4°= Said heretofore mentioned grantee, its successors or assigns, shall
have the right, without prior notice o r proceeding at law, at such times as
�' may be necessary to enter upon said above described property for the purpose
�` of constructing, maintaining, repairing, altering or reconstructing said
µ utility, or making any connections therewith, without incurring any legal
obligations or liability the refore, provided, that such construction, main- I
taining, repairing, altering or reconstruction of such utility shall be
accomplished in such a manner that the private improvements existing in the right
right(s}-of-way shall not be disturbed or damaged, or in the eve.nt they are
disturbed or damaged, they will be replaced in as good a condition as the� we�

The North 241.90 feet of Tract 290, C. D. Hillman's Lake Washington
Garden of Eden Division #4, according to the Plat recorded in Voume 11 of Plats,
page 82, records of said County; excep t that portion thereof described as follows:
Commencing at the Northeast corner thereof as the true point of beginning;
thence South along the East line a distance of 122 feet; thence West, parallel to
�.,,' the North line thereof a distance of 120.41 feet; thence North, parallel to the East
�, line thereof a distance of 121 feet to the North line thereof; thence East, along
� said North line, to the true point of beginning: and EXCEPT that portion described
