REVOCABLE PERMIT
WHEREAS the Boeing Computer Services Division Co. , a division
of the Boeing Company, a Delaware corporation, desires a variance of the requirements of
the City of Renton ordinance requ�iring undergrounding of wires, and
WHEREAS Che City of Renton is willing to issue such a revocable
permit subject to the terms and'conditions hereinafter set forth, NOW THEREFORE
IT IS HEREBY AGREED AS FOLLOWS:
l . The City of Renton hereby issues and grants a revocable
permit unto BOEING COMPUTER SERVICES C0. for installing overhead coaxial cables on Puget
Power Company/Pacific Northwest Bell Telephone Co. 's existing poles in the locations as
shown on the attachments hereto.
2. That this Revocable Permit is issued for the purpose of I
a video system among Boeing new airplane company programs at the Renton Plant, Grady
Way Building and Valley Office Park.
3. Boeing Computer Services Division ayrees Co hold �he
City harmless from and against any and all claims, actions, liability and expense in
connection with loss of life, personal injury and/or damage to property arising from y
or out of any occurrence in or upon the attached described routes of the overhead coaxial
cables, or occasioned wholly or in part by any act or omission of the undersigned Per-
mittee, its employ.ees, customers or concessionaires. In case the City of Renton shall ,
without fault on its part, be made a party to any litigation commenced by or ayainst
the undersigned Permittee, then said Permittee shall proceed and hold the City harmless
and shall pay atl costs, expenses and reasonable attorneys' fees incurred or paid by the
City in c.�nnection with such litigation.
4. In further consideration of the City's permit, the under-
signed Permittee shall secure and have in effect policies of public liability and prop-
erty damage insurance in connection with the aforestated activity in which the limits
of public liability shall not be less than $100,000 per person and $300,000 per accident
and which the property damage liability shall not be less than $50,000. Evidence of
such insurance snall be submitted to the City Clerk prior to the issuance of said permit.
5. The Permit herein granted is subject to revocation by the
City of Renton and the undersigned Permittee agrees, upon written notice to it by the
City of not less than 30 days, to take steps to underground the facilities as required
by Ordinance 2432.
6. In consideration for the issuance of this Revocable Permit,
Boeing Computer Services Co. agrees to pay the sum of $.05 per lineal foot of cable to
the City of Renton as the Permit Fee per year .
7. It is expressly understood that the issuance of this
revocable permit does not create any� liability on the part of the City.
8. Permittee further agrees and covenants to comply with
all the applicable rules, regulations and ordinances of the City of Renton, exclusive
of the variance granted, and any other govenmental agency having j�risdiction over such
activities and/or the premises described herein.
9. It is understood that Pe�mittee shall obtain separate per-
mission for use of the poles of Puget Sound Power � Light Co. and/or Pacific NW Bell Co.

mentioned i.n that paragraph. I would suggest you drop the

Boeing Co. and the Administration approving variance request .,for overhead
Variance Request cables by Boeing Computer Services. Communication lines must be

I � � REVOCABLE PERMIT
WHEREAS the Boeing Computer Services Company, a division of the Boeing
Company, a Delaware corporation, desires to add additional conferencing cable line
between two buildings on Park Avenue N. in the Renton Boeing Plant for TV conference
� requirements in support of the 757 program, this being a variance to the requirements
of the City of Renton ordinance requiring undergrounding of wires, and
WHEREAS the City of Renton has granted this variance by the Board of Public
� Works and is willing to issue a supplement to the Revocable Permit on the same terms and
conditions as set forth in the aforesaid Revocable Permit RPAG 053-80, NOW THEREFORE
IT IS HEREBY AGREED AS FOLLOWS:
l . "Ihe City of Renton hereby issues and grants a revocable permit unto
Boeing Computer Services Co. for installing overhead video conferencing cable lines
in the amount of 1 ,040 lineal feet at a fee of $.05 per lineal foot, for a total of
$52.00 per year in the location set forth above and as further delineated in Exhibit
"A" attached hereto.
2. All other terms of the original Revocable Permit remain in full force
and effect.

Triad Associates Letter from Michael Miller, Project Engineer, Triad Associates,
West Coast representing Gary M. Merlino submitted appeal of administrative
Trucking Site determination re compliance to the Bulk Storage Ordinance contend-
ing the proposed use of site does not fall under the definition of
Bulk Storage as defined by Code Section 4-702(28) . The letter also
contended past interpretation of the Ordinance has determined the
proposed use does not fall under that ordinance. The letter explained
that appeal had been filed with the Hearing Examiner in error due
to misinformation and asked waiver of 10 day appeal period.
MOVED BY STREDICKE, SECOND CLYMER, REFER MATTER TO THE PLANNING
AND DEVELOPMENT COMMITTEE FOR RECOMMENDATION. CARRIED.

LID 313 • Letter signed by property owners included in the proposed Local
Talbot Road Improvement District 313 for improvements to Talbot Road, was
read which recalled the LID was formed after three new homes
butilt by contractor, Mr. Sasse, flooded after a heavy rain with
water coming across the road from Victoria Park. The letter
explained Mr. Lobe had attempted since 1976 to have water problems
corrected; City intiated the LID; present owners not aware of
conditions or LID 313 and asked review and revision so that the
expenses are placed where the water is coming from. MOVED BY
STREDICKE, SECOND HUGHES, REFER MATTER TO PUBLIC WORKS DEPARTMENT
AND CITY ATTORNEY FOR RESPONSE TO COUNCIL. Fred Krebbs, 2703
Talbot Rd S, expressed concern and inquired re effect of Six-Year
Transportation Improvement Program revision wherein the improvement

Property Transfer written regarding transfer of property for the City Shops. Stredicke
noted two different dates have been given that reply would be
received from the County; earliest date 7/21/81 .
Green River Council President Stredicke commended Staff for questionnaire
Drainage which has been prepared and distributed re Green River Drainage
Meeting Project; 7/29/81 has been established for reply deadline.
Stredicke requested Committee of the Whole meeting 7/30 rather
than August meeting, asking for decision on drainage problem.

ADMINISTRATIVE Mayor Shinpoch reported King County Executive Dunlap will be meet-

Dr. Broswell had met with them and advised: District Court filing
fees will be raised 10$ which will barely cover anticipated costs. ,
Determination of when the County becomes responsible for suspected
felon will be determined in friendly court suit; County will not
bill cities until decision made and will be retroactive. A new
formula wilt be used for jail and medical costs for prisioners
which will be prorated on number of days and population of cities
with no charge for prisioners held six hours or less. Preliminary
County budget will be available in mid-October. King County
Executive Dunlap was adamant that 911 bill was out of line upon �
comparison with other areas (Florida and California) and Northwest '
Bell has lowered costs; that if proposed E-911 voted upon, figures
will be understandable by "man in the street."

Dear Ms. Truman,
It has become necessary for Bocing Camputer Services to supply a
video conferencing cable line between two buildings on Park Avenue
in the Boeing Renton Plant (see attached diagram). This ca��e wo uld
support TV conference requirements in support of the 757 program.
We have investigated the costs associated with undergrounding this
cable and found it to be prohibitive in terms of time and actual
cests. We therefore seek a variance from the undergrounding require-
ments to permit BCS to negotiate with Puget Sound Power and Light to
attach the cable to the six poles (indicated in red on attached
diagrmn).
This variance would be in accordance with the previous permit
(RPAG 053-80) issued by the city of Renton to Boeing Computer
Services in April of this year �or another route of which this is
an extension.
This variance involves 1,040 lineal feet, which at an annual permit
fee of 5¢ per lineal feet involves $52.00. ,
We therefore respectfully request that a Revocable Permit be drawn
to permit an overhead variance on this proposed route at your earliest
convenience so that we may proceed with arrangements to install this
cable. Thank you for your consideration in this matter. Should you

order by Chairman Houghton at 9:00 a.m.

a. Letter from Larry Warren, City Attorney, approved Letter of Credit. in the
amount of $99,320 from Cedar Ridge Associates.
b. Letter from Dean Henry, Lincoln Property Company, requested a 30-day exten-
sion beyond June 3rd for completion of the landscaping and erosion control systems
for the Country Hills Apartments. The letter offered the delivery of a bond in the
amount of $20,000 for the items still unfinished on the project. Mr. Nelson com-
mented that he had received a request from the bank handling the project a few weeks
ago on the $20,000 bond but rejected it. He noted visiting the site last week and
the landscaping and erosion control had not been completed and no price had been

it appeare t at t o lem was to relocate the cable line to private
property where it can be overhead instead of underground and recommended the request
be denied and the cable placed between the buildings on private property. Mr. Holman
said that it would be necessary to close the street at some point if the unde�ground-
ing was required and that it would be very complicated. Discussion followed on how
the lines could be strung on Boeing's property. The Boeing representatives noted
, that Boeing would be willing to participate in any undergrounding LID in that area.

b. Appeal Application, Use of Overhead Uti }ity Lines, 316 S.W. 4th Place,
William F. Taylor - Report from Traffic Engineering recommended denial of the
variance. After some discussion of the cost factor involved, it was moved 6y

c. Appeal Application, Deferral of Sidewalk, Curb and Gutter at Lake Washington
Blvd N. and N. 33rd St. , LaValley � Hudson - Report from Traffic Engineering noted
that there were no curbs, gutter or sidewalks adjacent to the property, it would
appear advisable to have the curb, gutter and sidewalk installed at this time and
�ecommended denial . Planning Department report noted the City did require that
Eastport Shores Condominiums construct the street, curb, gutters and sidewalk along
Lake Washington Blvd and continued deferral of improvements along that roadway would
only delay the ultimate construction and continue a deteriorating situation. The
Board should also be aware that Quendal ) Terminals is proposing a major development
at the NE 44th St. interchange. The report recommended denial . The Board discussed
previous deferrals in the area, Terhune, Mclaughlin and Anderson and noted that there
were restrictive covenants on those deferrals. Moved by N�'LS�N, �seconded by CL�MFNS,

d. Appeal Application, Variance from Driveway Slope Requirement, Victoria Park
# 4, Cascade Pacific Development Corporation - Report from Building Department noted
that lowering the garage floor of the house 18 inches would allow construction of
the driveway within the 8� maximum allowed and recommended denial since the problem
could be solved with a minor grading change. Planning Department report noted the
lot did have physical limitation as a result of the topography and that whether the
street should have b�een higher or the house placed at a lower elevation was now an
academic question. The 14� slope did not appear to be detrimental to the public
and the report recommended approval of the variance. Traffic Engineering report
recommended approval as viable alternative did not appear to be readily available.
Report from Engineering recommended continuation of 2� from back of the walk to
property line before transitioning into the steeper grade. Mr. Nelson said that
he thought the ordinance should be changed to 12� grade and noted this driveway was
not going to create a hardship on adjacent properties and it could be a problem with
the develo er. He noted the develo er had ad'usted the rade once before. Mr.

Houghton noted the developer was figuring the grade from the street and it has to
be figured from the property line side of the sidewalk. Moved by N�LSUN, aeconded

e. Deferral of Off-Site �mprovements, S. Bruce Cass Office Buildinq, 333 Rainier
Avenue North - Mr. Lucker explained that the plan and profile was done by an engineer
and showed the condition of the street at the centerline, showed encroachment into the
street area to the west. The improved part of Hardie Ave. S.W. is mainly to the west.
He noted it would be hard to provide enough right-of-way with curbs, gutters and side-
walks and they would have to dig into the bank. He also noted that from a practical
standpoint, they wouldn' t be able to foretell what would happen in the future when the
rest of the roadway was improved. Further discussion followed regarding need for catch
basin, the driveway and the improvements on N.W. 3rd St. Moved by CL�MFNS, aeconded 6y
