RESOLUTION NO. 2800
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON, DECLARING
AN EMERGENCY FOR PURPOSES OF WAIVING ENVIRONMENTAL REVIEW
IN CONJUNCTION WITH PENDING BUILDING PERMIT APPLICATIONS
AT THE MT. OLIVET LANDFILL SITE.
WHEREAS, the City of Renton issued a permit in 1977 to American
Memorial Services Incorporated for landfill disposal of demolition
and construction debris at a site in Renton called the Mt. Olivet
Landfill; and
WHEREAS, the City of Renton and the Seattle-King County Health
Department required the owner and operator of Mt. Olivet Landfill,
as a mitigation measure, to install a leachate collection and
treatment facility on the site of the landfill to prevent the
leachate from percolating into the underground water stratas; and
WHEREAS, the Seattle-King County Health District has been
responsible for environmental monitoring of the operation of the
site; and
WHEREAS, the treatment facility is part of a project included
in a Stipulated Settlement dated July 24 , 1987 , and is necessary for
environmental compliance and proper operation of the landfill
independent of the owner' s purported intended expansion of the
landfill onto four contiguous properties ( identified as King County
Tax Account Numbers 1723059125, 1723059127 , 1723059128, and
1723059143 ) located to the west of the landfill; and
WHEREAS, the operator has submitted a building permit
application for the construction of a retaining wall, leachate

collection system, and structural shell of a building which are part
of the treatment facility; and
WHEREAS, the city staff has reviewed the operator's proposed
plans with the operator, has obtained copies of additional materials
and is continuing to work with the operator to correct deficiencies
and problems discovered; and
WHEREAS, the operator currently has a permit to discharge
untreated leachate directly into the Metro sewage system only until
mid-October of 1990; and
WHEREAS, it is expected to require 120 days to construct the
major structural components of the leachate treatment facility
including the retaining wall, collection system, and building shell;
and
WHEREAS, the city is desirous of protecting its aquifer which
would be severely threatened in the event this collection and
treatment facility was not completed by October 1990; and
WHEREAS, the city views the available construction time as
encroaching on the necessary completion date; and
WHEREAS, requiring additional environmental inquiry will extend
the commencement of construction which will necessarily extend the
completion of construction and that will create an imminent threat
to public health and safety, or an imminent threat of serious
environmental degradation, or both.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS :
SECTION I . The above recitals are found to be true and
correct in all respects .

SECTION II . An emergency is declared for the construction of
the collection and treatment facility at Mt. Olivet.
SECTION III . The administration is hereby directed to conduct
full building permit review, with the exception of environmental
review, for the construction of the leachate collection system and
treatment facility at the Mt. Olivet Landfill site.
SECTION IV. This declaration of emergency DOES NOT extend to
the contiguous four lots which were previously residential uses and
which abut the landfill on the west .
