TEMPORARY CONSTRUCTION EASEMENT

by and between United Way of King County and ;
hereinafter called "Grantor, " and the CITY OF RENTON, a Municipal
Corporation of King County, Washington, hereinafter called "Grantee. "

� That said Grantor, for and in consideration of the sum of
� $27 .50 paid by Grantee, and other valuable consideration, doe`s by

(� these presents, grant, bargain, sell and convey unto the said Grantee,
� its successors and assigns, a temporary construction easement for
^�cZ' use of the Grantee, its employees, agents and contractors with respect
� to constructing certain street improvements to the adjoining street,

;'�- said easement being over, through, across and upon the following
described property in King County, Washington, more particularly
described as follows:
A strip of land, of varying width over the following des-
cribed property:
- The North 390 feet of the East one-half of the Northeast
one-quarter of the Southwest one-quarter of the Northeast one-quarter
of Section 31, Township 23 North, Range 5 East, W.M. , in King County,
Washington, lying West of the Kent-Renton County Road;
EXCEPT the North 30 feet thereof and
EXCEPT the East 166 .36 feet thereof;
Situate in the County of King, State of Washington.
t� Said strip of land being described as followsa
BEGINNING at the Northwest corner of the above described
property; thence South along the West line thereof a distance of
7 .40 feet to the true point of beginning; thence Easterly a distance
of 163 .70 feet to a point on the East line of said property 12.02
feet South of the Northeast corner thereof; thence South along said
East line a distance of 7 .98 feet; thence Westerly a distance of
163 .69 feet to a point on the West line of said property 8.76 feet '
South of the true point of beginning; thence North along said West
line a distance of 8.76 feet to the true point of beginning.
Said temporary construction easement shall remain in force
during construction and until such time as the street improvement
has been accepted for operation and maintenance by the Grantee but
not later than December 3 , 1973 .

Said heretofore mentioned grantee, its successors or assigns,
shall have the right, without prior notice or proceeding at law, at
such times as may be necessary to enter upon said above strip of land
for the purpose of constructing, maintaining, repairing, altering or
' reconstructing said street improvements, or making any connections
therewith, without incurring any legal obligations or liability there-
� fore, provided, that such construction, maintaining, repairing,
altering or reconstruction of such improvements shall be accomplished
in such a manner that the private improvements existing in the right(s) -
of-way shall not be disturbed or damaged, c�r in the event they are
_ distta�bed or damaged, they will be replaced in as good a condition as
� they were immediately before the property was entered upon by the
.� Grantee. -

o The Grantor shall fully use and enjoy the aforedescribed
Qpremises, including the right to retain the right to use the surface
� of said right-of�way if such use does not interfere with construction
'�'"' of said street improvements . However, the grantor shall not erect
buildings or structures over, under or across the right-of-way during
the existence of such easement.
This easement, shall be a covenant running with the land
and shall be binding on the Grantor, his successors, heirs and assigns .
Grantors covenant that they are the lawful owners of the above
� properties and that they have a good and lawful right to execute this
