PROCLAMATION
a) Fire Prevention Week-October 4-October 10,2015.A proclamation by Mayor Law was read
declaring October 4 to 10, 2015 to be "Fire Prevention Week" in the City of Renton in
commemoration of the Great Chicago Fire of 1871,which killed more than 250 persons, left
100,000 homeless, and destroyed more than 17,400 buildings;and encouraged all citizens to
join in this special observance. Fire Marshal Anjela St.John accepted the proclamation,
explaining the history of Fire Prevention Week in the United States. She also thanked Council
for its support and reported that this year the fire prevention campaign focuses on the value
of having working smoke alarms installed where you sleep.

b) Domestic Violence Awareness Month-Odober 2015.A proclamation by Mayor Law was

supporting all victims so they can lead healthy lives safe from violent and abusive behavior.
Domestic Violence Victim Advocate Tina Harris accepted the proclamation and thanked
Council and City officials for supporting efforts to end domestic violence.

c) Housing America Month-October 2015.A proclamation by Mayor Law was read declaring

Kellee Rodriguez accepted the proclamation and thanked Council for the proclamation.

SPECIAL PRESENTATION
State of the County-King County Councilmember Reagan Dunn. King County
Councilmember Reagan Dunn presented the annual State of the County Address. He
discussed the following topics:
• Passage of the County's first biennial budget of 9.9 billion dollars.
• Structure of the King County Council and various committees he is involved in.
• Public Transit issues.
• Flood District updates regarding benefits to Renton.
• Eastside Rail Corridor-Master Planning update.
Additionally Councilmember Dunn answered questions/concerns raised by Council and
thanked them for their hard work.
PUBLIC HEARING
Allocation and Use of 2016 Community Development Block Grant(CDBG) Funds.This being
the date set and proper notices having been posted and published in accordance with local
and State laws, Mayor Law opened the public hearing to consider the allocation and use of
the 2016 CDBG funding recommendations.

Economic Development Director Cliff Long reported that CDBG funds are allocated by the
Department of Housing and Urban Development(HUD)and are received through an interlocal
agreement with King County. He stated that the CDBG is a flexible program that provides
communities with resources to address a wide range of unique community development
needs. Beginning in 2015,the City atlocated discretionary CDBG funds to be used for
economic development activities along with human services programs,and the 2016
allotment is estimated to be at$599,682.
Mr. Long further laid out the City's plans on how to use the 2016 allotment:

Additionatly, Mr.Long explained how the Downtown Commercial Rehabilitation and Facade
Improvement Loan Program would work,as well as its purpose which is to incentivize and
assist property owners to rehabilitate commercial buildings,encourage private investment,
provide marketable space for businesses,and achieve significant visual improvements in the
downtown area.
Councilmember Persson requested that an update be provided to Council regarding the sale
and/or lease status,and the status of the application, regarding the Downtown Commercial
Rehabilitation and Facade Improvement Loan Program for the building located at 801 S.3rd
St.
Staff recommended that following the public hearing,Council approve the Committee of the
Whole Committee Report recommending concurrence with the staff recommendation to
approve the allocation and use of the City's 2016 CDBG funds as detailed above.
Public Hearing Audience Comments: Dave Brethauer,Seattle,owner of the Renton Western
Wear/Cortona Building,shared how the Downtown Commercial Rehab and Facade
Improvement Loan Program will benefit his building. Mr. Brethauer further explained that he
intends to use the loan for additional improvements to the building to help attract new
tenants and help increase economic activity in the area. Mr. Brethauer thanked City staff for
working with him and helping him achieve these goals.

ADMINISTRATIVE REPORT
Deputy Public Affairs Administrator Preeti Shridhar reviewed a written administrative report
summarizing the City's recent progress towards goals and work programs adopted as part of
its business plan for 2015 and beyond. Items noted were:
• Public Works Maintenance Services Worker Kip Braaten was among 55 participants who
competed in the 2015 APWA National Snow"Roadeo" held in Loveland,CO Wednesday,
September 30th. Kip took third place in the loader obstacle course and finished 28th in
the truck competition.
• Preventative street maintenance will continue to impact traffic and result in occasional
street closures through October 31, 2015. ,
AUDIENCE COMMENT
The following individuals from Cannabis Organization of Retail Establishments(CORE)
addressed Council regarding Marijuana regulation in the City of Renton,offering their
assistance in putting forth thoughtful regulations that would ensure a legal,safe and
sustainable cannabis industry within Washington State.Additionally,they recommended that
council make minimal changes to the number of retailers within theirjurisdiction or buffer '
zones, and informed Council that they are happy to assist with crafting robust policies that
objectively maintain public health and safety standards in the face of scrutiny and skepticism.

Agreement to Purchase LiDAR Data with King County and regional partners for an amount not
to exceed$12,000 to capture and acquire public-domain, high-resolution topography data

c) Community&Economic Development Department requested adoption of an ordinance
declaring an emergency and adopting interim zoning regulations to a�low adequate time to
establish regulations regarding the number of recreational marijuana stores in the City of

d) Community Services recommended approval of a 64-month lease with Crawford and
Company for use of space on the 5th floor of the 200 Mill Building. Revenue generated is

Right-of-way vacation petition was received on May 6, 2015,from Dale Walker of D&C Investments, LLC. City
Code requires that more than two-thirds(2/3) of the owners whose property abuts the right-of-way to be
vacated sign the petition. One-hundred percent (100%) of the abutting property owners have signed this

A public hearing was conducted on August 3, 2015,and Council authorized approval of the Walker Street Vacation
Petition with conditions, and authorized its appraisal and subsequent resubmittal to Council for final action.
Subsequently,the City Attorney noted that RMC 9-14-10 which provides that staff shall waive all fees in Auto Mall Area
A was an incentive to combine properties in the Auto Mall area.Therefore,as the Code allows for the waiver of all fees,
an appraisal of the right-of-way to be vacated is not necessary.

ISSUE:
Should Council vacate the alley abutting Walker's Renton Subaru, located at 555 SW
Grady Way (between Seneca Ave SW and Lind Ave SW)? In addition, per RMC 9-14-10,
should Council waive all fees for this right-of-way vacation within Auto Mall Area A?
RECOMMENDATION:
Staff recommends that Council should authorize the Mayor and City Clerk to sign the
release of the referenced right-of-way (alley) and to waive all fees for the alley vacation
within Auto Mall Area A, per RMC 9-14-10.
BACKGROUND SUMMARY:
A right-of-way vacation petition was received on May 6, 2015, from Dale Walker of D&C
Investments, LLC. City Code requires that more than two-thirds (2/3) of the owners
whose property abuts the right-of-way to be vacated sign the petition. One-hundred
percent(100%) of the abutting property owners have signed this petition. The portion
of the right-of-way included in this petition was dedicated in C.D. Hillmans' Earlington
Gardens No 1 Addition on Aprif 16, 1909.
There are city-owned sewer and stormwater systems in the area of the vacation
petition. The City's Water Utility has requested that an easement be recorded over the
entire alley vacation area for future water line extension.The City's Wastewater Utility
has requested an easement over the alley to own, operate, and maintain the existing
12-inch sewer main located within the full length of the alley.The City's Surface Water
Utility has requested that the existing public storm system within the alley revert to a
private storm system that the property owner will be responsible for future
maintenance and repair of.

The petitioner plans to use the requested vacation area to secure their property after
hours, protect their vehicle inventory, and stop the undesired use of the parking lot as
' an unregulated through block vehicular short cut.
The project site is located within Auto Mall Area A. In accordance with RMC 9-14-5D, all
street vacation fees and compensation for right-of-way may be waived by City Council
for developing properties in Auto Mall Improvement Area A (area bounded by Grady
Way South, Rainier Avenue South, I-405, and Lind Avenue South) when:
1. The properties are designated to be vacated on
the Auto Mall Improvement Plan Map (Resolution No. 3182);
2. The application for street vacation conforms to
RMC 9-14-10, Administrative Procedure For Right-Of-Way Vacations; and
3. The uses proposed conform to RMC 4-2-060,
Zoning Use Table.
, The subject property is designated on the Auto Mall Improvement Plan Map. The
application for the alley vacation conforms to RMC 9-14-10 and the use of an auto
dealership on the property conforms to RMC 4-2-060. Therefore, the proposed vacation
is eligible for the fee waivers by Council.
A public hearing was conducted on August 3, 2015, and Council authorized approval of
the Walker Street Vacation Petition with conditions, and authorized its appraisal and
subsequent resubmittal to Council for final action. Subsequently,the City Attorney

CONCLUSION:
A survey of various City departments and outside agencies was conducted by staff.The
City's Water and Wastewater Utilities have requested an easement over the entire
vacation area for future water line extension. The City's Surface Water Utility has
requested that the existing storm system within the alley revert to a private storm
system to be owned and maintained by the property owner. Staff recommends vacating
the requested portion of right-of-way subject to the recording of a utility easement,for
maintenance of the existing sewer line and for future water line extension, over the
entire area to be vacated. In addition, staff recommends that the storm system within
the alley revert to a private storm system that the property owner will be responsible

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, VACATING AN AILEY
ADJOINING 555 SW GRADY WAY BETWEEN SENECA AVENUE SW AND LIND
AVENUE SW (DALE WALKER OF D&C INVESTMENTS, LLC, PETITIONER; VAC 15-
002).
WHEREAS, a petition has been filed with the City Clerk of the City of Renton on or
about May 6, 2015, pursuant to the requirements of RCW 35.79, petitioning for the vacation of
an alley adjoining 555 SW Grady Way between Seneca Avenue SW and Lind Avenue SW, as
hereinafter more particularly described, and the petition was signed by the owners of more
than two-thirds (2/3) of the property abutting upon the street sought to be vacated; and
WHEREAS,the City Council, by Resolution No. 4258, passed on July 13, 2015, set August
3, 2015, at 7:00 p.m., in the City Council Chambers of the City of Renton as the time and place
for a public hearing on this matter; and the City Clerk gave proper notice of this hearing as
provided by law, and all persons were heard who appeared to testify in favor or in opposition

WHEREAS, the Revised Code of Washington (RCW) section 32.21.015 authorizes
municipalities to establish an independent salary commissions to review and set the salaries for
elected officials; and
WHEREAS, The City Council currently reviews and sets compensation for the members
of the City Council, which was most recently done in July 2004 via Ordinance No. 5090; and
WHEREAS, The City Council currently sets compensation for the Mayor by ordinance in
conjunction with regular budget processes; and
WHEREAS, Ordinance No. 5245 adopted on December 11, 2006 sets the compensation
for the elected Judge to be at least ninety-five percent (95%) of a district court judge salary
which is adjusted regularly; and
WHEREAS, the Council wishes to address the compensation of the City Council
Members in a more consistent and uniform manner as other elected city officials;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES

SECTION I. Subsection 1-5-1.0 of subsection 1-5-1, Number of Councilmembers;
Duties; Salaries, of Chapter 5, Council, of Title I (Administrative) of the Renton Municipal Code,
is hereby amended as follows:
C. The salaries of the Councilmembers are hereby fixed at nine hundred
fifty dollars ($950.00) per month plus two percent (2%) of salary for deferred
compensation, plus for those Councilmembers not participating in PERS, an extra
one point four percent(1.4%j of salary for deferred compensation. However, the
compensation of such elected officials who fix their own compensation shall not
be increased during their terms of office, and as limited by the Constitution and
statutes of the State of Washington. The salaries of Councilmembers mav also be
adiusted accordin� to the procedures and rules established bv chapter RMC 2-
20, Independent Salarv Commission.

2-20-1 COMMISSION ESTABLISHED:
An Independent Salarv Commission is herebv established oursuant to RCW
35.21.015, hereinafter referred to as the Citv of Renton Indenendent Salarv
Commission ("Commission").
2-20-2 PURPOSE:
The Commission shall review and establish the salaries of the
Councilmembers and exercise the powers and perform the duties established bv
RCW 35.21.015, as now existin�or hereafter amended. For the purposes hereof.
the salarv authority of the independent salarv commission shall include all
compensation that mav be paid to or received bv councilmembers, whether or
not it is identified as salarv.
2-20-3 QUALIFICATIONS:
A. Members must be a resident of the Citv for at least one (11 vear
immediatelv precedin�such appointment, and a re�istered voter of Kin�Countv.
B. No officer, official, or emqlovee of the Citv or anv of their immediate
familv members mav serve on the Commission. "Immediate family member" as
used in this subsection means the parents, spouse, siblin�s. children, or
dependent relatives of the officer, official, or emplovee, whether or not livin� in
' the household of the officer, official, or emplovee.

2-20-4 MEMBERSHIP:
A. Number of Members:The Commission shall consist of five (5) members. I
B. Appointment: Members shall be appointed bv the Mavor, subiect to
confirmation by the Citv Council. Members shall be selected without respect to
political affiliations and shall serve without compensation.
C. Terms: Members of the Commission shall serve their term upon '
appointment and Council confirmation, until the salarv review is comqlete and a i
salarv schedule has been filed with the Citv Clerk or until determination is made
that no salarv adiustment is approoriate. No member mav be appointed to more
than two (2) terms on the Commission, whether or not those terms are held
consecutivelv.
D. Removal: Members mav be removed bv the Mavor, onlv, durin� their
terms of office for cause includin� incapacitv, incompetence, ne�lect of dutv, or
malfeasance in office or for a disaualifvin� chan�e of residence.
E. Vacancies: Vacancies occurrin� shall be fifled for the unexqired terms, in
the same manner as apqointments in subsection B of this section.
F. Quorum:Three (3) members shall constitute a auorum.
G. Chair and Vice-Chair: The Commission shall elect a chair and vice-chair
from amon�its votin� members.

A.The Mavor will appoint appropriate staff to assist the Commission.

B. The Commission shall keep a written record of its proceedin�s, which shall
be a public record in accordance with State law, and shall activelv solicit nublic
comment at all meetin�s. The meetin�s shall be subiect to the Open Public
Meetin�s Act, Chapter 42.30 RCW, as amended or recodified.
C. The Commission shall meet as often as necessarv in order to file a
schedule with the Citv Clerk, on or before November 30. 2015. Once a schedule
has been filed, the Commission will not meet until the Citv Council confirms a
new Commission for purposes of further studvin�Citv Council comqensation.
2-20-6 RESPONSIBILITIES:
The Commission shall have the followin� responsibilities:
A. To studv the relationship of salaries to the duties of Council President and
Councilmembers and to studv the costs personallv incurred bv Councilmembers
in performin�such duties;
B. To studv the relationshiq of Renton Council salaries and benefits to those
salaries and benefits of Councilmembers in surrounding Citv iurisdictions and I,
other current market conditions;
C. To establish salarv and benefits bv either increasin� or decreasin� the
existin� salarv and benefits of each position bv an affirmative vote of not less
than three (3) members; and
D. To review and file a salarv and compensation schedule with the Citv Clerk
no later than November 30, 2015. Future Commissions shall have ninety (90)

davs after confirmation bv the Citv Council to complete their review and file the

2-20-7 EFFECTIVE DATE—SALARIES:
A. The Commission established or amended salary schedule will become
effective in the amounts, at the times, and under the conditions established in
the schedule.
B. Anv increase or decrease in salarv shall become effective and incorporated
into the Citv bud�et without further action of the Citv Council or the
Commission.
C. Salarv increases established bv the Commission shall be effective as to all
Council elected officials, re�ardless of their terms of office.
', D. Sa�arv decreases established bv the Commission shall become effective as
to incumbent Council elected officials at the commencement of their next
subseauent terms of office.
E. Anv adiustment of salarv bv the Commission shall supersede anv Citv
ordinance related to the bud�et or to the fixin�of salaries.
2-20-8 SALARY SCHEDULE SUBJECT TO REFERENDUM PETITION:
A. Salary increases and decreases shall be subiect to referendum petition in
the same manner as an ordinance upon filin� of such petition with the Citv Clerk
within thirtv (30) davs after filin� of the salarv schedule. In the event of the filin�
of a valid referendum petition, the salarv increase or decrease shall not �o into
effect until approved bv vote of the people.

B. Referendum measures under this section shall be submitted to the voters

follows:
5-3-15ALARIES OF ELECTIVE OFFIC�IALS:
The elective officials, consisting of the Mayor and members of the City
Council, shall receive the salaries fixed and established by City ordinances from
time to time and as otherwise provided by law. The salaries of Councilmembers
mav also be adiusted accordin� to the procedures and rules established bv
chapter RMC 2-20. Independent Salarv Commission.
SECTION IV. This ordinance shall be effective upon its passage, approval, and thirty

WHEREAS, a petition has been filed with the City Clerk of the City of Renton on or
about May 6, 2015, pursuant to the requirements o#RCW 35.79, petitianing for the vacation of
an alley adjoining 555 SW Grady Way between Seneca Avenue SW and Lind Avenue SW, as
hereinafter more particularly described, and the petition was signed by the awners of more
than two-thirds (2/3) of the property abutting upon the street sought to be vacated; and
WHEREAS, the City Councii, by Resoiution No. 4258, passed an July 13, 201S, set August
3, 2015, at 7.00 p.m., in the City Council Chambers of the City of Rentan as the time and place
for a public hearing an this mat#er; and the City Clerk gave proper notice of this hearing as
provided by law, and all persons were heard who appeared to testify in favor or in opposition

WHEREAS, the Revised Code of Washington (RCW) section 32.21.015 authorizes
municipalities to establish an independent salary commissions to review and set the salaries for
elected officials; and
WHEREAS, The City Council currently.reviews and sets compensation for the members
of the City Council, which was most recently done in July 2004 via Ordinance No. 5090; and
WHEREAS, The City Council currently sets compensation for the Mayor by ordinance in
conjunction with regular budget processes; and
WHEREAS, Ordinance No. 5245 adopted on December 11, 2006 sets the compensation
for the elected Judge to be at least ninety-five percent (95%) of a district court judge salary
which is adjusted regularly; and
WHEREAS, the Council wishes to address the compensation of the City Council
Members in a more consistent and uniform manner as other elected city officials;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES
ORDAIN AS FOLLOWS:

SECTION I. Subsection 1-5-1.0 of subsection 1-5-1, Number of Counciimembers;
Duties; Salaries, of Chapter 5, Council, of Title I (Administrative) of the Renton Municipal Code,
is hereby amended as follows:
C. The salaries of the Councilmembers are hereby fixed at nine hundred
fifty dollars ($950.00) per month plus two percent (2°�) of salary for deferred
compensation, plus for those Councilmembers not participating in PERS, an extra
one Qoint four percent f 1.4°�1 of salary fo�deferred compensation. However,the
compensation of such elected officials who fix their own compensation shall not
be increased during their terms of office, and as limited by the Constitution and
statutes of the State of Washington.The salaries of Councilmembers mav also be
adiusted accordin� to the arocedures and rules established bv chapter RMC 2-
20, Independent Salarv Commission.
SECTION II. Title II (Commissions and Boards) of the Renton Municipal Code, is

A. Number of Members:The Commission shall consist of five (5l members.
B. Apqointment: Members shall be anpointed bv the Mavor, subiect to
confirmation bv the Citv Council. Members shall be selected without respect to
� political affiliations and shall serve without comqensation.
C. Terms: Members of the Commission shall serve their term upon
appointment and Council confirmation, until the salarv review is comalete and a
salarv schedule has been filed with the Citv Clerk or until determination is made
that no salary adiustment is appropriate. No member mav be aqpointed to more
than two (21 terms on the Commission, whether or not those terms are held
consecutivelv.
D. Removal: Members mav be removed bv the Mavor, onlv, durin� their
terms of office for cause includin� incapacitv, incompetence, ne�lect of dutv, or
malfeasance in office or for a disQualifvin�chan�e of residence.
E. Vacancies: Vacancies occurrin� shall be filled for the unexpired terms. in
the same manner as appointments in subsection B of this section.
F. Quorum:Three (3) members shall constitute a auorum.
G. Chair and Vice-Chair: The Commission shall elect a chair and vice-chair
from amon�its votin�members.
2-20-5 MEETINGS:
A.The Mayor will apqoint apqropriate staff to assist the Commission.

B.The Commission shall keep a written record of its proceedin�s, which shall
be a public record in accordance with State law. and shall activelv solicit public

C. The Commission shall meet as often as necessarv in order to file a,
schedule with the Citv Clerk. on or before November 30. 2015. Once a schedule
has been filed, the Commission will not meet until the Citv Council confirms a
new Commission for aurposes of further studvinQ Citv Council compensation.
2-20-6 RESPONSIBILITIES:
The Commission shall have the followin�responsibilities:
A. To studv the relationship of salaries to the duties of Council President and
Councilmembers and to studv the costs personallv incurred bv Councilmembers,
in performin�such duties;
B. To studv the relationshiq of Renton Council salaries and benefits to those
salaries and benefits of Councilmembers in surroundin� Citv iurisdictions and i
other current market conditions;
C. To establish salarv and benefits bv either increasin� or decreasin� the
existin� salarv and benefits of each position bv an affirmative vote of not less,
than three i3) members;and
D. To review and file a salarv and comqensation schedule with the Citv Clerk

Commission.
C. Salarv increases established bv the Commission shall be effective as ta all
Council elected officials, re�ardless of thei�terms of office.

to incumbent Council elected officials at the commencement of their next
subsequent terms of office.
E. Anv adiustment of salarv bv the Commission shall suaersede anv Citv

2-20-8 5ALARY SCHEDULE SUBJECTTO REFERENDUM PETITION:
A. Salarv increases and decreases shall be subiect to referendum petition in
the same manner as an ordinance upon filin�of such petition with the Citv Clerk

of a valid referendum petition, the salarv increase or decrease shall not �o into

pedestrian traffic through the Renton Transit Center, will be closed for street repairs.
Bus stops have been temporarily relocated along South 2nd Street and South 3rd Street.

appreciation to the City for supporting REACH in their efforts to eradicate homelessness and
hunger in the Renton community.
c) Kirk King, Seattle, shared some of his concerns regarding the negative impact that homeless
vagrants are having on businesses and residents in the City of Renton.Additionally, he
requested that Council find a way to work with the challenges this problem poses to the
safety of Renton residents.

b) Diane Dobson, Renton, shared her concerns about safety issues within her neighborhood due
to the increasing number of homeless people within the City.She shared some of her positive
and negative experiences,suggested that the Renton Police Department take a more
proactive approach to the homelessness problem, and urged Council to increase the level of
consistency in communication regarding this issue.
