fund balance to fund half of the total program cost of the Residential Plat Stormwater

SUMMARY OF ACTION:
On July 11, 2011, City Council held a public hearing in the matter of the proposed Gaile Annexation.
Following that public hearing, Council accepted the 60% petition and authorized the Administration to
forward a Notice of Intent to the King County Boundary Review Board (BRB). On September 19, 2011,
the BRB issued a Closing Letter for Completed Action indicating its approval of the annexation. The
next step for this proposed annexation is for Council to adopt the ordinance annexing the area to the
City. The area was pre-zoned Residential Four Dwelling Units per Acre (R-4) as part of Ordinance #5561
and the Fairwood pre-zone. The R-4 zoning will become effective upon annexation. City departments
conducted a review of the annexation proposals and all departments indicated that the annexations
represent logical extensions of services and raised no concerns.
STAFF RECOMMENDATION:
Adopt the ordinance annexing the Gaile Annexation area.

ORDINANCE NO. ________
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON ANNEXING CERTAIN
TERRITORY OF THE CITY OF RENTON (GAILE ANNEXATION; FILE NO. A-11-001)
WHEREAS, under the provisions of RCW 35A.14.120, as amended, a petition in writing
requesting that certain territory contiguous to the City of Renton, as described below, be
annexed to the City of Renton, was presented and filed with the City Clerk on or about May 24,
2011.
WHEREAS, prior to the filing and circulation of said petition for annexation to the City of
Renton, the petitioning owners notified the City Council of their intention to commence such
proceedings as provided by law, as more particularly specified in RCW 35A.14.120 and upon
public hearing thereon, it having been determined and the petitioning owners having agreed to
accept that portion of the City's Comprehensive Plan as it pertains to the territory including the
applicable Zoning Code relating thereto; and
WHEREAS, the King County Department of Assessments has examined and verified the
signatures on the petition for annexation on, or about, June 1, 2011 and determined that the
signatures represent at least sixty percent (60%) of the assessed value (excluding streets) of the
area to be annexed, as provided by law; and
WHEREAS, the Department of Community and Economic Development the City of
Renton having considered and recommended the annexing of said property to the City of
Renton; and
WHEREAS, the City Council fixed July 11, 2011, as the time and place for a public hearing

in the City Council Chambers, City Hall, Renton, Washington, on the petition and notice thereof
having been given as provided by law; and
WHEREAS, pursuant to said notices public hearings have been held at the time and
place specified in the notices, and the Council having considered all matters in connection with
the petition and further determined that all legal requirements and procedures of the law
applicable to the petition method for annexation have been met; and
WHEREAS, the King County Boundary Review Board having deemed the "Notice of
Intention" approved as of September 19, 2011; and
WHEREAS, the City of Renton pre-zoned the annexation site R-4, four units per net acre,
as part of Fairwood Prezone Ordinance No. 5561 and that zoning will become effective upon
annexation;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
SECTION I.The findings, recitals, and determinations are hereby found to be true
and correct in all respects. All requirements of the law in regard to the annexation by petition
method, including the provisions of RCW 35A.14.120, 130, 140, and 150 have been met. It is
further determined that the petition for annexation to the City of Renton of the property and
territory described below is hereby approved and granted; the following described property
being contiguous to the City limits of the City of Renton is hereby annexed to the City of
Renton, and such annexation to be effective on and after the approval, passage, and thirty days
after publication of this Ordinance; and on and after said date the property shall constitute a
part of the City of Renton and shall be subject to all its laws and ordinances then and thereafter

in force and effect; the property being described as follows:
See Exhibits “A” attached hereto and made a part hereof as if fully set forth
herein
[Said property, approximately 44-acres, the western boundary is coterminous
with existing City limits, with parcel lines in proximity of Southeast 160th Place to
the north, parcel lines and Southeast 162nd Place to the east, and parcel lines in
proximity of Southeast 164th Street to the south.]
and the owners of the property within the annexation shall be subject to the City's
Comprehensive Plan and Zoning Code.
SECTION II.This Ordinance shall be effective upon its passage, approval, and thirty
days after its publication.
A certified copy of this Ordinance shall be filed with the King County Council, State of
Washington, and as otherwise provided by law.

SUMMARY OF ACTION:
Eoscene Corporation leased offices at the 200 Mill Building between March of 2002, amended in June
2004, and May 2005. In 2006, Eoscene subleased Suites 400 and 410 to Etelos Inc. In October 2008,
Etelos vacated their premises prematurely and returned possesion of same to Eoscene. In September of
2009, Eoscene vacated their premesis and defaulted on their rents. The City filed suit against Eoscene
and Etelos in King County Superior Court. This Agenda Bill seeks Council approval of a settlement in the
City's favor of $50,000, payments no later than October, 2014.
STAFF RECOMMENDATION:
Approve a Settlement Agreement/Mutual Release with Eoscene and authorize the Mayor and City Clerk
to sign.

with Eoscene Corporation for Past Due Rents at the 200 Mill

Issue:
Should the Council authorize the Mayor and the City Clerk to sign a Settlement & Mutual
Release Agreement with the Eoscene Corporation for past due rents for Suites 400, 410
and 600 in the 200 Mill Building?
Recommendation:
Council authorize the Mayor and City Clerk to sign the Settlement & Mutual Release
Agreement.
Background:
·The City leased Suite 400 in the 200 Mill Building to Eoscene Corporation in 2002.
The City’s property manager for the 200 Mill Building is Kidder Mathews.
·In 2004, Eoscene leased additional space described as Suite 410 and Suite 600.
·In 2006, the City approved the sublease of Suites 400 and 410 to Etelos Inc. That
sublease was in effect through June, 2010.
·Etelos vacated prematurely in October, 2008. Their settlement with the City is
considered in a separate Agenda Bill.
·Because they fell several months behind in rent payments, several vacation
actions were taken against Eoscene by KM. Late notices and statements were
sent whenever they fell behind.
·Eoscene attempted to renegotiate terms and conditions of their rent, but were
not able to provide an acceptable repayment plan for their back rents. At the
time they vacated the building in March of 2009, they owed $46,945.
·After unsuccessful attempts to collect back rents, the City filed suit in King
County Superior Court. The Administration authorized the use of an outsourced
attorney in this matter, Sayre Law Offices, a firm that regularly represents Kidder
Matthews’ and their clients’ interests in the specialized area of pursuit of past

due commercial rents.
·Eoscene filed counterclaims, which were shown to have no substance. After
some additional procedural delays, Eoscene finally participated in the
negotiations that led to the Agreement, which is attached to the Agenda Bill.
·The settlement is for $50,000 of the $253,456.03 accumulated debt. That debt
included the unsettled amount of rents due from the sub lessee, Etelos.
·Eoscene was required to provide certified financial statements showing that it
does not possess enough capital or salable assets to settle the debt with a lump
sum payment. The extended payment schedule was agreed to as reasonable
while still providing the means for Eoscene to continue to operate and create
revenue.
·Eoscene has the right to seek payments for back rents from Etelos. Section 3 of
the Settlement Agreement insures that the City, and not Eoscene, will receive
any and all of those payments, if such action is pursued by Eoscene.
Conclusion:
Approving this Settlement & Mutual Release Agreement provides some cash flow for the
operation of the City’s Leased Properties Fund 108 and maintains the City’s integrity
regarding pursuit of defaulting tenants.

SUMMARY OF ACTION:
The Community Services Department submits CAG-10-119, Philip Arnold Park Ballfield Lighting, for
release of retainage. The project started on September 27, 2010, and was completed on January 7,
2011. The contractor did not complete all of their project closeout paper work until May 2011, and the
City received the release papers in September 2011. The contractor, Milne Electric, Inc., fulfilled the
terms of their contract by installing ballfield lighting improvements to Philip Arnold Park.
STAFF RECOMMENDATION:
Approve the project, and release the retained amount of $9,903.87. All required lien releases have
been obtained.

SUMMARY OF ACTION:
The existing parking lot light fixtures around the Renton Community Center and Carco Theatre are
inadequate to safely light the exterior spaces. There are too few fixtures and the lights are dated high
pressure sodium lights which emit a pale yellow light, leaving many dark spaces in the parking lot. The
new fixtures will double the existing fixture numbers, including pedestrian-scaled fixtures around the
Community Center and Carco Theatre, and will be LED (light emitting diodes) lights, saving nearly
$1,000 in annual energy costs, and significantly decreasing staff maintenance costs. The quote opening
was September 8, 2011. Eight quotes were submitted, and Transportation Systems, Inc. was the low
quote. Staff has reviewed the quote for completeness, inclusion of all required forms, mathematical
correctness of the quote, and reference checks. All of the paperwork is in order. Staff proposes to
accept the quote of $247,582.13. The Capital Improvement Program adjusted budget for 2011 Light
System Upgrades is $334,949.00. To date, $90,111.28 has been spent or encumbered for various light
system projects, with a balance of $244,837.72. In order to increase funds to the contract amount, and
to provide a construction contingency, staff recommends utilizing the following funding sources.

SUBJECT:Cedar River Park Parking Lot Lighting – Contract Agreement
ISSUE:
Should the Council concur with the staff recommendation to execute the Agreement for
Services with Transportation Systems, Inc., to remove the existing parking lot lighting
and install new exterior lighting at Cedar River Park parking lot and Carco Theatre, and
an electric car charging unit?
RECOMMENDATION:
Staff recommends approval of the Agreement for Services in the amount of $247,582.13
between the City of Renton and Transportation Systems, Inc. to remove the existing
parking lot light fixtures at Cedar River Park, and install new light fixtures, including
around Carco Theatre. The staff’s estimate for this work was $240,000.00
The 2011 Adjusted CIP Budget for Parks General Major Maintenance – Light System
Upgrades is $334,949.00. To date, $90,111.28 has been spent or encumbered for park
lighting projects, with a balance of $244,837.72 remaining. In order to increase funds to
the contract amount and to provide a construction contingency, staff recommends the
transfer and use of $21,600.00 from Boundary, Topographic & Site Survey

SUMMARY OF ACTION:
The goal of the Washington Traffic Saftey Commission's "Target Zero Teams" program is to reduce the
number of people killed or seriously injured by impaired drivers in King County through aggressive,
multi-jurisdictional, high-visibility patrols using an integrated systems approach to traffic safety which
is evidenced-based and targets the locations where the most safety benefit can be realized. To help
achieve this goal, the Washington Traffic Safety Commission grants funding to the Renton Police
Department (and other King County police agencies). Officers will be deployed in coordination with

THIS AGREEMENT, pursuant to Chapter 39.34 RCW, is made and entered into
by and between the Renton Police Department and the Washington
Traffic Safety Commission (WTSC).
TERM: October 1, 2011 to June 30, 2012

IT IS THE PURPOSE OF THIS AGREEMENT to provide funding for King
County Law Enforcement Agencies to participate in the Target Zero Teams
project.
GOAL: to reduce the number of people killed or seriously injured by impaired
drivers in King County through aggressive, multi-jurisdictional, high-visibility
patrols using an integrated systems approach to traffic safety which is
evidenced-based and targets the locations where the most safety benefit can
be realized.
IT IS, THEREFORE, MUTUALLY AGREED THAT:
1.SCOPE OF WORK: The Target Zero Team DUI patrols will be deployed at
times and locations where data indicates that the most safety benefit can
be realized as determined by the King County Target Zero Task Forces.
2.CONDITIONS: the Renton Police Department will deploy highly skilled
officers in coordination with other King County Law Enforcement agencies,
the King County Target Zero Task Forces, and the WSP District 2 Target
Zero Team to generate the highest amount of deterrence possible.
The Renton Police Department certifies that all of the officers that
participate in DUI emphasis patrols under the terms of this agreement are
SFST trained. Officers participating on the Target Zero Teams project
must be proficient in conducting standard field sobriety tests. SFST
training is required as follows:

pass SFST refresher training before participating on these
patrols.
·Officer who received SFST training in 2008 or later will need to
take the SFST refresher training when their BAC re-certification
is due to stay current and be qualified to work these patrols.
(BAC re-certification and SFST refresher training are required
every three years.)
·The 16-hour Advanced Roadside Impaired Driving Enforcement
(ARIDE) course is recommended for officers participating in
Target Zero Team patrols.
3.PAYMENT FOR LAW ENFORCEMENT: the Renton Police Department will
provide commissioned law enforcement with appropriate equipment
(vehicle, radar, etc.) and on an overtime basis (not to exceed 1.5 times
their normal salary and benefits) to participate in these emphasis patrols
not to exceed officer overtime of $10,837.50.
Overtime for court appearances that result from a law enforcement officer
making a DUI arrest while on Target Zero Teams patrol will be considered
for reimbursement with approval from the Target Zero Manager or her
designee.
4.DISPATCH: WTSC will reimburse communications officers/dispatch
personnel for work on this project providing the Renton Police
Department has received prior approval from the Target Zero Manager.
5.GRANT AMOUNT: WTSC will reimburse the Renton Police Department
for overtime salary and benefits. Your agency is allotted $10,837.50 for
the cost of this project. This allocation may be increased by your Target
Zero Manager during the above campaign(s), without amending this
agreement PROVIDED THAT the increase in the allocation does not exceed
50% of the original amount. Any increase in allocation exceeding 50%
will require an amendment to this document.
6.PERFORMANCE STANDARDS:
a.All participating law enforcement officers are required to have 3
self-initiated contacts per hour of enforcement, or show DUI
arrests.
b.Some violator contacts may result in related, time-consuming
activity. This activity is reimbursable.
c.Other activities, such as collision investigation or emergency
response that are not initiated through emphasis patrol contact
WILL NOT be reimbursed.
9.REIMBURSEMENT OF CLAIMS: Claims for reimbursement must include:
a.Invoice Voucher (A19-1A Form).
·The Renton Police Department identified as the “Claimant”;

10. DEADLINE FOR CLAIMS: All claims for reimbursement for emphases
conducted prior to June 30 must be received by WTSC no later than August
15, 2012. Monthly billing is preferred.
11.DISPUTES: Disputes arising under this Memorandum shall be resolved
by a panel consisting of one representative of the WTSC, one
representative from the Renton Police Department, and a mutually
agreed upon third party. The dispute panel shall decide the dispute by
majority vote.
12.TERMINATION: Either party may terminate this agreement upon 30
days written notice to the other party. In the event of termination of this
Agreement, the terminating party shall be liable for the performance
rendered prior to the effective date of termination.
13.SUPPLANTING DISCLAIMER: I certify that none of the funds for this
project supplant the normally budgeted funds of this agency nor do
these funds pay for routine traffic enforcement normally provided by this
agency.

SUMMARY OF ACTION:
On October 18, 2010 Council approved a new program to assume maintenance and operation of all
stormwater facilities in plats that manage runoff from public streets. The budget needed to implement
the program was to be presented to Council as part of the 2012 budget adjustment process and phased
in over a few years depending upon how many stormwater facilities were ready for assumption by the
City. The Surface Water Utility has been inspecting the facilities and working with the Homeowners
Associations (HOAs) to bring them up to City maintenance standards so that the facilities could be
transferred to the City to assume maintenance starting in 2012. There are a sufficient number of
facilities that have been properly maintained by the HOAs to warrant implementing half of the program
in 2012 including hiring staff and purchasing equipment. The remaining half of the program would be
implemented in 2014. No additional Utility revenue increase would be needed to start the program in
2012. However, a revenue increase would be required in 2013 and 2014 to fully implement the program.
STAFF RECOMMENDATION:
Approve use of $372,000 of Surface Water Utility fund balance to fund half of the total program cost in
2012 including hiring needed staff and purchasing equipment. This item will be included in the
upcoming 2012 budget adjustment ordinance. A rate increase will be required in 2013 and 2014 to fully
implement the program.

ISSUE:
Should Council approve the renewal of the existing Agreement for the Emergency Sale of
Water between the City of Renton (City) and the City of Seattle (Seattle)?
RECOMMENDATION:
Approve the renewal of Agreement for the Emergency Sale of Water between the City
and Seattle for a 50-year period.
BACKGROUND SUMMARY:
The current agreement for the emergency sale of water between the City and Seattle
will expire on December 31, 2011. Seattle requests a new agreement similar to the
previous agreement approved by Council in 2002.
In order to maintain continuity of service during emergency events for the City to
provide water to our customers, the City of Renton has constructed and maintained
several water system interties with the City of Seattle. We also have water system
interties with neighboring cities and water districts.
An interlocal agreement is needed to establish the conditions for the use of the interties,
the availability and quantity of water to be sold and the rate for the sale of water.
Under this agreement, the City will have the sole discretion to determine the availability
and the quantity of surplus water for sale to Seattle for emergency use. In exchange,
Seattle is willing to sell water to the City to recharge our aquifer, if needed, such as in
case of a severe drought. The proposed rate for the sale of emergency water to Seattle
will be the same as the City’s rate for residential customers. Seattle’s rate to the City for
the sale of emergency water will be the same rate that Seattle charges all its other
wholesale purveyors, and it is established through Seattle Municipal Code.

In April 2011, the City signed a 50-year (2012-2062) wholesale water supply contract
with Seattle. Under the new contract Seattle will provide us with additional water to
supplement our own supply sources to meet water demand from future growth in
population and development within our water service area. Seattle would like to renew
the existing emergency water sale agreement for a period of 50 years so that this
agreement and the wholesale water supply agreement will expire on the same date of
January 1, 2062.
CONCLUSION:
The renewal of the emergency sale of water between the City of Renton and the City of
Seattle will provide mutual benefit to both parties in securing water supply in case of an
emergency. Council’s approval of the agreement is necessary for the City to maintain
continuity to provide water service to our customers during emergency events.

AGREEMENT FOR THE SALE OF WATER
IN AN EMERGENCY BY
THE CITY OF RENTON TO THE CITY OF SEATTLE
This AGREEMENT made and entered into this day of _____________, 2011, by the
CITY OF RENTON, a municipal corporation of the State of Washington, hereinafter called
"RENTON" and the CITY OF SEATTLE, a municipal corporation of the State of Washington,
acting through Seattle Public Utilities, hereinafter called "SEATTLE".
WHEREAS, SEATTLE and RENTON have existing interties between their water
systems;
WHEREAS, SEATTLE may experience emergency situations that call for an
augmentation of its water supply, such as certain water shortage periods due to low
snowpack/precipitation, inflows in Cedar and Tolt River Watersheds, a transmission
pipeline break or an episode of high turbidity in one of its reservoirs; and
WHEREAS, RENTON, in the spirit of intergovernmental cooperation during such
water supply emergencies, is willing to sell an increment of water to SEATTLE when
available during non-peak periods; and
WHEREAS, SEATTLE is willing to sell water to RENTON to allow RENTON's ground
water aquifer to recharge, when water is available following a water shortage emergency;
where RENTON has supplied emergency water to SEATTLE; and,
WHEREAS, the parties desire to enter into an AGREEMENT providing for the sale of
water in an emergency from RENTON to SEATTLE, and for the subsequent sale of an
equivalent amount of water from SEATTLE to RENTON, if necessary, to allow recharge of
RENTON's Aquifer.
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
1)Term of AGREEMENT. This agreement shall be in effect beginning on January 1,
2012 and shall remain in effect until January 1, 2062, unless terminated by either
party in accordance with Section 16 of this AGREEMENT. The rates and quantities
of water sold are set forth in Sections (2), (7), and (10).
2)Sale Price of Renton Water. SEATTLE shall pay to RENTON for all water delivered at
the rate, in effect at the time of water delivery, of RENTON’s wholesale water rate.
3)Location of Interties: This Agreement is limited to the two (2) intertie locations
described as follows: Tiffany Park Pump Station Interties located at the intersection
of Kirkland Avenue SE and the Cedar River Pipeline right-of-way (Section 21
Township 23 Range 5); and Union Avenue Intertie, located at the intersection of
Union Avenue SE and SE 2nd Street (Section 16 Township 23 Range 5). The physical
arrangement of the interties is shown in Exhibits 1 and 2.
4)Metering. SEATTLE shall provide, and RENTON shall own and maintain, an

appropriate metering device to measure the water flowing from RENTON's system
into SEATTLE's system at the point of service connection. Additional metering
equipment approved by RENTON to transmit signals to RENTON's recording
equipment located elsewhere shall be provided as determined by RENTON, all at
SEATTLE's expense.
5)Priority and Continuity of Service. The determination of whether water is available
for SEATTLE shall be at the sole discretion of RENTON. In the event of a condition
requiring restrictions on the delivery of water, RENTON shall have the right to
restrict or interrupt service to SEATTLE. RENTON may voluntarily interrupt or
reduce deliveries of water to SEATTLE if RENTON determines that such interruption
or reduction is necessary or reasonable. Except in cases of emergency and in order
that SEATTLE's operations will not be unreasonably interfered with, RENTON shall
give SEATTLE reasonable notice of any such interruption or reduction, the reason
therefore, and the probable duration thereof. SEATTLE shall discontinue or reduce
service from RENTON upon reasonable notice from RENTON. Service shall be
reactivated or increased again subject to the aforementioned conditions.
6)Water Quality. The quality of water delivered under this AGREEMENT shall comply
with all applicable provisions of State and Federal law and rules and regulations of
the appropriate State agency governing water quality. In addition to the above
requirements, RENTON agrees to deliver water which shall be of no less quality than
is delivered to its customers throughout the RENTON service area. Prior to any
delivery of water, information on current water quality will be provided to the
receiving party so that blending, compatibility and other water quality issues can be
evaluated and addressed, if practicable.
(7)Quantity of Water. Depending upon water availability in the RENTON system,
RENTON shall make available for purchase by SEATTLE up to the approximate
amount of two million (2,000,000) gallons per day from the existing emergency
intertie located at the Tiffany Park Pump Station. The rate of delivery of water from
Tiffany Park Pump Station system to SEATTLE's system shall vary between zero and
approximately 1,400 gallons per minute. Also in the fall and winter RENTON may
make available an additional amount up to approximately three and one-half
million (3,500,000) gallons per day from the intertie at Union Avenue SE and SE 2nd
Street. The rate of delivery of water from this intertie shall vary between zero and
approximately 2,400 gallons per minute.
8)Miscellaneous Control Devices. RENTON reserves the right to require SEATTLE to install, as
a condition of water service, pressure reducing valves, backflow preventative devices,
pressure relief valves, back-pressure sustaining valves, pipeline flow limiting devices or
similar devices at locations where RENTON determines a need to protect its
facilities.
9)Coordination and Project Management.
A)Operations:

For the purpose of operating the interties between RENTON and SEATTLE,
coordination shall occur between representatives of the systems, who are:

The coordination shall consist of exchanging operational information such as the
interties used, the respective flow rates, back-pressure sustaining valve set points,

maintaining safe operation of both systems.
B.Engineering:
For the purposes of coordinating engineering issues regarding the RENTON and
SEATTLE interties, the following personnel shall be the designated representatives:

10)RENTON's Aquifer Recharge. It is recognized that runoff into SEATTLE's surface
water storage facilities generally exceeds the storage capacity during the winter and
spring months. It may be necessary, due to RENTON supplying water to SEATTLE, to
allow RENTON's aquifer to recharge during the winter and spring months.
Following a water shortage emergency and recovery of SEATTLE's water system
impoundments on the Cedar and Tolt Rivers, SEATTLE will sell water to Renton. The

water sale will be based on availability at the intertie locations between SEATTLE
and RENTON's systems and at such flow rate as is available from the intertie
location during the following winter or spring. The quantity of SEATTLE's water,
made available for allowing RENTON's Aquifer to recharge, shall not exceed the
quantity of water that was supplied by RENTON to SEATTLE during the water
shortage emergency. SEATTLE will sell the water to RENTON at the then applicable
Commodity Charge Rates in effect for RENTON under Seattle Municipal Code
Section 21.04.440.E.2, as it may be amended from time to time, plus any emergency
surcharge, if applicable generally to the wholesale customers at that time.
The determination of whether water is available for RENTON, to allow RENTON's
Aquifer to recharge, shall be at the sole discretion of SEATTLE. SEATTLE may
voluntarily interrupt or reduce delivery of said water, providing that such
interruption or reduction is necessary or reasonable. Except in cases of emergency,
and in order that Renton's operations will not be unreasonably interfered with,
SEATTLE shall give RENTON reasonable notice of such interruptions or reduction,
the reason therefore, and the probable duration thereof.
11)Payment. The party supplying water shall read the meter once each month at
approximately thirty (30) day intervals. Payment shall be made by the party
receiving water as soon as possible after receipt of statement from the party
supplying water, and in any event, not later than the tenth (10) of the second
month following the presentation of the bill.
In the event a meter shall fail to register or obviously register incorrectly, the
amount of water considered delivered through said meter shall be the amount
delivered the previous day or the last day that the meter was previously known to
be properly functioning and the total amount registered shall be pro-rated based on
the number of days multiplied times the reading used unless reasonable data is
available evidencing a different total amount.
12)Damages for Late Payment. The party supplying water may assess a late charge on
the party receiving water for failure to comply with the provisions in Section (11).
This charge shall be at the rate of twelve percent (12%) per year. In the event that
the party receiving water should fail to make any payment for a period of sixty (60)
days after the same becomes due, the party supplying water shall have the right to
terminate further water service until such delinquency is cured.
13)Procedure for Amending the Contract. Either party can request the other to
consider an amendment of the AGREEMENT. Any proposed amendments shall be
made in writing. Amendments may be made if they are mutually acceptable to
RENTON and SEATTLE and signed by both parties.
14)Access to Facilities and Records. Each party shall be entitled to inspect the facilities
of the other at any reasonable time. Both parties agree to make mutually available
such information or records as are at their disposal and as may be reasonably

necessary to properly implement any section of this AGREEMENT.
15)Non-Assignability. Neither this AGREEMENT nor any interest therein shall be
transferred or assigned by SEATTLE without prior written consent of RENTON.
16)Termination. This AGREEMENT may be terminated in whole or in part by either
party any time after one year from the date of this AGREEMENT, upon ninety (90)
days written notice sent by certified mail to the other party.

City of Renton (City) and Skyway Water and Sewer District (Skyway)?
RECOMMENDATION:
Approve the Agreement for the Emergency Sale of Water between the City and Skyway
Water and Sewer District.
BACKGROUND SUMMARY:
As part of the City’s planning to maintain continuity of service during emergency events
for providing water to our customers, the City of Renton and Skyway had jointly
constructed in 2006, an emergency water system intertie located at Skyway’s Dimmitt
pump station. The City also maintained emergency water system interties with the City
of Seattle, Kent and Tukwila.
The City of Renton and Skyway need to enter into an interlocal agreement to establish
the conditions for the use of the interties, the availability and quantity of water to be
sold and the rate for the sale of water. Under this agreement, the City will have the sole
discretion to determine the availability and the quantity of surplus water for sale to
Skyway for emergency use. In exchange, Skyway is willing to sell water to the City if
needed during emergency events. The proposed rate for the sale of emergency water
from Renton to Skyway will be the same as Renton’s wholesale water rate for
non-residential/commercial customers. Skyway’s rate to the City for the sale of
emergency water will be Skyway’s wholesale water rate.

AGREEMENT FOR THE SALE OF WATER IN AN EMERGENCY
BETWEEN THE CITY OF RENTON
AND SKYWAY WATER AND SEWER DISTRICT
This AGREEMENT made and entered into this _____ day of _________, 2011, by the
CITY OF RENTON, a municipal corporation of the State of Washington, hereinafter called
"RENTON" and SKYWAY WATER AND SEWER DISTRICT, a municipal corporation of the State
of Washington, hereinafter called "SKYWAY".
WHEREAS, RENTON and SKYWAY may experience periodic water supply shortfall;
WHEREAS, RENTON and SKYWAY recognize the public benefits of cooperation and
collaborative problem solving;
WHEREAS, RENTON and SKYWAY are willing to sell water in a emergency at the
existing system intertie,
WHEREAS, the parties desire to enter into an AGREEMENT providing for the sale of
water in an emergency;
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
1)Term of AGREEMENT. The effective date of this AGREEMENT shall be
_____________________, 2011. The AGREEMENT shall be for a minimum of one
(1) year and shall continue in full force and effect in its present form, or as amended
until terminated by either party in accordance with Section 15 of this AGREEMENT.
The rates and quantities of water sold are set forth in Sections (3), and (7).
2)Sale. Subject to the conditions set out in this agreement either party may sell water
to the other in the event that the receiving party is experiencing an emergency. An
emergency is defined, for the purposes of this agreement, as a situation of relative
short duration during which either RENTON or SKYWAY cannot meet water
consumption needs of all or part of its respective distribution system.
3)Rate: RENTON shall pay to SKYWAY for all water delivered at the rate of SKYWAY’s
wholesale water rate. SKYWAY shall pay to RENTON for all water delivered at the
rate of RENTON’s wholesale water rate. The rates charged by the SELLER shall be
the rate in effect at the time of water delivery.

4)Location of Intertie: This Agreement is limited to one (1) intertie locations
described as follows: Skyway’s Dimmitt Booster Station located at 12603 82nd
Avenue South, near the intersection of 82nd Avenue South and South 126th (Section
12 Township 23 Range 4). The physical arrangement of the intertie is shown in
Exhibits 1 and 2.
5)Metering. RENTON and SKYWAY shall each provide, and own and maintain, an
appropriate metering device to measure the water flowing through the intertie.
Before allowing any water to flow through the intertie, the party requesting the
water shall provide a description and documentation of the emergency condition to
the other party.
6)Priority and Continuity of Service. The determination of whether water is available
for emergency sale shall be at the sole discretion of the party delivering (selling) the
water. In the event of a condition requiring restrictions on the delivery of water,
the party delivering the water shall have the right to restrict or interrupt service.
The party providing water may voluntarily interrupt or reduce deliveries of water if
it determines that such interruption or reduction is necessary or reasonable. Except
in cases of emergency and in order that operations will not be unreasonably
interfered with, the party providing water shall give the party buying water,
reasonable notice of any such interruption or reduction, the reason therefore, and
the probable duration thereof. The party buying water shall discontinue or reduce
service from the intertie upon reasonable notice. Service shall be reactivated or
increased again subject to the aforementioned conditions.
7)Water Quality. The quality of water delivered under this AGREEMENT shall comply
with all applicable provisions of State and Federal law and rules and regulations of
the appropriate State agency governing water quality, and subject also to applicable
provisions of City ordinances relating thereto and not inconsistent herewith. Each
party agrees to deliver water which shall be of no less quality than is delivered to its
other retail customers throughout the service area. Prior to any delivery of water,
information on current water quality will be provided to the receiving party so that
blending, compatibility and other water quality issues can be evaluated and
addressed.
8)Quantity of Water. Depending upon demand conditions, water availability
(including conservation impacts), as well as aquifer behavior, in the water systems,
each party may make available, for the purchase by the other party, up to the
approximate amount of one million eight hundred thousand (1,800,000) gallons per
day, at flow rates vary from zero to approximately 1,250 gallons per minute, from
the intertie described and located in Section (4) of this agreement.

9)Coordination and Project Management.
A)Operations:
For the purpose of operating the intertie between RENTON and SKYWAY,
coordination shall occur between representatives of the systems, who are:
Water Maintenance Manager for the City of Renton
and
General Manager for Skyway Water and Sewer
(or their designated representatives )
The coordination shall consist of exchanging operational information such as the
interties used, the respective flow rates, back-pressure sustaining valve setpoints,
system pressure effects, water quality characteristics, and other operational
information as necessary to accomplish the purposes of this AGREEMENT while
maintaining safe operation of both systems.
B.Engineering:
For the purposes of coordinating engineering issues regarding the RENTON and
SKYWAY intertie, the following personnel shall be the designated representatives:

Cheryl Scheuerman, Manager for Skyway Water and Sewer
(or their designated representatives or replacements)
The engineering issues addressed shall include operational criteria as well as
hydraulic behavior, water quality considerations, and other appropriate engineering
