6.CONSENT AGENDA
The following items are distributed to Councilmembers in advance for study and review, and the
recommended actions will be accepted in a single motion. Any item may be removed for further

b. Mayor Law appoints David Basco to the Airport Advisory Committee, West Hill Neighborhood –
primary (position previously held by Roger Lewis), for a term expiring 5/7/2015. Refer to
Community Services Committee.
c. Mayor Law reappoints the following individuals to the Airport Advisory Committee, each for a
three year term expiring on 5/7/2015: Marlene Mandt (Kennydale neighborhood primary
representative), Robert Dempster (Aircraft Owners/Pilots Association primary representative),
Karen Stemwell (Aircraft Owners/Pilots Association alternate representative), and Ulf
Goranson (Airport‐At‐Large primary representative). Council concur.
d. City Attorney Department recommends amending City Code by correcting a reference
in Renton Municipal Code (RMC) 1‐3‐1.B. regarding gross misdemeanors. Council concur.

e. Community and Economic Development Department submits King County Boundary Review
Board Closing Letter regarding the Windstone V Annexation, and recommends a public hearing
be set on 6/18/2012 to consider approving the annexation and zoning. Council concur to set

f. Community Services Department requests authorization to waive City Center Parking Garage
fees in the total amount of $6,000 for volunteers working at the 2012 Renton Farmers Market

$54,405.35 to Lakeridge Paving Company, LLC, contractor, if all required releases are obtained.

It was recently noted in RMC 1-3-1 that an amendment intended in Ordinance No. 5635 was
inadvertently omitted. This ordinance is a housekeeping measure to correct RMC 1-3-1.B to include a
reference to "gross misdemeanors."

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTION
1-3-1 OF CHAPTER 3, REMEDIES AND PENALTIES, OF TITLE I (ADMINISTRATIVE)
OF ORDINANCE NO. 4260 ENTITLED “CODE OF GENERAL ORDINANCES OF THE
CITY OF RENTON, WASHINGTON”, CORRECTING SUBSECTION 1-3-1B TO
INCLUDE GROSS MISDEMEANORS.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS:
SECTION I.Subsection 1-3-1B, Violations, of Chapter 3, Remedies and Penalties, of
Title I (Administrative) of Ordinance No. 4260 entitled “Code of General Ordinances of the City
of Renton, Washington”, is hereby amended as follows:
B. Violations: Any person convicted of a criminal violation of any section of
the Renton Municipal Code shall be punished in accordance with RCW
9A.20.021(2) and (3), as now or hereafter amended, for gross misdemeanors and
misdemeanors. Whenever a specific penalty or range of penalties has been
established for a crime by the State Legislature and that crime has been
incorporated into the Renton Municipal Code, either directly or by reference,
then the penalty ranges established by the Legislature shall govern and this
provision shall not be enforced.
SECTION II.This ordinance shall be effective upon its passage, approval, and thirty
(30) days after publication.

SUMMARY OF ACTION:
On March 12, 2012, City Council held a public hearing in the matter of the proposed Windstone V
Annexation. Following that public hearing, Council accepted the 60% petition and authorized the
Administration to forward a Notice of Intent to the King County Boundary Review Board (BRB). On May
16, 2012, the BRB issued a Closing Letter for Completed Action indicating its approval of the
annexation. The next step in the annexation of this area is for Council to hold a second public hearing
in the matter of zoning. Following that public hearing, the Council may adopt the ordinance annexing
the Windstone V area and the ordinance establishing zoning. City departments conducted a review of
the annexation proposal and all departments indicated that the annexation represents a logical
extension of their services and raised no concerns.
STAFF RECOMMENDATION:
Set June 18, 2012, for a public hearing to hold the second public hearing in the matter of zoning
the Windstone V annexation area; and to adopt the ordinances finalizing the annexation.

SUMMARY OF ACTION:
Volunteer workers are instrumental for the success of the Farmers Market, the Return to Renton Benefit
Car Show, and other public events that enrich the quality of life for Renton citizens and attract visitors
from other cities. As a show of support and appreciation, the City has customarily waived parking fees
in the City Center Parking Garage for those hours in excess of the initial free two-hour parking period.
Event managers submit Fee Waiver Requests for their events, which are then brought to the Council
Finance Committee for consideration.
STAFF RECOMMENDATION:
Authorize the Fee Waivers for the Farmers Market and Return to Renton Benefit Car Show.

Issue:
Should the Council authorize the Fee Waivers for volunteers’ parking fees at the City
Center Parking Garage for the 2012 Farmers Market and the 2012 Return to Renton
Benefit Car Show?
Recommendation:
Authorize the Fee Waiver Requests for volunteers’ parking fees at the City Center
Parking Garage for the 2012 Farmers Market and the 2012 Return to Renton Benefit Car
Show.
Background:
·Council previously authorized fee waiver requests for the Piazza Renton Volunteers
for 2011 and 2012 and for the Farmers Market Volunteers and the Return to Renton
Benefit Car Show Volunteers for 2011. Volunteers provide thousands of hours of
donated time to plan, market, and labor these events.
·The events are very popular with Renton residents and many visitors to our City.
Each of them in their own way provide direct benefit to the attendees and the City is
grateful for the volunteers’ service.
·While parking is free for the first two hours at the City Center Parking Garage, the
volunteers work many long hours.
·In appreciation for their service, the City has typically waived the need for additional
parking fees for the volunteers on event days.
·The calculated loss of revenue for 2012 is $6,000.00 an amount that is greatly
exceeded by the financial benefits of these events to the City, in addition to their
community-building character.

Conclusion:
Waiving parking fees for volunteers is a suitable gesture of appreciation for the many
hours of volunteer labor for events that help to make Renton a better place to live,
work, and play.

SUMMARY OF ACTION:
The project started on August 10, 2011 and was completed on May 11, 2012. The original contract
amount was $1,127,855.93 and the final contract amount is $1,088,106.86. Of the $1,088,106.86 final
contract amount, the following amounts will be paid by: Street Overlay Program will pay $746,106.86
and the Arterial Rehabilitation Program will pay $342,000.
STAFF RECOMMENDATION:
Accept completion of the project and approve the Final Pay Estimate in the amount of $137,391.79 and
approve the release of retainage for the full project in the total amount of $ 54,405.35 after sixty (60)
days, subject to the required authorization.

SUMMARY OF ACTION:
The project was awarded on September 26, 2011. Construction began on December 20, 2011, and was
completed on May 4, 2012. The original contract amount was $148,256.43 and the final amount is
$172,507.82, an increase of $24,251.39 or 16 percent. The majority of the increase in cost
(approximately $21,000) was due to having to rehabilitate two additional sewer mains. The two mains
were in such bad condition that the contractor had to rehabilitate those lines in order to install the
temporary plugs so they could bypass flows around the section of the Cascade interceptor to be relined.
The final cost was within the amount budgeted for the project.
Based upon Interlocal Agreement CAG-64-764 Addendum #1-11, Soos Creek Water and Sewer District is
responsible for 80 percent of Schedule A or $94,777.16 (based upon final cost).

The budgeted funds and reimbursement from Soos Creek are sufficient to cover the cost of the project

ISSUE:
Should the City accept the project and approve the final pay estimate for CAG-11-127
with SunCoast Environmental NW for the Cascade Interceptor Rehabilitation project?
RECOMMENDATION:
Accept the project, approve the final pay estimate, in the amount of $1,095.00, and
release the retainage in the amount of $7,877.06 after 60 days, subject to the receipt of
all required authorizations.
BACKGROUND SUMMARY:
Council awarded the Cascade Interceptor Rehabilitation contract to SunCoast
Environmental NW. on September 26, 2011. Construction began on December 20, 2011,
and was completed on May 4, 2012.
The original contract amount was $148,256.43 and the final contract amount is
$172,507.82, an increase of $24,251.39.
The additional costs to complete the construction were a combination of the following
unforeseen conditions:
●Rehabilitation of two additional feeder sewer mains that flow into the Cascade
Interceptor. The two mains were in such bad condition that the contractor had
to rehabilitate those lines in order to install the temporary plugs so they could
bypass flows around the section of the Cascade interceptor to be relined.
●A point repair had to be performed on one of the sewer mains prior to lining
the main.
●Some of the manholes that were rehabilitated were larger in diameter than
standard manholes and thus took more labor and materials to rehabilitate.

SECTION I. Subsection 1-3-1B, Violations, of Chapter 3, Remedies and Penalties, of
Title I (Administrative) of Ordinance No. 4260 entitled "Code of General Ordinances ofthe City
of Renton, Washington", is hereby amended as follows:
B. Violations: Any person convicted of a criminal violation of any section of
the Renton Municipal Code shall be punished in accordance with RCW
9A.20.021(2) and (3), as now or hereafter amended, for gross misdemeanors and
misdemeanors. Whenever a specific penalty or range of penalties has been
established for a crime by the State Legislature and that crime has been
incorporated into the Renton Municipal Code, either directly or by reference,
then the penalty ranges established by the Legislature shall govern and this
provision shall not be enforced.
SECTION II. This ordinance shall be effective upon its passage, approval, and thirty
(30) days after publication.

SECTION I. Section 6-10-1, Code Sections Adopted, of Chapter 10, Criminal Code, of
Title VI (Police Regulations) of Ordinance No. 4260 entitled "Code of General Ordinances of the
City of Renton, Washington", is hereby deleted in its entirety and replaced with the following:
6-10-1 REVISED CODE OF WASHINGTON. CRIMINAL OFFENSES ADOPTED:
A. The City of Renton adopts by reference the sections ofthe Revised Code of
Washington (RCW) noted in subsection C below, as and for a portion ofthe City
of Renton penal code, as if set forth in full, in detail and with specificity, including
the criminal, penal and offense classification and applicable penalty and
sentencing provisions unless a different classification and/or penalty is
specifically provided for the particular sections of the RCW adopted by
reference:
B. The adoption of sections of the RCW bv reference shall not be construed
or interpreted to vest in the City any authority or responsibility to prosecute
felony offenses, and the adoption of sections of the RCW which include felony
provisions shall be limited to those provisions falling within the City's authority,
and such adoption, and the provisions being adopted, shall be construed and

interpreted in accordance with the lawful authority ofthe City. However, at the

misdemeanors or misdemeanors in the RCW, as now enacted or hereafter

procedure), RCW Title 13 (Juvenile courts and juvenile offenders), RCW Title 16
(Animals and livestock), RCW Title 19 (Business regulations - miscellaneous),
RCW Title 26 (Domestic relations) RCW Title 46 (Motor vehicles), RCW Title 66
(Alcoholic beverage control), RCW Title 68 (Cemeteries, morgues and human
remains), RCW Title 69 (Food, drugs, cosmetics, and poisons), RCW Title 70
(Public health and safety), RCW Title 74 (Public assistance), RCW Title 76 (Forests
and forest products). RCW Title 77 (Fish and wildlife), RCW Title 79 (Public lands).
RCW Title 79A (Public recreational lands), RCW Title 81 (Transportation). RCW
Title 88 (Navigation and harbor improvements), and RCW Title 90 (Water rights -
environment).
D. The City of Renton adopts by reference the Model Traffic Ordinance
(MTO). and WAC 308-333-425, as now enacted or hereafter amended or
adopted, including all other statutes adopted by reference in the MTO and WAC
308-333-425, as and for a portion of the City of Renton penal code, as set forth

prevail unless the RCW, WAC or state constitution requires otherwise due to
preemption or supremacy.
