EASEMENT
The Grantor, BURLINGTON NORTHERN INC ., a Delaware corporation
hereinafter called Railway Company, for and in consideration of
"`r Seven Hundred and No/100 Dollars ($700 .00) to it paid, and the
��-� agreements herein contained, does hereby grant to the CITY OF
�� RENTON, hereinafter called City, an easement to lay down, construct,
� reconstruct and permanently maintain an underground water line
�n through, under and along the following described premises situated
O in King County, State of Washington:

That area located on the Railway's Renton to
Maple Valley branch line beginning at Rati.lway
,_� Company Survey Station 727+90, Mile Post 13+4150
in Section 16, Township 23 North, Range 5 East,
W.M. , and ending at Railway Company Survey Station
747�-;'.��., Mile Post �.4+�S�I� in Section 21, Township
23 North, Range 5 East, W.M. , in Renton, Washington,
as shown in GREEN color on Exhibit "A" map, dated
November 14, 1972, attached hereto and by this
reference, made a part hereof .
This easement is made subject to and upon the following ex- , �
press conditions :

reserves aIl rights to use the property hereinbefore described
for any and a�.1 purposes whatsoever not inconsistent w�.�h the
easement hereby granted, including, but not limited to, th.e right
to construct, maintain, repair, renew, reconstruct, replace and
operate present tracks and future tracks, communication, signal
and electric power lines, utilities including sewer lines , water
lines, gas lines, streets, sidewalks, roadways and other types of
facilities on said �roperty when deemed necessary or expedient to
the Grantor. Rights reserved shall be so exercised as not to
, /` clamage or interfere with the �aater line as above defined. This
easement is subject to all existing i.nterests of third parties in
said property of any kind or nature whatsoever and any and all
extensions or renewals thereof .

This instrument does not grant or convey unto the City any
right or title to the surf ace of the soil along the route of said
permanent easement except for the purpose of laying down, inspect--
ing, restoring and replacing the waterline .

; The City agrees to indemnify and hold harmless the g�antor �
from any and all loss, cost, damage or expense arising out of �
work performed by the grantee or its contractor in constructing �
and maintaining said underground waterline regardless of �uY�ether
such loss , cost, damage or expense arises out of damage to, or
destruction of, the property of the Railway Company or any person,
I firm or corporation whatsoever, or out of claims for personal in-
juries or death.

The contractor shall confine his operations to the designated �
areas an�.. observe all restrictions .

The contractor shall make any necessary preliminary explorations
�„ to determine the location of any obstructions which may interfere
with the construction of the waterline .

t� '� The City agrees to provide, at its sole cost and expense adequate
O � drainage of the Railway Company's property in connection with use,
�� ' construction, and maintenance of said underground waterline, also
,` ;
� agrees to reimburse the Railway Company for any and all expense in-
curred by it by reason of any f ailure of the City to provide such
- -�� drainage .
VII
During the time that the work is in progress, the contra�r
shall make every effort to maintain the site in a neat and orderly
condition. All refuse, broken pipe, excess fill material, curbing,
etc . , sha�l be removed as soon as practicable .
VIII
The City shall, or shall require its contractor to notify Mr.
T . W. Mackenroth, Burlington Northern Inc . , Seattle, Wn. TeZephone I
624-1.900, ext . 2221, at least 24 hours in advance, whenever the
City or its contractor is ready to perform work on or adjacent to
the Railway Company`s right of way,,:� �
IX
I
In the event that this easement shall at any time cease to be
used for an underground waterline, or shall by operation of law or
otherwise become vacated or abandoned, the easement herein granted
shall immediately cease and terminate without notice or other pro-
ceedings on the part of the Railway Company and the City, its
successors or assigns, shall reconvey immediately said property to
I the Railway Company.
