VACATING A PORTION OF RIGHT-OF-WAY, LOCATED WEST OF UNION AVE. AND SOUTH OF NE 4tH ST. (VAC -15-79) MICHAEL MASTRO WHEREAS a proper petition for vacating a portion of N.E. ,4th St. & Union Avenue, Renton, King County, Washington, was duly filed with the City Clerk on or about July 23, 1979, and said petition having been signed by owners representing more than two- thirds of the property abutting upon such street sought to be vacated; and WHEREAS the City Council by Resolution No. 2290 passed and approved on August 20, 1979, and after due investigation, did fix and determine the 17th day of September, 1979 at the hour of 8:00 P.M. in the City Council Chambers of the City of Renton to be the time and place for a public hearing thereon, and the City Clerk having given due notice of such hearing in the manner provided by law, and said hearing being continued, and all persons having been heard appearing in favor or in opposition thereto; and WHEREAS the Department of Public Works and the Planning Department of the City.of Renton having duly considered said petition for said vacation, and having found same to be in the public interest and for the public benefit, and no injury or damage to any person or properties will result from such vacations; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I: The following described portion of street, to -wit: :See Exhibit "A attached hereto and made a part hereof as if fully set forth herein BE AND THE SAME'IS HEREBY VACATED SUBJECT to an easement over, across, under and on all of the aforedescribed property in favor of the City for util"ity and related purposes. :.. ? 1)E}:. Petitioner purchasing for its full appraised value a right of way from the City Utilities Department approximately 30 feet wide by 632.36 feet long immediately abutting Petitioner's property to the south, to make a total right of way of 60 feet for development purposes; AND FURTHER SUBJECT to Petitioner signing a binding contract for the development of the right of way under terms and conditions as O detailed by the City Council., CAG 063-79. SECTION II: The City Council hereby elects to charge no fee to Petitioner -Owner for this vacation. SECTION III: This Ordinance shall be effective upon its passage, approval and five days after its publication. A certified copy of this Ordinance shall be filed with the Office of Records and Elections, King County, and as otherwise provided by law.
