HomeMy WebLinkAboutORD 1927. • 4 T � h ORDINANCE NO. 1927 57o?i AN ORDINANCE OF THE CITY OF RENTON, ESTABLISHING A MUNICIPAL COURT PROVIDING FOR THE APPOINTMENT OF JUDGES, ESTABLISHING RULES OF PLEADINGS, PRACTICE AND PROCEDURE AND REPEALING ANY AND ALL ORDINANCES IN CONFLICT THERE6dITH. WHEREAS the City of Renton is a City of the Second Class under the laws and statutes of the State of Washington which had heretofore for many years past operated its own Municipal Court known as the Police Court of the City of Renton, and WHEREAS Chapter 299 of the State of Washington Session Laws of 1961, also known as the "Justice Court and other inferior Court re -organization Law" permits cities of the second class to establish and operate ttd1s own municipal court system as provided for in Chapter 6 of said Act and WHEREAS the City of Renton has elected to so establish its own Municipal Court under said Chapter, now therefore FOLLOWS: BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, AS SECTION I: There is hereby created and established an inferior court to be known and designated as a municipal court, entitled "The Municipal Court of the City of Renton" which court shall have exclusive original criminal jurisdiction of all violations of City Ordinances and shall have original jurisdiction of all other actions brought to enforce or recover license penalties or forfeitures declared or given by such City Ordinances or by any State statutes. Said Municipal Court shall further have jurisdiction and shall exercise all powers granted by Chapter 6 of said "Justice Court and other Inferior Court Re -organization Law4l (Chapter 299, Laws of 1961), together with such other powers and jurisdictions as are generally conferred in this state by either common law or by express statute upon said Municipal Court. The Judge of the Municipal Court shall be appointed by the Mayor of the City of Renton, with the approval and concurrence of the City Council and such appointment to be for a term of four years, commencing on January 15, 1962. Succeeding appointments shall be made in like manner by the fifteenth day of December preceding the end of every such four year term. The person appointed as municipal judge shall be a citizen of the United States and of the State of Washington and an attorney duly admitted to practice law before the courts of record of the State of Washington and practicing law in the City of Renton or residing in the City of Renton. The position of such municipal judge shall be on a part time basis. Additional part-time judges may be appointed by the Mayor, subject to the approval and with the concurrence of the City Council in the same manner as hereinabove set forth, whenever public interest and the administration of justice requiraf the appointment of such additionali judge or judges. -1- SECTION II: The salary of the municipal court judge shall be fixed for the initial term of four years in the sum of Four Hundred Fifty Dollars ($450.00) per month, SECTION III: The Mayor shall, with the approval and concurrence of the City Council, appoint Judges pro tem who shall act in the absence or disability of the regular judge of the municipal court. The judges pro tem shall be qualified to hold the position of judge.of the municipal court as provided for hereinabove. Such pro tem judges shall receive the sum of Twenty-five Dollars (025.00).per'day as compensation for services rendered as such pro tem judges. SECTION IV: The traffic violations bureau of the City of Renton as hgretofore established by Ordinance shall remain in full force and effect. All fees, costs, fines, forfeitures and other moneys imposed or collected by any municipal court for the violation of any municipal ordinance, together with any other revenues received by the municipal court, shall be deposited with the City Treasurer as a part of the general fund of the City. SECTION V: The municipal court shall be open and shall hold regular session on the following days, to -wit: Wednesday of each week between the hours of 9:00 A.M. to 12:00 Loon On the last Friday of each month between the hours of 9:30 A.M. and 12:00 Noon On Monday of each week between the hours of 1:00 P.M. and 5:30 P.M. to hear juvenile traffic cases, together with such additional times for regular of special session as may be prescribed by the City Council of the City from time to time. SECTION VI: Pleadings, practice and procedure in cases not governed by statutes or rules specifically applicable to municipal courts shall, insofar as applicable, be governed by the statutes and rules now existing including the applicable provisions of Chapter 299, State of Washington Session Iaws for 1961, or as may hereafter be adopted governing the pleadings, practice and procedure applicable to justice courts. SECTION VII: Every person convicted by the municipal court of the City of Renton of a violation of the criminal provisions of an >ordinance shall be punished by a fine of not more than Five Hundred Dollars 0500.00) or imprisonment in the City jail for a period not to exceed 90 days, or both such fine and imprisonment, SECTION VIII: Any and all ordinances or parts of ordinances in conflict hermwith are hereby repealed. -2- SECTION IX: This Ordinance shall be ia.fu71 force and effect from and after its passage, approval and legal publication.
