled trench where it can he saaked inta
the surrounding soil. The cannectian is intended to provide oppartunity far inf Itration af any runaff
that is being conveyed from an imperviaus surFace (usually a roof}to a local drainage system such as a
c�itch or roadway pipe system. This on-site �MP shall be maintained per Appendix A o�the City of
Renton's Surface Water Design Manual.
MI0.ENTENANCE RESTRICTIONS
• The size and cnmposition of the��rforated pipe conneetion as depicted by the site plan and
design details must be maintained and may not be changed without written approval from the
City of Renton or through a future developmer�t peznait frana the City of Rentoi�.
• The soil avertop of the perfarated pflrtian of the system must not be campacted or covered
with impervious materials.
