� � Drainage District Number One of King County, Washington, a municipal corporation
�' existing under the laws of the State of Washington, hereinafter called Grantor, in
. consideration of One Dollar ($1 .00) , and the terms coritained herein, grants unto the
� City of Renton, a municipal corporation existing under the laws of the State of Wash-
��' ington, hereinafter called Grantee, easements as herein limited as follows:
"� 1 . Grantor grants to Grantee an easement for the construction, maintenance and oper-
ation of a public street over and across the following described real property in King
; County, situated in the NE 1/4 of Section 25, Township 23 North, Range 4 East, W.M. ,
- and NW 1/4 of Section 30, Township 23 North, Range 5 East, W.M. ; a strip of land across
+ the 40 foot right-of-way of Springbrook Creek, said strip being 40 feet wide and lying
-� 20 feet either side of the north-south cor�mon section line between Section 30, T 23 N,
�' R 5 E, and Section 25, T 23 N, R 4 E, W.M. , and the northerly and southerly boundaries
of said easement being the northerly and southerly margins, respectively of SW 27th
Street right-of-way as extended said right-of-way being 90 feet in width as platted in
the plat of Burlington Northern Industrial Park of Renton, Division No. 2 as recorded
in Volume 111 of Plats, pages 42-44, records of King County, Washington.
Grantee will install , and from time to time and all times hereafter, will repair,
maintain and clean two (2) 10 ft. 3 inch by 6 ft. 11 inch arch culverts within said
�7 easement for the purpose of allowing and maintaining the flow of drainage water.

0 2. Grantor grants to Grantee an easement for the construction, maintenance and oper-

� the following described real property in King County, situated in the NW 1/4 of Section
� 30, Township 23 North, Range 5 East, and the NE 1/4 of Section 25, Township 23 North,
� — Range 4 East, W.M. ; a 20 foot strip of land lying across the 40 foot right-of-way of

line of N 88 24'47" W of SW 30th Street of the plat of Burlington Northern Industrial
Park of Renton, Division No. 2 as recorded in Volume 111 of plats, pages 42-44, records
of King County, Washington.
3. Grantor grants to Grantee an easement for the construction, maintenance and oper-
ation of a public street over and across the following described real property in King
. County, situated in the SW 1/4 of Section 30, Township 23 North, Range 5 East and the
SE 1/4 of Section 25, Township 23 North, Range 4 East, uJ.M. , an 80 foot wide strip of
land across the 40 ft. right-of-way of Springbrook Creek, the northerly and southerly
boundaries of said easement being the northerly and southerly margins, respectively,
of SW 34th Street right-of-way as extended, said right-of-way being 80 ft. in width as
platted in the plat of Burlington Northern Industrial Park of Renton, Division No. 2,
as recorded in Volume 111 of plats, pages 42-44, records of King County, Washington.
Grantee will install , and from time to time and at all times hereafter, will repair,
maintain and clean two 10 ft. 8 inch by 6 ft. 11 inch arch culverts within said easement
for the purpose of allowing and maintaining the flow of drainage water.
Said easement is also granted for the construction, maintenance and operation of a
12 inch ductile iron water main (Pipe Thickness Class 52) and an 8 inch sanitary sewer
-- PVC Pipe SDR 35 , over and across the top of said installed culvert.
4. Grantor grants to Grantee an easement for the construction, maintenance and
operation of an 8 inch DI sanitary sewer pipe (Pipe Thickness Class 52) under and across
the following described real property in King County, situated in the SE 1/4 of Section
25, Towr�ship 23 North, Range 4 East, W.M. ; a 20 foot strip of land across the 40 ft.
right-of-way of Springbrook Creek, said 20 ft. strip of land lying 10 feet either side of
the centerline which i� the extension of the centerline of the 20 ft. pedestrian access
easement extended N 42 36'37" W from the westerly line of SW 39th Street of the plat of
Burlington Northern Industrial Park of Renton, Division No. 2, as recorded in Volume 111
of plats, pages 42-44 records of King County, Washington.

This grant is made on the following terms:
1 . Grantee will from time to time and at all times hereafter, install , repair,
maintain and clean any culverts or other provisions for the flow of drainage water
which are herein specified or which may be hereafter required by Grantor in its discre-
tion.
2. Grantee shall operate, exercise and mai�.ntain the foregoing easements in a manner
which will in no way hinder or prevent the proper and reasonable use of said real prop-
erty by Grantor as part of a continuous drainage syster�.
3. Grantor retains the right to use said easements for maintenance of its drainage
. system or other purpose so long as said use does not interfere with the purpose for
which the easements are granted.
� 4. All wor,k required by Grantee by the terms hereof shall be done in a timely, proper,
Qsubstantial and workmanlike manner, and shall be done at the cost and expense of the
� Grantee.

�" 5. All installations by Grantee of any pipes, mains, lines or other objects or
� obstructions of any nature whatsoever shall be at an elevation of 2.50 based upon City
Cp of Renton datum and below, and exceptions to such depth shall only be allowed with the
specific written approval of the G�rantor.
6. Grantee will release, indemnify and hold harmless Grantor from all claims or
actions arising from the use of, or installation pursuant to, this easement by Grantee.
7. The Grantee shall have the right at times as may be necessary to enter upon said
property for the purposes of repairing and maintaining any pipes, mains and culverts
installed pursuant to these easements, provided that such repairs and maintenance shall
be accomplished in such a manner that any private or public improvements existing in said
easement, including any ditch or ditches of the Grantor, shall not be disturbed or dest-
royed. ,
This easernent is for the benefit of, and appurtenan� to, the property of the Grantee
adjoining said easement, and shall inure to the benefit of, and be binding upon, the
successors and ass'igns of the Grantee and the Grantor.
IN WITNESS WHEREOF, the parties have hereto executed this agreement in duplicate
