Said heretofore mentioned grantee, its successors or assigns , shall
have the right, without prior notice or proceeding at law, at such tirr�e� as
may be necessary to enter upon said above described proper�y for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal
obl i gations or 1 i abi 1 i ty therefore, provi ded, that such constructi on, main-
taining, repai ri ng, al tering or reconstructi on of such util i ty shall be
accomplished in such a manner that the pr4vate improver�nts existing in the right
right(s)-of-way shall not be disturbed or damaged, or in the event they are
disturbed or damaged, they will be repiaced in as good a condition as they were
� immediat;ely before the property was entered upon by the Grantee.

oThe Grantor shali fully use and enjoy the afored�scribed premi�es ,
� including the right to retain the right to use the surface of said right-of-way
p if such use does not interfere with instailation and maintenance of the utility
� line. However, the grantar shall not erect buildings or structures over, under
°O or across th2 �right-of-w�y during the existence of such utility.
This easement, shall b� a covenant running with the land and shall be t,ind=
i ng on the Grantor, hi s successors , hei rs and assi gns. Grantors coveriant that
they are the l�wful owners of the abave propert�es and that they have a good and
1 awful ri ght to execute thi s agreerr�nt.
