Said heretofore mentioned grantee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon sai d above descri bed property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
uti 1 i ty, or maki ng any connecti ons therewi th, wi thout i ncurri ng any 1 egal
�bligations or liability therefore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utitity shall be
accomplished in such a manner that the private improvements existing in the right
right(s)-of-way shall not be disturbed _ or damaged, or in the event they are
dis turbed or damaged, they will be replaced in as good a condition as they we re
immediately before the property was entered upon by the Grantee.
� -�p The Grantor shall fully use and enjoy the �afvredescribed premises,
� including the right to re tain the right to use the surface of said right-of-way
if such use does not interfe re with installation and maintenance of the utility
'� line. However, the grantor shall not erect buildings or structures over, under
; �� or across the right-of-w�y during the existence of such utility.
� This easement, shall be a covena�nt running with the land and shall be bind-
s`'� ing on the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.
