by these presents, grant, argain, sell , convey, and warrant unto the said Grantee,
its successors and assigns, an easement for public utilities (including water and
sewer) with necessary appurtenances over, through, across and upon the folTowing
described property in King County, Washington, more particularly described as
follows:
The north 15 feet of the east 16.5 feet of the following:
- The West 130 feet of Tract 45, C. D. Hillman' s Lake Washington Garden of Eden #1 ,
as recorded in Volume 11 of plats, page 63, records of King County Washington. Less
the east 100 feet of the South 204.5 feet thereof.
Together with a temporary construction easement described as: I

Said temporary construction easement shall remain in force during construc-
tion and until such time as the utilities and appurtenances have been accepted
for the operation and maintenance by the Grantee but not later than

have the right, without prior nctice or proceeding at law, at such times as
may be necessary to enter upon said above� described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal
obligations or liability the refore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utility sha]1 be
accomplished in such a manner that the private improvements existing in the right
� right(s)-of-�vay shall not be disturbed or damaged, or in the event they are
� disturbed or damaged, they will be replaced in as good a condition as they we re
�J- immediately before the property was entered upon by the Grantee.

� The Grantor shall fully use and enjoy the aforedescribed premises,

— including the right to re tain the right to use the surface of said right-of-way

� line. However, the grantor shall not erect buildings or structures over, under

or across the r.ight-of-way during the existence of such utility.
This easement, shall be a covenant running with the land and shall be bind-
' ing on the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
