(CONNER HOMES,VAC-04-001) WHEREAS,a proper petition for vacating a portion of unimproved road located on 140th Avenue S.B.between S.E.132nd Street and S.B.136th Street was filed with the ...-i City Clerk on or about April 15,2004,and that petition was signed by the owners ~ 0) o o representing more than two-thirds (2/3)ofthe property abutting upon the street or alley too o::l' N C"1 be vacated;and o Lf) o o WHEREAS,the City Council,by Resolution No.3691,passed on May 17,2004,set N '*i=June 14,2004,at 7:30 p.m.in the City Council Chambers of the City of Renton as the time and b"l .~place for a public hearing on this matter;and the City Clerk having given proper notice of this 'D Hoo (J) P:: in opposition on this matter,and the City Council having considered all information and arguments presented to it;and WHEREAS,the Administrator of the Planning/Building/Public Works Department has considered this petition for vacation,and has found it to be in the public interest and for the public benefit,and that no injury or damage to any person or properties will result from this vacation; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON,DOES ORDAIN AS FOLLOWS: SECTIONL The following described portion of unimproved road located on 140th Ave~ue S.E.between S.E.13200 Street and S.E.136th Street,to wit: 1 ORDINANCE NO.5128 [The right-of-way 20 feet in width and approximately 308 feet in length,of 140th Avenue S.B.,south ofS.E.13200 Street] See Exhibits "A"and "B"attached hereto and made a part hereof as if fully set forth herein is hereby vacated subject to a stormwater utility easement over,across,under and on all the following described area in favor ofthe City: The East 10.00 feet of the North Half of the Northeast Quarter of the Southeast Quarter of the Northwest Quarter of Section 15,Township 23 North,Range 5 East,W.M.,in the City of Renton,King County,Washington. This easement is for the purpose of constructing,reconstructing,installing,repairing,replacing, enlarging,operating and maintaining utilities and utility pipelines,including,but not limited to, water,sewer and storm drainage lines,together with the right of ingress and egress thereto.The City may also construct such additional facilities as it may require.This easement is subject to the following terms and conditions: That a utility easement will be retained by the City over the above-described area,with the understanding that the property may be developed fully if the existing utilities are relocated,with the City's approval,at the sole cost ofthe developer;and That this easement shall run with the land described herein,and shall be binding upon the parties,and their heirs and successors in interest and assigns. SECTION II.The City Council hereby elects to charge a compensation amount of$16,500 (Sixteen Thousand,Five Hundred Dollars)to the petitioner-owners. SECTIONm. five days after its publication.
