This indenture made this �day of �L/17�'- , 1974,
between PUGET SQUND PflWER & LIGHT COMPANY, a Washington corporation,
{"Grantor" herein} and the CITY 4F RENTON, a Municipal corporation
�I of King Countyj Washingtan ("Grantee" herein� :
` WITNESSETH:
That i.n con�ideratian of Ten Dollars {$10.{}0) in hand paid, receipt
of which is hereby acknawledged, and the performance by Grantee of the
cavenants hereinafter set farth, Grantor hereby grants unto Grantee,
without warranty of any kind, an easement far the construction, main-
tenance and operation af an underground 10-inch sanitary sewer iine
aver. acorss and under the fallowing described real property in King
County, Washington:

thence S 89°44 ' 24" E a distance o� 1Q4 teet more or less ta
the east line of the Puget Sound Power & Light Company Right
of Way and the terminus of said centerline.

This easemen�. is granted on the followa.ng terms and conditions:
I 1. Grantee agrees that said sanitary sewer line will be buried
at least seven (7} feet below the natural surface of the ground at
all points. '
2. Gran�ee agrees to notify Grantor 48 hours prior to beginning
of construction by calling our aperations office at AL 5-2464, exten-
sion 281, Rentan, Washington.
� 3. Said easement �hall include the right of ingress and egress
to, upon and over said land to construct, maintain, aperate, repair
and replace said sanitary sewer line, and also grants to Grantee the
use of such additional area immedia�ely adjacent to the above ease-
ment as may be necessary for the construc�.ion of said sanitary sewer
line, such additional area to be held to a minirnum necessary far that
purpose. The grant for use of additional area shall terminate upon
completian of said construction or, in any event, not later �han
December 31, 1974.
4. Grantee agrees to save and ha2d Grantor harmless fram aIl
i loss or damage which may be due to the exercise by Grantee a� the
right herein granted, and from all claims for such damage by whom-
soever made, and to indemnify Grantar for all such lass, damage and
claims.
5. Gran�.or reserves the xigh�: to use said premises �'or its own
purposes in any way. Without 2imiting �.he general.ity af the foregaing,
Grantor reserves the right at any time, and fram time to time, to con-
struct or recanstruct an electrieal transmission or distribu.tion system,
Vah¢ther AC or DC; whether noca existing or herea�ter ta be constructed,
and related structures, upon the premises. If Grantar' s use necess-
arily damages Grantee ' s facilities, Grantee shall have na claim ar
right of reirnbursement against Grantor for such damage.

6. Grantor reserves the right to grant rights in the premises to
other persons provided such rights so granted are not inconsistent with
the rights herein granted to Grantee, including without limitation the
right to grant to any other person a right of access across any part
of said premises.
7. The right hereby granted shall terminate whenever Grantee shall
have permanently abandoned the use of said facility for a period of
five years. Upon such abandonment Grantee shall remove its facility
and restore the premises to as good condition as they were in prior
to the construction of said facility.
8. Grantee agrees to replace or pay for the replacement of any �'
, survey monuments or stakes that may be dislodged or removed as
� a result of this grant, and to otherwise, so far as is reasonably
l!� practical, restore said easement area to the condition it was in prior
� o to Grantee' s exercise of its rights herein granted.

I'� 9. When, as and if the subject sanitary sewer should interfere
� with Grantor' s existing structures or facilities, or the development
r.,, of future structures or facilities on Grantor' s property, said sani-
tary sewer facility shall be relocated within said property, or
modified, at the Grantee' s sole cost, to accommodate the aforementioned
structures or facilities of Grantor.
10. When and if the Grantee, its successors or assigns, makes an
excavation in the Grantor' s property Grantee, its successors or assigns ,
shall without delay restore the surface as nearly as practicable to the
same condition as it was in before the doing of such work.
11. No assignment of the privileges and benefits accruing to the
Grantee hereunder, by operation of law or otherwise, shall be valid
without the prior written consent of the Grantor.
12. This easement is granted to the City of Renton under the
express conditions that Puget Sound Power & Light Company property
will not be included in local improvement district No. 285 involving
construction of the subject unaerground sanitary sewer line, and will �
not be assessed under such local improvement district No. 285 .
13. The rights herein granted are contingent upon the relinquish-
ment of all those rights granted to the City of Renton By Puget Sound
� Power & Light Company in that certain easement dated January 21, 1972, �
- and recorded under Auditor' s File No. 7202040357, records of King
County, Washington.
14. The rights and obligations .of the parties shall inure to the
benefit of and be binding upon their respective successors and assigns.
