The Violator has had three (3) prior violations under this Section of the Code; and ii. The prior violations were within the last ten (10) years. Time served in jail is not excluded from the ten (10) year period. 4 c. If a ViolatarJDefendant is found guilty beyand a reasonable doubt,the VialatorJDefendant shail serve na less than five (5) days in jail for the first convictian, na less than ten (10} days for the secand convictian, and no less than thirty�30} days for any subsequent conviction. d. (Ord. 5129,3-14-05;Ord.5653,2-6-12) 6-1-2 DEFINITIONS: DISMRNTIED:A vehicle that is in parts or pieces such that it is apparently inoperable or unal�le to be lawfully operated upon public roads or highways. iNOPERABLE:A vehicfe that is apparen#1y not functianing or is inopera#ive or cannat be Iawfully operated upon public roads or highways. JUNK VEHICLE:A vehicle that meets at least three of the following requirements: (1)a vehicle that is three years old or older,(2)a vehicie that is extensively damaged,such damage including but not limited to any of the following:a broken window or windshield,or missing wheets,tires,motor, or transmission;(3)a vehicie that is apparentiy inoperabie; (4}a vehicle that has an appraximate fair market value equal only to the approximate value of the scrap in#he vehicle's current conditian; or(5}evidenca of inaperabiiity or damage that inciudes,but is not limited to,any bui3dup of debris that obstructs use,or a flat or missing tire or tires,ar a nonfunctianai motar or transmission,or missing bumpers,or missing license plates. or expired vehicle license plate tabs. LANDQWNER:A legai owner or owners nf priva#e reai property,or a person in possession or controi of private real property. MAINTAtN or MAINTENANCE:To hold or keep in an existing state or canditian,or keep in existence or continuance. RETAIN ar RETENTION:To continue to hold,have,keep,own,possess,or to axercise dominian or exercise control over. STORE or STORAGE:To place,accumulate,or leave in a iocation. VEFitCLE: RCW 46.04.670 is hereby adopted by reference,as naw worded or hereafter amended,as if fully set forth herein, and shall apply#o the interpretation and en#orcement af this Chapter. VEHICLE HULK:Any part or porkion of the body or chassis of a vehicle that is apparently inoperable or unable to be lawfully operated upon pubiic roads or highways. WRECKED:A vehicle or vehic4e hulk,ar any part thereo#that is dtsabled,destroyed.apparently inoperable,or extensively damaged. The storage, maintenance or retention ofjunk,wrecked,dismantied or an apparentiy inoperable vehicfe,vehicle huik,or any parts#hereof,on private reai property in the City is hereby declared to be a pubiic nuisance and subject to abatement in accordance with this CF�apter and RMC 1-3-3,,as now worded ar hereafter amended. C. Abatement Costs: Costs of abatement and remavai ofjunk,wrecked,dismantied or an apparently inoperable vehicle, vehicie hulk, or parts thereof,from private real praperty in the Ci#y may be first assessed against the last registered owner of the vehicle,vehicle hulk,or any parts thereof, if the identity of such owner can be determined, uniess such vehicie awner in the transfer of the ownership of such vehicie or vehicle hulk has complied with RCW 46 12.101, or second,the costs may be assessed against the landawner on which such vehicle,vehicle huik,or any parts thereof is stored; provided,that said vehicie,vehicle huik,or any paris thereo#,is stored,maintained,kept ar retained wi#h the landowner's permissian or acquiescence and shali constitute a lien therean. D. Notice:Before the abatement or removal of a junk,wrecked,dismantied or an apparentiy inoperable vehicle,vehicie hulk,or any parts thereof, notice shall be given by the Paiice Chief or his or her designee to the iast registered vehicie owner and Iegal vehicle awner of record,i#the identity af such owner can be Iawfulfy determined,and#he landowner af reai property upan which such vehicle ar vehic2e hulk or any parts thereof is located,that a public hearing may be reques#ed befare the Hearing Examir�er nf the City,by mailing a copy af the notice by certified maii,return receipt requested,to the last knnwn address of the vehicle's last registered and lega!owner and tandowner af rea!property on which the vehicle.vehicle hulk or any parts is located,or by personal service upon said owners,and if no hearing is requested within twenty-one{21) days from the date of mailing or personai service,the vehicie,vehicle hulk or any parts thereof may be removed and abated m accardance with this Chapter and RMC 1-3-3. E. Request for hiearing: !f a request for hearing is received by the hfearing Examiner,a notice giving the time, Iocation and date af such hearing an the question of the abatement and removal of such vehicle,vehicle hulk.or any parts thereof,as a public nuisance shall be mailed by certified mail with a retum receipt requested,to the landowner of the real praperty as shown on the King County tax assessment roil and to the last registered owner a�d legal owner of record of such vehicle, vehicle hulk,or any parts thereof, uniess the vehicle is in such candition that identification numbers are not available to determine ownership. F. Testimony:The applicant for hearing may either appear in person at such hearing or present a written skatement in time for consideration at the hearing and deny responsibility for the presence of the vehicle on the land,with his or her reasnns for such denial. I#it is determined at the hearing that the vehicie,vehicle hulk,or any parts thereof was piaced on the land without the consent of the landowner, and that the landowner has not subsequently acquiesced in its presence,then the Hearing Examiner shali not assess costs of administration or removal of the vehicle,vehicle huik or any parts thereof against the tandowner of the real property uppn which the vehicle,vehicle huik or any parts thereof is Iocated or otherwise attempt to coilect such costs from the landowr�er. G. Dispnsal:After natice has been given by the Police Chief of the City or his or her designee,of the intent of the City to abate the vehide,vehicle hulk,or any parts thereof,and no request for a hearing is received,or a hearing is held and the Hearing Examiner orders the uehicie,vehicle huik,or any parts thereof removed,the said vehicie,vehic�e huik or parts thereof shali be removed from private reai property by the Paiice Chief or his or her designee and disposed of to a licensed auto wrecker with notice to the Washington State Patrol and the State of Washingtan Qepartment of licenses. H. Exceptions:This Chapter shail not apply to: (1)a vehicle or paR thereof which is compietely enclosed within a building in a Iawfui manner where it is not visible from the street or other pubiic or private real property,or(2)a vehicle or part thereof whicfi is stored or parked in a Iawful manner on private real property zoned far and in connectfon with the business of a iicensed dismantier or 6censed vehicle dealer and is fe�ced according to RCW 46_80 130,or{3}a vehicle or part thereo# whict�is stored or parked in a lawfui manner on private reat property in an area zoned far and in cannection with the business of a licensed auto bady rspair shop ar facility. I Removal by Landowner:Nothing in this Sectian shai�be construed to prevent any�andowner or the person in controi of reai property,except City property,from immediately removing a vehicie,vehide hulk,or any parts thereof,which was left on such property without the IandawnePs permission,irrespective of any time limits specified eisewhere in this Chapter,by means of towing or otherwise,ta a garage designated by the Police Department;provided,#hat the Foliee DeparErrtent shaii be notified one ho�r prior to tha removai of such a vehicle,vehicie hulk,or any parts thereof. It shali also be uniawful to deposit,throw,dump or place any garbage, recyclables or yard waste on private property owned by another person in the City,without the consent of the landowner or person in possession or control of the real property. E. Uniawful Storage of Bulky Waste: It shall be unlawful for any person in the City to store, maintain,keep, retain, dump or accumulate bulky waste on private real property in the City,except for any licensed ancillary disposal provider or licensed business in connection with bulky waste collection or disposal i�an area zoned for the collection or disposal of bulky waste. Unlawful Deposit of Buiky Waste: It shall be unlawfui to deposit,throw,dump or place any bulky waste in any lane, alley, street, road or other public way or place in the City,except for bulky waste coilection by the City's collection contractor or any other person authorized by the City to collect bulky waste or a licensed ancillary disposal provider pursuant to a City permit. It shall also be unlawful to deposit,throw,dump or place any bulky waste on private real property owned by another person in the City,without the consent of the landowner or person in possession or control of the real property. G. Uniawful Storage or Deposit of Special or Hazardous Waste: It shall be unlawful for any person in the City to store, maintain, keep,deposit, retain,dump or accumulate special or hazardous waste on private or public reai property in the City. Any special or hazardous waste generated in the City shall be collected and disposed of in accordance with all Federal, State,County, and local statutes, ordinances, rules and regulations,by a solid waste coilection contractor licensed for such collection and disposal and stored and disposed of in an area zoned for the storage or disposal of special or hazardous waste. H. Unlawful Deposit or Disposal into the Waste Stream of Special or Hazardous Waste: It shall be unlawfui to deposit, throw,dump or place any speciai or hazardous waste into the waste stream in garbage cans or units, recycling bins or yard waste carts for regular garbage or recyclables collection,or to dispose of special or hazardous waste in a transfer station, recycling station or otherwise in the City,except in accordance with Federal,State or County statutes or ordinances and in the manner approved by the State Department of Ecology or its successor,and by a person licensed by law for coilection, transfer and disposal of special or hazardous wastes. I. Unlawful Deposit or Storage of CDL: It shall be unlawful to deposit,throw, dump,place or store any CDL on private or pubiic real property in the City,except for any licensed ancillary disposal provider or business in connection with CD� collection or disposal at a facility zoned for and designated for receiving disposal of CDL. J. Unlawful Use of Garbage Cans or Units, Dumpsters, Recycling Bins or Yard Waste Carts: It shall be unlawful to place, deposit or throw garbage, recyclables or yard waste in the garbage can or unit,detachable container,dumpster, recycling bin or yard waste cart that is owned, leased or rented by another person,without the consent of the person paying for the collection service. K. Unlawful Placement and Removal of Garbage Cans, Recycling Bins and Yard Waste Carts: It shail be unlawfui for a person residing in a single-family residence to place garbage. recyclables,or yard waste at the curbside for collection by the City's collection contractor more than 24 hours prior to the regular collection date for his or her single-family residence It shall also be unlawful for a person residing in a single-family residence to leave garbage cans, recycling bins or yard waste carts at the curbside more than 24 hours after collection by the City's collection contractor. Further, it shall be unlawful for a person residing in a single-family residence to maintain, place or store any garbage cans, recycling bins or yard waste carts at a location other than adjacent to the residential structure or within a fully enclosed building or garage. L. Unlawful Placement and Removai of Garbage Cans, Recycling Bins and Yard Waste Carts in Business Areas: It shall be unlawful for any person accumulating garbage, recyclables,and yard waste in the Center powntown Zone,Center Neighborhood Zone,Commercial Arterial Zone,or Center Village Zone,as set forth in RMC 4-2-02d,whose location requires the placing of garbage cans or units, recycling bins or yard waste carts on sidewalks or alleys for coilection,to piace garbage cans or units, recycling bins or yard waste carts on sidewalks or alleys earlier than 5:00 p.m. It shaii also be unlawful for any person who owns, leases or rents any garbage can or unit, recycling bins or yard waste carts in the zones referenced above to fail to remove their garbage,recyciing and yard waste containers from sidewalks or alleys by 9:30 a.m.foliowing collection of the garbage, recyclab�es or yard waste,except that if coilection has not occurred by the City's coilection contractor,then the garbage cans or units, recycling bins or yard waste carts shall be immediately removed following collection. Accumulation of Waste:All persons accumula#ing garbage in the City shall piace and accumulate the same in garbage cans,garbage units or detachable cantainers. Recyclables may also be accumulated in recycling bins or recycling carks,and yerd was#e may aiso be accumulated in yard waste carts. B. Callection of Garbage Required:Garbage collection shall be made by collsction contractors as authorized by the Gity. All persons and properties within the City shall use the garbage collectian system and service of the utility and collection cantractor(s)of the City. C. Placement and Removai of Garbage Cans,Recyc(ing Bins and Yard Waste Carts:Any singie-family residencs accumulating garbage,recyclables,and yard waste shail place their materials for coilectian at the curbslde no eariier ihan 24 hours prior to their callection day.Likewise. all garbage cans,recycling bins and yard waste carts musf be removed from the curbside within 24 hours of being collected and returned to a location adjacent to the residential structure or within a fuliy enclosed buiidmg or garage. d.
