DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS
FOR THE PLAT OF HONEY CREEK HEIGHTS
KING COUNTY,WASHINGTON
THIS DECLARATION is made on this d' day of 449/L , 2000, by
LONDO-TIBERIO CONSTRUCTION, INC., a Washington corporation (hereinafter referred
to as "Declarant"), which is the owner of certain land situated in the State of Washington,
County of King, known as the Plat of Honey Creek Heights, defined and more particularly
described on Exhibit A (the "Plat"), which is attached hereto and incorporated herein by this
reference, which term shall be deemed to automatically include any additional properties
subjected to the terms of this Declaration as specified herein.
NOW THEREFORE,the undersigned hereby declares that all of Honey Creek Heights
as defined herein, and the buildings and structured hereafter constructed shall be, held, sold,
and conveyed subject to and burdened by the following covenants, conditions, restrictions,
and easements, which are for the purpose of enhancing and protecting the value and
desirability of Honey Creek Heights for the benefit of the Owners thereof, their heirs,
successors, grantees, and assigns. All provisions of this Declaration shall be binding upon all
parties having or acquiring any right, title, or interest in Honey Creek Heights or any part
thereof, and shall inure to the benefit of the Owners thereof and to the benefit of the
Association and are intended to be and shall in all respects be regarded as covenants running
with the land.
ARTICLE I
DEFINITIONS
Section 1.1: "Declarant" shall mean and refer to Londo-Tiberio Construction, Inc., a
Washington corporation, and its successors and assigns, if such successors or assigns should
acquire all or substantially all of the then undeveloped parcels of Honey Creek Heights from
Declarant for the purpose of development.
Section 1.2: "Mortgagee" shall mean and refer to the holder or beneficiary of any
recorded mortgage or deed of trust encumbering one or more of the Lots.
Section 1.3:
"Owner" shall mean and refer to the record owner (whether one or more

persons or entities) of a fee interest in any Lot, but excluding Mortgagees or other persons or
entities having such interest merely as security for the performance of an obligation.
ARTICLE II
COVENANTS
Section 2.1: Maintenance of Access Easement Area. The Owners of Lots 13 and 14
shall be jointly and equally responsible for the maintenance of the access easement over Lot
13 and serving Lot 14. Said access easement is described on the face of the plat.
Section 2.2: Maintenance of Access Easement Area. The Owners of Lots 5, 6, 7, and
8 shall be jointly and equally responsible for the maintenance of the access easement over
Lots 5 through 8 and serving Lots 5 through 8. Said easement is described on the face of plat.
Section 2.3: Drainage Covenant. Every Owner of a lot in the plat of Honey Creek
Heights shall be jointly and equally responsible for maintaining all of the drainage facilities
located in the plat of Honey Creek Heights.
ARTICLE III
GENERAL PROVISIONS
Section 3.1: Enforcement. Any Owner, shall have the right to enforce by any
proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and
charges now or hereafter imposed by the provisions of this Declaration. Failure by any
Owner to enforce any covenant or restriction herein contained shall in no event be deemed a

waiver of the right to do so. Failure by the Owners to enforce any covenant or restriction
shall result in the right of the City of Renton to enforce the covenant or restriction.
Section 3.2: Severability. Invalidation of any one of these covenants or restrictions
by judgment or court order shall in no ways affect any other provisions which shall remain in
full force and effect.
Section 3.3: Amendment and Extension. The covenants and restrictions of this
Declaration shall run with and bind the land, for a term of twenty (20) years from the date this
Declaration is recorded, after which time they shall be automatically extended for successive
periods of ten(10) years. This Declaration may be amended by an instrument signed by all of
the lot owners. Any amendment must be recorded with the King County Recorder.
