with the sewer assessment against t�ta.ilway property in the
Kenn;ldale area maintained by the City of Renton as a public
bathir� beach under Lease :�10. 70796.
As you recall, on August 11, 1967, �Te submitted
a supplement inserting in the lease a provision for payment
of taxes and assessments by the City. You will further re-
call we requested that the City either execute the supple-
ment or exempt the Railway Company from payment of taxes
and assessments.
Since tYiis is a matter of long st�anding a:nd keep-
ing in mind that the Railway Company derives no rental, com-
pensation or benefit f'rom the lease, we hope the City will
no�a act favorably on our renuest, either in the form of an
exemption or by completin� th� supplement. In the event
the supplement has been lost or misplac�d, we attach a dup-
licate set for your handling.

Moved-�iy'Garrett, seconded by Dahlquist, to concur with the recommendation of the
Building Director and grant the Pennit. The Chair ruled the motion out of order
since it is contrary to the original motion,which he stated should have also been the
ruling.on the prior item. Discussion ensued on whether a positive motion had precederrt
over a negative motion. City Attorney Shellan advised that the intent of the subse-
quent motion was not to amend but a direct opposite changing the nature of the orfginal
motion which is not permissible. Znquiry was made of the Building Director regarding
justification for the recommendation and Mr. Johnson advised that the pole would be
within li.mits set for B-1 areas and inspection reveals that the request is made with
regard to the best visibility, having to come before Council because a Revocable
Permit is involved wh�ch must be approved by the Council. It was noted that the sign
is at the intersection of Park Avenue and Second Street in a parking lot. �ote
was called for on the motion to deny the request. The motion lost, the ayes prevailing.
Attention was called to previous requests which had been denied in the subject area.
Moved by Garrett, seconded by Pedersen, to eoncur in the reeo�nendation of the Building
Director and the permit be granted. Carried.
Letter from W. E. Bennett, Utility Accountant requested appropriation of $300.00 from
excess revenues, Waterworks Utility Fund unto 7100/130 Salaries & Wages, to allow
hiring of a part time employee to prepare data for conversion to Data Processing which
labor was not contemplated when the budget was prepared. Moved by Poli, seconded by
Gianini, to grant the request with referral to the Law and Ordinance Committee.Carried.
Letter from Mayor Custer submitted proposed Supplement to Lease Agreement between
the City and Mrs. Anna J. Elliott to correct a property description, and it was
requested that this matter be referred to the Property Cortgnittee for recommendation.
Moved by Dahlquist, seconded by Sehellert, to concur in the request. Carried.
Letter from Jack Wilson, City Engineer, requested authorization to call for bids on
installation of a watermain in 132nd Avenue S.E. southerly from North 4th Street and
in an easement between Sunset Blvd. East and "E" Street. September 25th was the date
suggested for bid opening. Moved by Poli, seconded by Pedersen, to concur in the
bid call and opening date. Carried.
Letter from Mr. Phillip L. Beckley, Chairman� Renton Independence Day Comnittee,
requested that the Committee be permitted to hold a dance �or high school age
students at the Renton Avia�i on Hangax on Saturday, August 26th from 8:30p.m. untfl
11:30 p.m. Off-duty poZice officers will be present and list of adults was attached
who will be available for consultation and/or chaperoning. Moved by Perry, seconded
by SchelZert, that the Council approve the request and recommend to the Renton Aviation
Board that this building be made available for this purpose. Carried.
Letter from City Engineer tJilson submitted and recommended for approval, proposed
Franchise for railroad crossing of Houser Way in the vicinity of North 8th Street.
It was recommended �y City Attorney Shel].an that the Street and Alley Committee
and possibly the Property Co�nittee go over this particular franchise request.

Letter from the Northern Pacific Railway Company called attention to lease wherein
clause providing for payment of taxes and assessments by the lessee had been crossed
out it being assumed the land would be exempt, no rent or other compensation being
received. It was requested that supplemental lease be executed providing for payment

Letter from Sven Johnson, Building Director, reported investigation, along with the
Park Director and Architect Dave Johnston, of the old library building and it has
been determined unfeasible to repair the building for occupancy since over 50y of
the structure would be involved, questionable roof support and unreinforced masonry
being unable to be renovated to Code requirements. It was recommended that funds
be appropriated to effect demolition of the building including removal of the
foundation and filling of the excavation. Salvage was not recommended due to length
of time the demolition would be unsightly. Permission was requested to call for bids
for removal of the building as soon as possible. Moved by Pol•i,, seconded by Perry,
to refer this matter to the Cort�►ittee of the Whole. Carried.
Letter from the State Highway Commission advised that on or about Januazy 1, 1968 a
portion of old PSH 5 (SR 167) Longacres to Cedar River Bridge, will be returned to
the City of Renton. Joint inspection with the City will be made to insure that the

Submitted herewith for the signatvres of the Mayor and City
Clerk are three copies of Assignment of Lease of the Kennydale Beach property
to the City of Renton by Northern Pacific Railway Company.
The Aasignment of Lease and the Lease have been checked by the
City Attorney axid� althou,;h they are in order, it should be brought to your
attention that there are certain stringent restrictions contained in this agree-
ment; namely, the following paragraphs:
�7 - It is understood by the part•ies that the leased premises are in dangerous
proximity to the tracks of the Railway Company and that property on the 1.eased
premises will be in danger of injury or destruction by fire incident to the
operation� maintenance or i�rovement of the railway, and the lessee accepts
this lease sub3ect to such dangers. It is therefore agreed, as one of the ma-
terial considerations of this lease without which the same �uld not be granted�
that the lessee assumes all risk of loss, damage or destruction by fire to build.-
ings or contents or to any other property brought upon or in proximity to the
leased premises b� the lessee, or by any other person with the consent or l�ow-
ledge of the lessee, without regard to whether such fire be the result of negli-
gence or misconduct of any person in the employ or service of the Railway Company
or of defective appliances, engi.nes, or machinery; except to the premises of the
Ra.ilway Company and to rolling stock belonging to the Ra.ilway Company or to others,
and to shipments of third parties in the course of transportation. The lessee
hereby indemnifies and agrees to protect the Railway Company from all such los s,
damage or �estruction to property� including claims and causes of action asserted
against the Railway Company by any insurer of said property.
The lesses also agrees to indemnify� and hold hazmless the P�ailway Company�
for loss, damage, or injury from any act or omission of the lessee, its invitees,
licensees, employes, or agents, to the person or property of the paxties hereto
anc? their employes� and to the person or property of any other person or corpora-
tion, while on or about said lea5ed premises; and if any claim or liability other
than from fire� shall arise from the 3oint or concurring negligence of both gar-
ties hereto, it shall be borne by them equally.
#9 - Either party may terminate this lease at any time upon th irt;y (30) days�
written notice to the other party. Notice of termination by the lessee sha].1 be
given to the Industrial Agent o�' the Railway Cornpany by United States mail; the
Ra,ilway Company may give its notice in the same manner to the lessee at the follow-
ing address, viz.: S1a.perintendent of Parks and Playgrounds� 608�, County-City
� Bldg.� 6eattle, �rdashington, or may serve same personally on the lessee, or post on
the leased premises.

#15 - The Rai.lway Company also peimits the lessee to maintain a nedestrian
crossing and sta.irway, 1t feet in width, Ieading from the northwesterly line
of Lake Washington Boulevard. across the Railway Companyts tracks to the above-
described premises, the center line thereof being parallel with and distant
approximately 125 feet southerly� measured along said center line, from the
produced northerly line of the leased premises. No part of said staisway
shall extend above the surface of the ground at the top of the Railway Com-
pa.�y�s roadbed. The lessee shall remove ancl keep removed at its expense ar�y
vegetation that will interfere with the view of trains within 50Q feet from
the crossing. gll work under this paxagraph sha.11 be done under the supervi-
sion and to the satisfaction of thE Division �uperintendent of the Railway
Company.
#16 - The lessee shall ma.intain at its expense a substantial fence along all
of the Iand boundaries of said premises except at the crossing described in
paxagraph 15.
