SUBJECT: Temparary Status
I learned yesterday from the police department that the Civil Service Comtnission had
asked for a legal opinion from the city attorney's office regazding the interpretation and
the appiication of CiviI Service Rule 13.01. I contacted Eileen Flott to inquire regarding
the question you wanted answered.
My understanding ofthe question is: May the police department assign a current
employee to a temporary assignment, which assignment is to fill in for an individual who
will be temporarily working for SCORE (the South County Correctional Facility)for an
indefinite period? I might not have understood the question accurately from Eileen. So,
if my understanding is in error,please do not hesitate to call rne at(425)255-8678.
I have reviewed Rules 13.01 and 13.02 of the Civil Service Rules for the police
department as well as RCW49.44.160. It is my opinion that the police department�
appoint a cwrent employee to a Temporary Appointment(Rule 13.01)to fill the position
thai will be vacant while Penny Bartley goes to work for SCORE.
In my reading of the ruies,I have concluded that this is not a provisianal assigrunent.
Tliere is no emergency that e�usts,which is a condition of the applica,tion of Rule 13.02.
For earample, there is no sudden vacancy of this position that needs to be filled
immediately(there aze four(4)definitions for"emergency"in the rule)and we have no
eligibility list and we need to buy some time to go through the hiring process.
Insofar as your question relates to the duration of the Temporary Assignment, my
interpretation ofthe rule follows. Rule 13.01 provides that"[a] person may be employed
in a temporary position only for the duration of the appointment." I interpret this to mean
either oftwo things: 1)the temporary assignment ends on a date certain;OR 2)the
temporary assignment ends on the occurrence of a specific event(i.e., Penny Bartley's
return to work to the city, or her resignation from employment with the city).

As you lmow,state law has a provision that prohibits tlie use of a"ternporary"
classification(by government)as a�ans to avoid providing be�fits to the temporary
employee. (RCW49.44.160.) As the city will be assigning to the vacancy an individual
who will be covered by city benefits(a curr�t regiila,r employee),I am of the opinion
there is no violation of RCW49.44.160.

NATURE QF WORK-Under the direction of the Police Service Specialist Supervisor,record and disseminate information
within the department, to other agencies, and the public within the legal limitations of public disclosure and rights to privacy;
provide various services to the public and assure the safety of jail inmates. Work is performed in an office environment,with
shif't work and weekend work are involved. Work also involves prisoner searches.
H4URS OF WORK-The unit is staffed 24 hours, 7 days a week. Specialists work four 10-hour days,with three days off.
8hift rotation is based on seniority.
REPRESENTATIVE DUTIES —Enter and update information into the law enforcement and state/national computer
systems. Receive in-station & telephone inquiries;maintain confidential files,recards and reports; prepare reports, statements,
foxms and letters on a personal computer; disserninate criminal and civil records; process and issue Concealed Pistol Licenses
and weapon purchases; process Renton Municipal Court warrants; monitor closed circuit security system; monitor City alarm
system giving proper emergency notification; operate police radio console, teletype and access terminals; and maintain
responsibility for the care, custody and search of same sex prisoners when required. (Representative essential duties are
intended to present a descriptive range of duties perFormed by employees in this classification and may not reflect all of the
duties per€ormed on the job).
REQUIREMENTS — Any combination equivalent to: graduation from high school and two years of clerical experience,
invalving extensive contact with the general publia Applicant must be a U.S. citizen,and be able to read and write the English
language, and be at teast 18 years of age. Must be able to work nights, weekends, and holidays. A stringent personal
background investigation, polygraph examination, psychological evaluation; medicaUphysical exam, and drug screening test
will be conducted on candidates considered for hire. Must be able to qualify for the Washington State Patrol ACCESS
Certification.
5ELECTION PROCESS.—Applicants whose experience and qualifications that most elosely meet the requirments will be
invited to participate in a competitive selection process consisting of a spelling slflll test and a data entry test,each requiring a
minimum passing score of 70%. Those passing both tests will then take a typing test,used for advisory purposes. Top passing
candidates will be invited for an oral board interview weighted at 100%of the final socre,and requiring a minimum passing
score of 70%to be place on a one year eligibility list. If you are invited to participate in the selection process and need ADA
accommodation,please notify HR&RM. Healthcare provider documentation attesting to accommodarion requirernent shall be
required prior to testing.

The Renton Police Department received one new applications for consideration. This candidate was interviewed
on 1/21/09. Candidates who pass the written test proceed to the Oral Board Interview. (Ever since 11/27/07 the
Physical Fitness Agility Test-PFAT was not administered as part of the Lateral Police Officer examination
process.) The interview is weighted at 100%of the final score,with a passing score of 70%.

considered. Must pass the written test, and oral board in order to be placed on the eligibility list.

Written exam involves candidates watching a video of a response to a 911 Domestic Violence call, and writing a
report with findings. The Written exam has a pass/fail rating. The oral board consists of a set of 15 structured
questions, and the rating of five dimensions, developed far an experienced police officer. Passing score for the
70%or geater is required to be placed on the eligibility list.
