in an expeditous and prompt manner so as not to unreasanably interfere
with the use o£ the surface rights aver and across the easement l�y

I� the right,,withaut priar notice ar proceeding at law, at such times .as may be
necessary to enter upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said roadw�y and utilities,
or making any connections therewith, without incurring any legal obligations or
liability therefore, provided, that such construction, maintaining, repairing,
� altering ar reconstruction of said roadway and utilities shall be accomplished. in
� such a manner that the private improvements existing in the right(s}-of=way shall
,,,�� nat be disturbed or damaged, they wi11 be replaced in as goad a condition as they
-- were immediately before the praperty was entered upan by the Grantee.
�.. The Grantor shall fully use and ertjoy the aforedescri�ed premises, including
c°— the ri ght ta retai n the ri ght to use the surface of sai d ri ght-of-way i f such use
does not. interfere with installation and maintenance of the roadway or utilities.
However, the grantor shall not erect buildings or structures aver, under or across
the right-of-way during the existence af such roadway and utilities.
This easement, sha11 be a covenant running with the land and shaii be bind-
ing on the Grantor, his successars , heirs and assigns . Grantors cavenant that they
are the lawful owners of the d�flV£ properties and that they have a good and lawful
ri ght to exe�c.u,�e-� ' agreement.
