hereinafter called "Grantor(s)" , and the CITY OF RENTON , a Municipal Corporation
of King County, Washington, hereinafter called "Grantee" .
WITNESSETH:
That said Grantor(s) , for and in consideration of the sum of $
paid by Grantee, and other valuable consideration,
do_ by these presents , grant, barga;n , seil , convey, and warrant unto the said
Grantee, its successors and assions , an easement for public utilities (including
water and sewer) with necessary appurtenances over, through, across and upon the
following described property in King County, Washinoton, more particularly
described as follows:
A utility easement 20 feet in width, 10 feet on either side of the following
described property:
That portion of the Northern one-quarter of the Northwest one-quarter of Section
5, Township 23 North, Range S East, W.M. , in King County, Washington, described as
follows :
Beginning at the intersection of the Easterly margin of Hillman's Boulevard
(104th Avenue Southeast) , as shown on the plat of Hillman' s Lake Washington Garden
of Eden Addition to the City of Seattle No. 1 , according to the plat recorded in
Volume 11 of Plats, page 63, records of King County, Washington prolongated Southerly
with. the North line of said Section 5; thence East along said North line 314 feet to
the true point of beginning; thence South at right angles to said North line to the
centerline of the stream, said centerline being the South line of a tract of land
conveyed to Walter A. Mathis and Vivian Mathis , his wife, by Deed recorded under
Auditor's File No. 4059348; thence East along said centerline to the Westerly margin
of Columbia and Puget Sound Railroad Company right-of-way; thence Northeasterly
along said Westerly margin to the North line of said Section 5; thence West to the
true point of beginning; EXCEPT the East 150 feet, as measured along the North line
of said Section 5.
The centerline of said easement being described as follows: i
Beginning at a point on the north line of Section 5, Township 23 North, Range
5 East, W.M. and the Southerly margin of North 28th Street in the City of Renton,
Washington, 205 feet Westerly of the intersection of said North Section line with `
the cente rline of Meadow Avenue North; thence South 0° 33' 45" West a dis tance of
87 feet; thence South 41 ° 27' 30" West 192.34 feet to the terminus of said easement.
Together with a temporary construction easement c�escribed as :
30 feet in width, 15 feet on either side of the above described centerline.
Said temporary construction easement shall remain in force during construction
and untii• such time as the utilities and appurtenances have been accepted for the
' operation and maintenance by the'Grantee but not later than

� tai ni ng, repai ri ng,-a1 teri ng or reconstructi on of such uti 1 i ty shal l be
�accomplished in such a manner that the private improvements existing in the right
f�— right(s)-of-way shall not be disturbed or damaged, or in the event they are
� �di s turbed or damaged, they wi 11 be repl aced in as good a condi tion as they were
immedi ately before the property was entered upon by the Grantee. ,
The Grantor shall fully use and enjoy the aforedescribed premises,
� including the right to retain the right to use the surface of said righ.t-af-way
if such use daes not interfere with installation and maintenance of the utility
line. Fiowever, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.
This easement, shall be a covenant running with the iand and shall be bind-
ing on the Grantor, his successors , heirs and assigns. Grantors covenant that �
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.
