AN ORDINANCE OF THE CI1`Y OF RENTON� LIASHIP�TON PROHI BITING =
ABANDONMF,I�1T OF MOZ'OR VEIiICLES; RESTRICTING THE DISPOSITION -
_ ED
OR KEEPING OF WRECKED, JUNKED, NON OPERATING 4R DISCARD
VEHICLES ON STREETS, ALLEYS AiVD PRIVATE PROPERT`Y; PROVIDING
FOR THE IMPOUNDING OF CIItTAIN VEHICLES AND IMPOSING P�NALTIES�
FOR VIOLATION S THERbOF.
WHEREAS in the CIZ`Y OF REN'1�ON, WASHIN�TON, vehicles are or may in the future be
abandoned ih the streets, alleys, public thoroughfares and on private properties within
Che CI'1'Y or on any CITY property, and
G�HEREAS there are or may in the future be dismantled or parti.ally dismantled,
wrecked, junked� non-operating or discarded vehicles left within the aforedescribed

areas other than in prope=�.� licensed wrecking aad junk yards, and
WHEREAS such conditions tend to impede traffic in the streeLs. constitute a
blight to the neighborhood� interfere with the enjoyment of and reduce the eajoymeat_.
of public and private property, invite plundering and pilfering, create and constitu�e

fire hazards aad,.other safety and health hazards to children as well as adults� iate�-

fere with the com£ort and wellbeing.of the public and constitute a health menace aad::
tend to and aid in the creation, extension and aggravation of urhan blight; anfl
WHEREA3 adequate protectifln of the public health, safety and welfare requi:ce�
tttat. such. conditions be regulated, abated or prohibited, NOW THEREFdRE
BE IT O�tDAZNED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RFN'tnN, 'WASHINGTOrT

AS FOLLOS�IS:
SECTION 1: The above findings .and recitals are hereby fouitd to be true and
correct and hereby adopted as the express findings of ��this legislative hody. �
SECTION. .2: The following definitions shall apply in the interpretation and en-
forcement of this Ordictance:
a) Person: Any person, firm, partnership, association, corporation, company o�c �
organization of any kind.
b) Vehicle: A machine propelled by power other than human power designed to
travel along the ground by use of whee2s, treads, runners or slides and transport :
persons or property or pull machinery and shall include, without limitation, auto- ;
mobiie; . truck, trailer, motorcycie, tractor� buggy and wagon.
c) Street or Highway: The entire width between the boundary 2ines of every way
publicly maintained or usually traveled upfln by the general Qublic� when .any part ;
thereo€ is open to the use of the public for purposes of vehicular travel.:
d) Property: Any real pra�erty witain the CITY or any CITY pr�perty within or
without the corporate limits which is nat a street or highway.
e) Chief of Police: The Chief of Police flf the CI7'Y OF RENTON or his authorized
representative.

SECTION 3:A-No person shall abandon any vehicle within th� CI�'Y QP RENTON or on
any CITY property within or wi�thout the corporate limits, and no person shall leave
any vehicle at any place within the CI'1`'Y or on CITY property within or without t�he
corporate Zimits for such time and under such circumstanees as to cau�e such vshicle
reasonably to appear to have been aban@oned. Such vehicle shall presume to have been
abandoned which remains in the same position for a period of seventy-two (72) hours
after a notice to remove is posted upon such vehicle and no person has aQpeared to
show good cause why such vehicle should not be rem�ved, in which case such abandflned �
vehicle shall constitute a nuisance.
B. The provisions contained in Paragraph A of Section 3 shall likewise a pply to any
partially dismantled, non-operating, wrecked or junked vehic].e on any street, alley
or public thoroughfare within the CITY or on aay other real property within the City
Limits of the CITY OF RENZ'ON; provided however� that this Section shall not aQply to
vehic2es housed or contained in a publicly licensed wrecking or junk yard in aecor@anc �_
with the Ordinances, rules and regulations of the �,�L�'Y OF RENTON governing same.
SECTION 4: A It shall be the c2uty of the Gb.ie��.of,koTice :or his duly suthorized
representative to remove any vehicie which shall constitute a nuisanre as hereiaabove
set forth, and turn any such vehicle over into the custody of the Sheri€f of King
County as more particularly provided for in RCW 46.52:110; provided however� prior to
such delivery to the Sheriff,the Chi�P�a��:PoTice� or his duly authorized representative,
sha 11:
a3 Make a diligent inquiry as to name and address of the owner `of the vehicie
b) Examine such vehicle for license number, motor nurr�ber� serial number, make,
style and any other information which will aid in the identification of the ownership
� and/
of the vehicle and forward such personal notice to the registered/or legal owner o°
such vehicle� if same can be foutvid; thereafter immediately transmit all such available
information pertaining to such vehicle to the Sheriff of King County and the Chief of
the Washington State Patrol.
B If after such notice has been given to the registered and/or legal owner by
the Chief of Police� or his duly authorized representative, and if upon the expiration o�
::orty-�ivE(45) days from the dats of mailiag such notices by registered or certified
and as otherwise
a�ail with return receipt requested, / specified in RCW 46.52.110, the vehic2e remains
unciaimed and has not been reported as a stolen vehicle, then the same may be sold
at p�iblic auetion in comp2iance wit� the terms of the a.foresaid statute.

- SECTION� S: No person in charge or...,control of ,any property, other than CITY pro� �
perty within the CITY� whether as owner� tenant, .oec.upant, lessea or otherwise, shall
allow any partially dismantled, non-operating� wrecked� junked or discarded vehicle to
remain on such property longer than thirty (30) days, and no person sha21 leave any
such vehic2e on any property other than CIT�' property within the CITY�;=�•.��" longer than
thirty (30) days, or on CITY property within or without the corp�rate limits for a
longer time than seventy-two (J2) hours; except the provisions of this Ordinance sha11
not apply to a vehicle regularly kept in an enclosed building, a vehicie on the premises
of a basiness enterprise operating in a lawfvl place and manner, when necessary to the
lawful operation of such business enterprise; or a vehicle in appropriate storage
place or depository maintained in a lawful place and manner by the CIT`Y.
SECTION 6: If� for any reason, the Sheriff of King County is unable to take into
custody any such vehicle as hereinabove described and loc�ted outside aRy public street,
alley� thoroughfare or CZTY property, then the Chief of Police, or his duly authoriznd
reQresentative, shall impound any such vehicle in:accordance with the provisions of
this Ordinance, provided however� that diligent inquiry has f irst been made as to the
name and address of the owner of the .vehic.le and proper notice given in writing as
(a) (b.)
specified in Section 4/hereinabove. If Lhe owner is properly identified, he shall bn
notified immediately as hereinabove set forth that such vehicle is held by the Polic�
Department o€ the CITY OF RENTON and such notice shall also sfiate:
a) The reason for the proposed impounding of said vehicle if same is not claimed
within seventy two C72) hours from the date of such notice
b) The anticipated costs �harged against any auch vehicle foc impounding, cost
of advertising the vehicle for sale and incidental costs thereto.

If the owner �to whom such notice has been mailed by registered mail then fails or neg-

lects to redeem such vehicle withia the aforesaid period/or fails and neglects to pay
the costs incurred theretofore, then such vehicle shall be so2d at a public auction as
hereinaf ter set forth.

SECT�OPI 7: If the owner of such vehicle cannot be identif ied after compliance
with Section 6 hereiaabove or no claim is made b a notified owner within tt�e time

specif ied by Section 4 hereinabove of this Ordinance, then the Chief of Police shall
I cause to be published in a newsp�per of ge�teral circuTation within the CITY a notice
of sale which notice shall inclu+de, among o�hers, the following:
a) The sale is of an abandoned. proper.ty i.n possession of tE�e CITY
b) A description of the vehicle incZuding the type, make� motor nnmber. seria�
number anc� atxy other information whic� will aid in accur�tely identifying
the vehicle.

c) The terms of the sale •
d) The date, time and place of sale.
The notice of sale shall be published two (2) ti:nes within the CITY'S legal newspaper
and the first such publication shall be made not less than ten (.10) days prior to the
date of the proposed sale.
SECTION 8: An owner may redeem a vehicle i�►pounded under the provisions of
this Ordinance, before a sale has taken place, by applying to the Chief of Police� or
his duly authorized representative, whereupon he shall:
a) Subrnit evidence of his ownership or interest in the vehicle� satisfactory
to the Chief of Police, or his duly authorized representative, that such
zlaim is rightful; and
b) Pay the costs due and owing at the ti�e the application to redeem is made, a:�.?:
c) Upon compliance with the provisions of this Section, the Chief of Police,
a= his duly authorized representative, shall execute a receipt for the owner
ana cause the vehicle to be returned to him.
If, however, no clai� shall be made to redeem an i�npounded vehicle before the time
set for sale of such vehiele, the Chief of Police, or his duly authori2ed representa-
tive, shall hold the sale at the time and place a ppointed and as further specified
in :2CW 46.52.110 and the net proceeds from any such sa2e shall be certified one-half
to the City Treasurer to be placed in the CITY'S Current Expense Fund and one-half
to the 3Eate Treasurer to be credited to the Highway Safety Fund.
SECTION 9: Any violation of this Ordinance shall be punisheble� upon cot�'victidn
thereof, by a fine of not to exceed Five Hundred and no/100ths Dollars ($500...40) or
imprisonment in the City Jail of not to exceed ninety (9G) days, or by both such
fine and imprisonment.
SECTION 10: All other Ordinances or parts of Ordinances in con�lict herewith
are hereby repealed.
SECTION 11: This Ordinance shall be in full force and effect fro� and after
its passage, approval and legal publication. n-
