All that portion of the SW 1/4 of the NE 1/4 of Section 3, Twp. 23 N. , Rng. 5 E. , W.M.
described as follows:
Beginning at a point which lies 1780.25 ft, east of the SW corner of the SE 1/4 of the
NW 1/4 of said Sec. 3, as measured along the south line thereof to the true point of
beginning; thence North 30 ft; thence west to west line of the SW 1/4 of the NE 1/4 of
said Section 3; thence South 30 ft; thence East to the true point of beginning.
Together with all that portion of said SW 1/4 of the NE 1/4 of Sec. 3 described as
follows: Beginning at the SW corner of the SE 1/4 of the NW 1/4 of said Section 3;
thence North 30 ft; thence East 1550.25 ft. to the true point of beginning; thence

Said heretofore mentioned grantee, its successors or assigns , shall have
the right, without prior notice or procee�ing at law, at such times as may be
� necessary to en�ter. upon said above described property for the purpose of canstruct-
ing, maintaining, repairing, altering �r reconstructing said roadway and utilities ,
or making any connections therewiih, without incurring any legal obligations or
liability therefore, provided, that such construction, maintaining, repairing, .
altering or reconstruction of said roadv�ay and u�ilities shall be accomplished in I
T„�, such a manner that the private improvements existing in the right(s)-of-way shall
�j not be disturbed or damaged, they will be replaced in as good a condition as they

� The Grantor shall fuily use and enjoy the aforedescribed premises , including

� However, the grantor shall not erect buildings or structures over, under or across
� the right-of-way during the existence of such roadway and utilities.

This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successors , heirs and assigns. Grantors covenant that they
are the lawful owners of the above properties and that they have a good and 7awful
right to execute this agreement.
