Houghton, Director June 1987 SUBJECT: Revocable Permit No. Dear Permit Holder: According to our records you hold the subject permit for Excess Right-of- Way use in the City of Renton. This memo is to advise you that the City is exercising it's right to revoke said permit under the 30-day Revocable Clause. This action is prompted by the fact that State Law stipulates we must charge full market value for the utilization of such right-of-way. The City recently amended their ordinance which governs excess right-of-way permits, to comply with the State regulations. This ordinance defines special uses and also addresses a new fee structure. The ordinance also spells out the following four categories for said fees. A. Single Family residential use - $10.00 annually. B. Other Uses (where there is no public benefit) - 1/2 of 1% (0.5%) per month of the value of the land to be utilized, plus leasehold excise tax, payable yearly in advance. Right-of-way value shall be based on the assessed value of the land adjoining the property as established by King County Assesor. C. Uses (where there is a public benefit) - 1/2 of 1% (0.5%) per year of the value of the land adjoining the property, plus leasehold excise tax, but in no case less than $10.00 - payable yearly in advance. D. A no-fee permit may be issued only when the applicant is a public agency and the proposed use of the right-of-way consists of the provision of a direct service to the public (e.g. Metro applications for right-of-way for bus shelters) . City Staff is currently inspecting the property you are utilizing. If you are interested in retaining the revocable permit, please advise. When all inspections have been completed you will be notified of the appropriate category and fee as described in the preceding paragraphs. If you have questions, do not hesitate to call . The assessments on all remaining properties within the district will remain in force from the previous preliminary roll.
