In consideration for the approval of Short Plat File No.LUA-96-085, SHPL by the City of Renton and pursuant to the conditions of that approval by the City of Renton,Ronald W.Munson and Elizabeth A. Munson, agree and declare as follows: 1. Grantors: Ronald W.Munson and Elizabeth A.Munson,husband and wife,(Grantors)are the owners of Lot 1 of Munson short plat No.LUA 96-085 - SHPL,legally described as follows: The South 100 feet of Block 60,N.H.Latimer's Lake Washington Plat,according to the Plat thereof recorded in volume 6 of plats,page 70,Records of King County, Washington. Together with the East Half of vacated Maple Avenue Northwest adjoining on the West which attached by operation of law. 2. Successors and Assigns: The covenants herein contained shall run with the land and are binding upon all subsequent owners thereof. 3. Basis for Covenant This covenant is designed to ensure compliance with the standard policy of the City Of Renton concerning connection of the above described property to the public sewer system. 0') 4. Covenant: Grantors hereby agree and covenant to the following conditions: A. To participate in, sign a petition in support of, and accept any Local Improvement District (LID): B. To participate in, sign a petition in support of any other City-initiated proposal,other than an LID, and pay their fair share thereof; C. Otherwise financially or physically participate in any proposal, City-initiated or otherwise, for the purpose of extension of the sanitary sewer main when required by the Renton Subdivision Ordinance or as directed by the Administrator of the Planning/Building/Public Works Department. Despite language in the City Code Section 8-5-2(d)the undersigned may be required to participate in or connect to a sanitary sewer,even if such sewer is installed by a developer for the purpose of meeting platting requirements and the undersigned is not an owner within the confines of said plat. Grantors acknowledges that the City of Renton strongly recommends that Lot 1 be removed from the dual side sewer and connected directly to the public sewer when it becomes available. Prior Agreements Grantor acknowledges that this Declaration of Sewer Covenant is a condition of the Munson Short Plat (File No. LUA 96-085, SHPL)by the City of Renton and that this covenant supersedes and takes precedence over language contained within the perpetual easement granted to the City of Renton under Recording Number 5506645 precluding this parcel from future local improvement districts for sanitary sewers.
