HomeMy WebLinkAboutORD 3942 ' � `� � �� w • .t II . � � � � • � CITY OF RENTON, [aASHINGTON ORDINANCE N0. 3942 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES WITHIN THE CITY nF RENTON FROM B-1 WITH CONDITIONS TO B-1 WITH AMENDED CONDITIONS (R-031-85 QUINTINSKIE) WHEREAS under Chapter 7, Title IV (Building Regulations) of Ordinance No. 1628 known as the °'Code of General Ordinances of the City of Renton" as amended, and the maps and reports adopted in conjunction therewith, the property hereinbelow described has here�tofore been zoned as B-1 with conditions; and WHEREAS a proper petition for change of zone classification of said property has been filed with the Building and Zoning Department on or about April 16, 1985 , which petition was duly referred to the Hearing Examiner for investigation, study and public hearing, and a public hearing having been held thereon on or about June 25 , 1985, and said matter having been duly considered by the Hearing Examiner and said zoning request being in conformity with the City' s Comprehensive Plan, as amended, and the City Council having duly considered all matters relevant thereto, and all parties having been heard appearing in support thereof or in opposition thereto, NOW THEREFORE THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I : The following described property in the City of Renton is hereby rezoned to B-1 with amended conditions as hereinbelow specified; subject to the findings, conditions and decision of the Hearing Examiner dated June 27, 1985; as amended by the City Council to eliminate daycare center as a permissible use; the Building and Zoning Director is hereby authorized and directed to change the maps of the -1- �� . , '� , . '� ' • . • " ' ORDINANCE N0. 3942 Zoning Ordinance, as amended to evidence said rezoning, to-wit: �'� See Exhibit "A" attached hereto and made a part hereof as if fully set forth herein (Said property being located at 426 Burnett Avenue S. ) AND SUBJECT FURTHER to that certain Declaration of Restrictive Covenants executed by Petitioner-Owners on or about September 13 , 1985 and recorded in the office of the Director of Records and Elections, Receiving No. 8509130913 and which said Covenants are hereby incorporated and made a part hereof as if fully set forth. Any mixed use of the subject site involving a combination of residential and commercial occupancies shall be in accordance with the Codes and Regulations of the City of Renton. Once the property is used for, or converted to use for the commercial purposes enumerated below, residential occupancy shall completely cease, except as otherwise permitted by the Codes and Regulations of the City of Renton. 2. Subject site is to be limited to only the following uses: Personal offices such as real estate, insurance, architects, lawyers, libraries, museums, art galleries, boarding houses, barber and beauty salons, and medical professionals, but not veterinary services. In the ultimate development or redevelopment of the site, if the existing � building is to be removed or its exterior appearance altered, Site Plan review will be required. � DURATION These covenants shall run with the land and expire on December 31 , 2025. , If at any time improvements are installed pursuant to these covenants, the portion of the covenants pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further doc�entation.
