Dhillon and Lakhbir Singh; Owners of the Subject Property, and the Grantee, the BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION on the following terms and conditions. The parties hereto agree that the owners of each listed lot in said plat shall be responsible to abide by the following Covenants, Conditions and Restrictions as herein presented or as may in the future by legally altered by the BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION under the terms and conditions as set forth in its Articles of Incorporation, including the By-Laws thereof, as filed and recorded with the State of Washington and/or within the records of King County, Washington: c:\documents and settings\bruce macveigh\my documents\simritdhillonccrrev02.doc1 r � • Item 1. Any party performing construction on any lot, commonly used easement or tract which requires permits from City of Renton or other jurisdictional agency must apply for and obtain a permit for such work. Work performed without an approved permit and which may be subject to corrective measures, restorations, fines or other penalties will be the responsibility of the party active in the work. • Item 2. The BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION shall be responsible for maintaining the private Roadway, Surface Water Drainage Facilities and Common Utilities, and other site amenities, in Tract"B"and in Tract"C" per the attached Mutual Maintenance Agreement for Roadway, Surface Water Drainage Facilities and Common Utilities. (Exhibit"A") Item 3. Parking shall not be permitted in the vehicular travel areas of Tract"B" and Tract"C". Item 4. The BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION shall be responsible for maintaining the entire General and Grounds Maintenance of Open Space and Recreational Facilities, Surface Water Drainage Facilities and Common Utilities for the designated common use Recreational Area known as Tract"D" per the attached Mutual Maintenance Agreement for General and Grounds Maintenance of Open Space and Recreational Facilities, Surface Water Drainage Facilities and Common Utilities. (Exhibit"B") Item 5. The ownership of Tract"A", upon which are located Surface Water Drainage Facilities, is retained by the BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION. The BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION shall be responsible for the care and maintenance of that portion of the property from the fence outward, to include the fence itself. The care, monitoring and maintenance of that portion within the fence, consisting of its Surface Water Drainage Facilities, is the responsibility of the City of Renton. The right of access through any portion of the property is granted the City of Renton as necessary for the care, monitoring and maintenance of the Surface Water Drainage Facilities. (Exhibit"C") Item 6. The BOB SINGH PLAT S.E. 191ST STREET HOMEOWNER'S ASSOCIATION shall be generally responsible for the care and maintenance of street trees in the public Rights-of-Way abutting the plat, with the further condition that those street trees abutting separate Lots shall be the responsibility of that particular Lot. Item 7.
