� unto the said Grantee, its suceessors and assigns, non-exelusive permanent

` necessary appurtenanees aver, through, under, aerass and upon portion of Lots 4

`� the plat thereof recorded in Vol. 108 of Plats, Pages 12 and 13, in King County,

�'. Easement No. 1: The east 10 feet of the west 20 feet of Lots 4 and 9, parallel
T� to existing utility e�sement reserved in the plat in the west 10 feet thereof,

Easernent No. 3: The east 60 feet af the west 80 feet of the narth 15 feet of
the south 47 feet of Lot 9.
Easement Na. 4: The east 60 feet af the west 80 feet of the sauth I5 feet of
the nortn 448 feet of Lot 4.,
and the approximate locatian of whieh is set forth on the attached map marked
Exhibit A and by this referenee made � part hereof as thaugh set forth herein in
full.
And said Grantor does further grant, bargain, sell, convey and warrant unta
the said Grantee a temparary construetion easement to be used by Grantee for the
sale {3L1P.�tdS�S af installing and constructing the publie utilities in the abave-
deseritied permanent easements and which temporary construetion easements are
described�as fallowss I
An.�•>aclditional 20 feet on each side of the above-described permanent
easemerit, but lying entirely on the aforesaid Lots 4 and 9, Block 1, Burlington �
Northern Orillia lndustrial Park of Renton.

Said temporary construetion easeznent shall remain in faree during
construetion and until such time as the roadway, utilities and �ppurtenances have
been aeeepted for the operation d maintenanee by the Grantee, but not later
than the _��_day af�"Za.,G�.�•��--�.�'�, 1979.
S�.id heretofore-mentioned Grantee, its successors or assigns, shall have the
right, without prior notice or proceeding at law, at such times as may be necessary �
I to enter upon said abave-deseribed property for the purpose of construction,
maintaining, repairing, altering ar recanstructing sa.id roa8way and utilities, or ;
making any connections therewith, without incurring any legal obligations or I
liability therefar, provided that sueh construetion, maintaining, repairing, altering
or construction of said raadway and utilities shall be accornplished in such rnanner
that the private irnprovements existing in the �bove-described permanent
easements shall not be disturbed or damaged and will be replaced and restored in as
gaod a canditian as they were immedi�tely before the property was entered upon by
I t�e Grantee.
The Grantor retains the right to fully use and enjoy the surface of the above-
described permanent easements provided Grantor shall not ereet buildings or
permanent structures within the permanent easement areas nor use Yhe same in
, such manner as to interfere with the installation, repair and maintenance of the
utilities installed therein.

This easement shall be a covenant running with the land and shall be binding
on the Grantor, its successors, heirs and assigns. Grantors covenant that they are
the lawful owners of the above-described properties and that they have a good and
lawful right to execute this agreement.
I Grantee shall indemnify, defend and save Grantor harmless from and against
any and all claims, demands, loss, damage, expense and liability of every kind and
description and for any damage to or loss or destruction of property whatsoever
suffered by Grantor, its heirs, successors and assigns, or by the person or property
of any third parties by re�son of the construction and/or maintenance of said
utilities in the above-described easeznents.
