WHEREAS, the City of Renton, a municipal corporation, has established provisions for partial payment of
and/or limited exemption from System Development Charges (SDC) for portions of property subject to SDC a
fees by Ordinances No.4525 and 4526; and

owners of the real property as described on Exhibit "A" attached hereto, located in the City of Renton,
County of King, State of Washington; and
WHEREAS, the owners of said property have paid the SDC fees for 40.4 % of the property. Said
percentage representing the portion of the property in the process of being developed; and
WHEREAS, the owners of said property desire to impose the following restrictive covenants running with the
land as a condition placed on the title of the remaining undeveloped property regarding the requirement,
obligation, and promise to pay the SDC fees when that portion to the property is developed. The SDC fees
shall be payable at the rates in effect at the time a formal application is submitted which would invoke the
SDC fees.
NOW, THEREFORE, the owners hereby establish, grant, and impose restrictions and covenants running with
the land herein above described with respect to the substantial open space area described as follows:

The owners of the above described property, their successors, heirs, and assigns, hereby agree and
covenant to pay the System Development Charge, at the rate in effect at the time of formal application
for development of the above described parcel.
These covenants are imposed in lieu of Section 5 , of Title 8 , of Ordinance No. 4525 , of
the City of Renton.{sewer}

These covenants shall run with the land and shall not expire. If at any time the SDC fees are paid for
the exempted area pursuant to these covenants, the portion of the covenants pertaining to the specific
exempted area as required by the ordinances of the City of Renton shall terminate by the filing and
recording of a Partial Satisfaction of System Development Charges release form with King County.
Any violation or breach of these restrictive covenants may be enforced by proper legal procedures in the
Superio .• - of King County by either the City of Renton or any property owners adjoining subject
