No. 1 (Sec. State Hwy No. 2-A) . ,
This easement is further subject to the following conditions :
l. The City of Renton agrees to pay for trees , bushes and
plants in the easement area and will replace them when
the work is finished or will pay for the bushes, trees
and plants as per the attached list. The City shall
� have the right to take out or move any of said trees,
, plants or bushes .
2 . Should any damage occur to Grantors' lawn, then the City I
will repair said damage after having prepared the property
by leveling and smoothing, if necessary and haul in top soil, I
if necessary
3. City agrees to repair any damage to the fence and to replace the same if �
necessary. '
4. Any and all repa.ir work detailed i.n items 1, 2 and 3 hereinabove shall be
completed within 30 days after work on the City's utilities has been completed,
but a time extension will be granted if necess�ry, due to inc��ement weather
5• The City hereby covenants and agrees to �ive to Grantors ten days notice
in writi prior to beginning work on thzs easement.

Said heretofore mentioned grantee, its successors or assigns , shall have
the ri ght, wi thout pri or noti ce or proceedi ng at 1 aw, at such ti mes as may be
necessary to enter upon sai d above descri bed property fc,r the purpose of con-
structing, maintaining, repairing, altering or reconstructing said utility, or
making any connections therewith , and such construction, maintaining, repairing,
altering or reconstruction of such utitity shall be accomplished in such a manner
that the private improvements existing in the right right{s)-of-way shall not be
disturbed or damaged, or in the event they are disturbed or damaged, they will
� be replaced in as good a condition as they were imrrediately before the property
� was entered upon by the Grantee.

Q The Grantor shall fully use and enjoy the aforedescribed premises,
� including the right to retain the right to use the surface of said right-of-way
Q if such use does not interfere with installation and maintenance of the utility
�,i' line. However, the grantor shall not erect buildings or structures over, under
O or across the right-of-way during the existence of such utility.

t'� This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.
