HomeMy WebLinkAboutORD 5043Amends ORDs 3055, 4253, 4304, 4441, 4461, 4481, 4567, 4585, 4643, 4723, 4815, 4881, 4928, CITY OF RENTON, WASHINGTON 4932, 4996, 5112 > 5319 ORDINANCE NO. 50 43 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTIONS 8-4-31 OF CHAPTER 4, WATER, AND 8-5-15 OF CHAPTER 5, SEWERS, OF TITLE VIII (HEALTH AND SANITATION) OF ORDINANCE NO. 4260 ENTITLED "CODE OF GENERAL ORDINANCES OF THE CITY OF RENTON, WASHINGTON" BY INCREASING FEES. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. Section 8-4-31, Charges for Metered Water Service Inside City, of Chapter 4, Water, of Title VIII (Heath and Sanitation) of Ordinance No. 4260 entitled "Code of General Ordinances of the City ofRenton, Washington" is hereby amended to read as follows: 8-4-31 CHARGES FOR METERED WATER SERVICE INSIDE CITY: A. Customer Classifications: There will be two (2) new classes of customers established for the water utility. They will be residential (including single-family and duplex units) and commercial customers (including multi-family, commercial and industrial customers). B. Metered Rates: 1. The minimum rates for metered water supplied within the City in one month or fractional period thereof are hereby fixed in the following schedule: Size Of Service 3/4 in. lin. 1-1/2 in. 2 in. 3 in. 4 in. 6 in. 8 in. 10 in. 12 in. Total Service Charge $ 10.82 13.54 17.36 30.33 89.82 129.83 194.77 270.53 389.55 541.06 ORDINANCE NO. 5043 2. Commodity Rates: Two (2) consumption blocks will be established for residential customers (single-family and duplex customers). The size of the first block will be zero to one thousand (0 to 1,000) cubic feet of water consumed per month. The second block will be all consumption over one thousand (1,000) cubic feet per month. The rates for these two (2) blocks are as follows: 1 to 1,000 cubic feet $1.81 Over 1,000 cubic feet 1.94 All commercial customers (multi-family, commercial and industrial) will pay for consumption at the first block rate of one dollar eighty one cent ($1.81) per one hundred (100) cubic feet. C. Senior Citizens And Disabled Persons: The following is hereby established for certain senior citizens and disabled persons who are economically disadvantaged as herein set forth: 1. Low-Income Seniors: A "low-income senior citizen" is defined as a person sixty-two (62) years of age or older who resides in a single-family dwelling that is separately metered for water usage, either as owner, purchaser, or renter, and whose total income, including that of his or her spouse or co-tenant, does not exceed the annual income threshold for low-income rate eligibility. The annual income threshold for eligibility for low- income rate shall be adjusted each calendar year, proportionate to the increase in the local consumer price index (for urban wage earners and clerical workers), to a base of the most recent census data available for determining the median household income for Renton. Any household with a disposable income of thirty five percent (35%) or less of the median household income for ORDINANCE NO. 5043 the City ofRenton will be eligible for a seventy five percent (75%) rate subsidy. Any household with an annual disposable income between thirty five (35%) and fifty percent (50%) of the Renton median household income is eligible for a forty percent (40%) rate subsidy. For the calendar year 2001 those figures shall be less than fifteen thousand dollars ($15,000.00) per annum for a seventy five (75%) rate subsidy and between fifteen thousand dollars ($15,000.00) and twenty one thousand nine hundred dollars ($21,900.00) for a forty percent (40%) rate subsidy for single occupancy, and for double occupancy less than seventeen thousand nine hundred fifty dollars ($17,950.00) for a seventy five percent (75%) rate subsidy, and between seventeen thousand nine hundred fifty dollars ($17,950.00) and twenty five thousand fifty dollars ($25,050.00) for a forty percent (40%) rate subsidy. For households with more than two individuals qualifying under subsection C ofthis Section, an additional five thousand dollars ($5,000.00) is added to the income threshold per qualifying individual. 2. Low-Income Disabled Citizen: A "low-income disabled citizen" is defined as: a) a person qualifying for special parking privileges under RCW 46.16.38l(l)(a) through (f); b) a blind person as defined in RCW 74.18.020; c) a disabled, handicapped, or incapacitated person as defined under any other existing State or Federal program; or d) a person on home kidney dialysis treatment who resides in a single-family dwelling that is separately metered for water usage, either as owner, purchaser or renter, and whose total income, including that of his or her spouse or co-tenant, does not exceed the annual income threshold for eligibility for low- income rate. 3. Qualified Persons: a. Every such person (if double occupancy, then both household members) shall meet either of the above requirements to qualify for senior citizen and disabled ORDINANCE NO. 50 4 3 rate(s). Every such person (if double occupancy, then both household members), shall file with the Utilities billing section of the City, his or her affidavit, that he/she or they are qualified to be charged the special rate for such utility services herein stated. b. Such statement shall contain such other information as the Utilities billing section may prescribe, including but not limited to address, ownership or interest in the dwelling occupied by such applicant(s), amount, source and nature of all income from any and all sources, together with the applicant's unqualified promise to forthwith notify the City of any circumstances or change in condition which would make the applicant(s) ineligible to receive said special rate(s). The Utilities billing section may establish rules and procedures for implementing this Section. 4. Low-Income Rates: a. For those senior citizens and disabled persons who qualified as economically disadvantaged and were on this low-income rate prior to August 1, 1994, the following rates for water service relating to such single-family dwelling in which such eligible person or persons permanently reside are as follows: (1) One dollar twenty nine cents ($ 1.29) per month for a seventy five percent (75%) rate subsidy and two dollars thirty two cents ($2.32) for a forty percent (40%) rate subsidy, limited to nine hundred (900) cubic feet of water per month. (2) Any excess shall be charged as provided in Sections 8-4- 31.AandB. b. For those senior citizens and disabled persons who qualify as economically disadvantaged, and were on this low-income rate after August 1, 1994, the ORDINANCE NO. 5043 following rates for water service relating to such single-family dwelling in which such ehgible person or persons permanently reside: (1) Two dollars eighty three cents ($2.83) per month for a seventy five percent (75%) rate subsidy, limited to nine hundred (900) cubic feet of water per month, and six dollars eighty cents ($6.80) per month for a forty percent (40%) rate subsidy, limited to nine hundred (900) cubic feet of water per month. (2) Any excess shall be charged as provided in subsections 8- 4-31 .A and B, except for those persons who qualify under home kidney dialysis. These customers are limited to one thousand seven hundred (1,700) cubic feet of water per month before any excess is charged as provided in subsections 8-4-3 LA and B. c. For those senior citizens and disabled persons who become eligible according to the criteria in Sections 8-4-3 LCI and 8-4-31.C.2 after the effective date hereof, the following rates for water service relating to such single-family dwelling in which such eligible person or persons permanently reside: (1) Two dollars fifty eight cents ($2.58) per month, limited to nine hundred (900) cubic feet of water per month, and for households with income thirty five percent (35%) or below the median household income for Renton; and six dollars eighteen cents ($6.18) per month, limited to nine hundred (900) cubic feet of water per month for double occupancy households with income between thirty six percent (36%) and forty seven percent (47%) of the median household income for Renton. (2) Any excess shall be charged as provided in Section 8-4- 3 LA and B. ORDINANCE NO. 50 43 5. For those senior citizens, sixty two (62) years of age or older and/or disabled citizens, when such seniors and/or disabled citizens are not otherwise eligible for special rates as low-income seniors and/or disabled citizens, but who qualify for property tax exemption pursuant to RCW 84.36.381.5(a) and are not residents of the City shall be exempt from the fifty percent (50%) utility surcharge applicable to those customers not residents of the City. To receive this exemption the applicant must provide the information required under Section 8-4- 31.C.3. D. Rate Revenue For Capital Purpose: A portion of the revenue generated from the above rates will be used for water utility related capital improvement projects and/or debt services for the same as indicated in the adopted budget. Also included in the above rates are applicable State and local taxes. E. Penalty And Late Charges: Penalty and late charges shall be the same as in Section 8-l-8.A.l.b. SECTION II. Section 8-5-15, Sewer Charges, of Chapter 5, Sewers, of Title 8 (Heath and Sanitation) of Ordinance No. 4260 entitled "Code of General Ordinances of the City ofRenton, Washington" is hereby amended to read as follows: 8-5-15 SEWER CHARGES: A. Disposal Rates: The monthly rates and charges for sewage disposal service shall be as follows: 1. Single-Family: Thirteen dollars four cents ($13.04). 2. All Other Users: A base charge of one dollar ninety nine cents ($1.99) plus one dollar forty seven cents ($1.47) per month for each hundred (100) cubic feet of water used, for a minimum charge of thirteen dollars four cents ($13.04) per month. ORDINANCE NO. 5043 3. Charges For Sewer Service Without City Water: In the event that water obtained from sources other than purchased from the City is either discharged or drained into the sewer system, users shall be charged by one of the two (2) following methods: a. For single-family residences, thirteen dollars four cents ($13.04) per month. b. For other than single-family dwellings, the Planning/Building/Public Works Administrator shall install a water meter into such private water system at cost to property owners, and the method of billing shall be in compliance with Section 8-5-15.A.2 ofthis Title. B. Separate Sewer Exempt Meter: Whenever the use of water is such that a portion of the water used does not flow into the City sewer system but is lost by evaporation or used in irrigation, manufacturing or any other use, and the person in control provides proof of this fact, such person may apply for the installation of a separate sewer exempt meter to measure the amount of water so used or lost and no charge shall be made for sewage because of water so used or lost. A sewer exempt meter apphcation will be made in the same manner as a regular water meter installation. All sewer exempt meters shall be located at the property line or adjacent to the regular meter; provided, however, an evaporation exemption may be granted to coin-operated and commercial laundries without the installation of a submeter. Such exemption shall be an eleven percent (11%) reduction in chargeable water consumption for commercial and industrial laundries and a three percent (3%) reduction in chargeable water consumption for coin-operated laundries. C. Service Outside Of City: The rates to such special uses shall be one and one-half (1-1/2) times the basic City water rates applicable to resident users for similar services plus any ORDINANCE NO. 50 4 3 monthly fees levied by Metro except that such exemptions and discounts as provided in Sections 8-4-32, 8-5-15.D.4 and 8-5-15.D.5 shall likewise apply to these rates. D. Additional Charges: In addition to the foregoing charges specified in this Section, the following rates shall be charged: 1. A charge of twenty three dollars forty cents ($23.40) per month payable to Metro for each single-family dwelling unit. 2. A charge of twenty three dollars forty cents ($23.40) per month payable to Metro for each seven hundred and fifty (750) cubic feet, or any fraction thereof, of water used for all users other than single-family. 3. Any additional charges hereafter imposed by Metro under the "Industrial Cost Recovery" or "Industrial Waste Surcharge" programs required under the FWPCA (PL 92- 500), section 204, or as same may be amended hereafter, plus fifteen percent (15%) thereof as an additional charge for the City's cost of implementing such programs. 4. Senior and/or disabled citizens who qualified under Section 8-4-3l.C for low-income rates prior to August 1,1994, are eligible for the following rates: a. Twenty three dollars forty cents ($23.40) per month for Metro sewer, and one dollar eleven cents ($1.11) per month for City sewer charges for a seventy five percent (75%) rate subsidy and two dollars twelve cents ($2.12) per month for City sewer charges for a forty percent (40%) rate subsidy. b. Senior and/or disabled citizens who qualify under Section 8-4-3l.C for low-income rates after August 1, 1994, are eligible for the following rates: (1) Twenty three dollars forty cents ($23.40) per month for Metro sewer and three dollars thirty four cents ($3.34) per month for City sewer charges for a ORDINANCE NO. 5043 seventy five percent (75%) rate subsidy, and seven dollars eighty five cents ($7.85) per month for City sewer charges for a forty percent (40%) rate subsidy. (2) For double occupancy households, seven dollars thirty two cents ($7.32) per month for households with incomes between thirty six percent (36%) and forty seven percent (47%) of the median household income for the City. 5. For those senior citizens, sixty two (62) years of age or older and/or disabled citizens, when such seniors and/or disabled citizens are not otherwise eligible for special rates as low-income seniors and/or disabled citizens, but who qualify for property tax exemption pursuant to RCW 84.36.381.5(a) and are not residents of the City shall be exempt from the fifty percent (50%) utility surcharge applicable to those customers not residents of the City. To receive this exemption the applicant must provide the information required under Section 8-4-31.C2. E. Installation Of Sewage Meter: Whenever the use of the public sewer is such that infiltration and/or inflow is evident from a private sewage facility, or a building sewer, where the sewer flow is two (2) times in excess of the daily metered water, the Utihties Engineer shall install a sewage meter and charge the regular monthly rates and charges for customers in that class, for all infiltration and inflow and sewage that it discharged into the public sewers. All costs and expenses incident to the installation and connection of the sewer meter shall be borne by the owner or applicant of the premises in question. F. Rate Revenue For Capital Purpose: A portion of the revenue generated from the above rates will be used for sewer utility related capital improvement projects and/or debt services for the same as indicated in the adopted budget.
