meeting of the Board of Adjustment to order.
Steve Maxwell, Mark Rigos, Jay Wallace, Wayne Jones, Ralph Evans. Motion
made, seconded and approved to excuse Boardmembers Feigner & Jacques.
Kristina Catlin, Associate Planner; Jennifer Henning, Principal Planner; Patrick
Roduin, Recording Secretary
Motion made and passed to approve the Minutes of October 22, 2003 as
submitted.
This being the date set and proper notices having been posted and published in

Project Description: The applicant is requesting a variance from Section 4-4-100E.3 of the Renton
MuniCipal Code to allow a 48-foot tall sign where 40 feet is the maximum sign
height allowed. The applicant has stated that the sign is required by Toyota USA
as part of a new signage and image program. The proposed sign would replace
the existing 32-foot tall sign.
In order to receive a variance they need to show that they meet all four of the decision criteria.

VARIANCE CRITERIA
City of Renton Development Regulations Section 4-9-250.B.5. -The Board of Adjustment shall have
authority to grant a variance upon making a determination, in writing, that the conditions specified below
have been found to exist:
1. That the applicant suffers undue hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape, topography,
location or surroundings of the subject property, and the strict application of the Zoning
Code is found to deprive subject property owner of rights and privileges enjoyed by other
property owners in the vicinity and under identical zone classification:
The applicant feels that the location of the existing facility qualifies as an undue hardship. The
location of the dealership places it at a disadvantage when compared with other auto facilities
visible from Rainier Avenue and Grady Way. According to surveys conducted by the Toyota
factory, consumers often purchase from other Toyota dealerships because they do not know that
there is a Toyota store in Renton. The applicant believes that the proposed 48-foot tall sign with
the Toyota logo prominently displayed at the top would be seen by most northbound Rainier
Avenue drivers and attract consumers that might otherwise be unaware that there is a Toyota
dealership in Renton.
Staff concurs with the applicant that the location of the Toyota dealership places it at a
disadvantage to dealerships located along the primary Automall arterials of Rainier Avenue and
Grady Way. The location of the dealership does not provide the same visibility for signage that
other auto dealers in the area enjoy. Approval of a variance from the Renton Municipal Code to
allow a 48-foot tall sign where 40-feet is the maximum height permitted would help the advertising
for the Toyota dealership to be visually competitive with the signs of other dealerships in closer
proximity to Rainier Avenue and Grady Way.
2. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which subject
property is situated:
The sign is proposed to be located in the southeast portion of the site. The granting of the
variance would not be materially detrimental to the public welfare. The sign is proposed on a
parcel that is located in a commercial zone within the Automall Improvement District. The area is
specifically designated for auto-sales and related activities. The permitted building height on the
site is 50-feet. The proposed sign is shorter than the maximum building height established for the
zone. The northern property line of the subject site is adjacent to residentially zoned property.
The subject sign is proposed to be located in the southeast comer of the site, thereby maximizing
the distance from the nearby residential properties. Due to the proposed location of the sign, the
commercial nature of the surrounding area, and the permitted building height of the CA zone,
granting of the requested variance for increased sign height is not antiCipated to have a
detrimental impact on any surrounding properties.
3. That approval shall not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated:
The approval of the requested variance would not constitute a grant of special privilege
inconsistent with the limitation upon the uses of other properties in the vicinity. Many of the other
properties in the vicinity are used for auto sales. The majority of those properties enjoy the
benefit of signs that are visible from Rainier Avenue South, which is a main travel route used by
driver entering Renton from Highway 167. The Bob Bridge Toyota dealership is located one
block west of Rainier Avenue South. The granting of the requested variance would allow Bob
Bridge to install a sign that would make his dealership visible from Rainier Avenue South.

4. That the approval as determined by the Board of Adjustment is a minimum variance that
will accomplish the desired purpose:
The applicant has indicated that the proposed sign is the first step of the Toyota factory's new
dealership image program, which will include an interior and exterior remodel of the showroom.
The proposed 48-foot tall sign is the minimum height needed to increase the visibility of the sign
from surrounding streets and improve the visual competitiveness of the dealership among the
many auto dealers in the surrounding area.
This concludes the staff comments, unless there are any questions.

Bob Bridge: Just a couple things to add. The sign is a sign that has just been introduced in the last
couple of months by Toyota Motor U.S.A. and will be installed at all twelve hundred
dealerships throughout the United States, where the city would allow it. There are some
that wouldn't, perhaps. Because in many cities they haven't had the foresight that this
city has to create an auto-zone. So the dealerships are kind-of scattered hither-dither
around the city so it makes it hard to have any type of continuity. Where the hardship
comes in is that people own automobiles for about five years -five-year cycles. And in
that five-year period, if every five years you shop for a car you really don't focus on, or
care really, except for maybe getting your maintenance done, where particular
dealerships are or if they've moved or something of this nature. Whereas a restaurant,
right across the street at Billy McHale's, a really good restaurant, a person may go there
two or three times a month, month in month out. And it first dawned on me, the hardship
it was causing, when I was standing by my switchboard operator, and inside of five
minutes she had three or four calls, and I could tell they were asking "where exactly are
you located", they were calling and wanted to come down, and she was describing it
and they weren't getting it. She said, 'Well, you know where Billy McHale's is?" "Oh
yes." And so with that they were able to say "Oh yeah, now I remember it's right across
the street." And so, I asked well how does this go on, and she said "Oh yeah, I get that
kind of call and have that kind of response very often." So, having a sign that is the
manufacturer'S sign, they spend tens of millions of dollars with designers and engineers
designing this stuff. The key to the sign for me is, whoever designed it was really smart,
it's only the top three or four pieces: the Toyota logo, the word Toyota, that little wave-
looking thing, and underneath that wave-thing is an all-new line of automobiles that I will
introduce to this area, made by Toyota, on the second week of June. They're called
Scion. And they're basically going to be a series of five vehicles that are situated or
conceived for twenty-one to thirty-eight year olds, youth-oriented, and with prices from
twelve to sixteen thousand dollars. And you'll see those, they're really quite interesting.
So, the key to me is the fifty-one to fifty-two thousand people, I understand, that head
up Rainier Avenue as they come off 1-405, when they come off there's one point on
Rainier as you head North you can kind-of get a view-corridor down Hardie. And also
even when they're at the light at Grady Way heading north, the fact that they put the
Toyota logo at the top is the key thing I need, because when people see that it's a very
recognizable logo, and they see that on an ongoing basis, driving to work, and going
and using this road on a frequent basis. That will pinpOint for them precisely where the
Toyota dealership is, whereas my current sign, you can't -if you're looking for it, it's
hard to see, or almost impossible. So, I'm proud to have my business in Renton; been

here for twenty years and have a hundred wonderful employees most of which have
been with me the entire twenty, and many live right here in Renton. So, I'm hopeful that
you'll approve this, and thank you for coming in tonight.
Chair. Wallace: Thank you very much. It looks like we don't have anyone to speak in opposition, which
is always a good thing to keep on the record. In which case, I'd like to have an
opportunity for the Board to ask questions.
Mark Rigos:
Bob Bridge:
Yeah, I have two questions for the applicant. Regarding Variance Criteria number two:
There are residential properties to the northwest; will this sign that's sixteen feet taller
affect any views of those residential properties?
I'm not sure I could answer that. When you go from the front of my property to the back,
there is a huge railroad -what do you call it?
Chair. Wallace: Trestle almost. ..
Bob Bridge: Well the trestle's there but around, if you go West up ih past my place. You can walk
right out the back of those businesses, right onto the railroad tracks. It's directly level.
But, right there as you get to my property and head to the trestle that actually goes
across the road Hardie, that barrier is easily thirty-five feet high, and one of the units of
the apartment-house is behind that, so if anybody could see it... When I'm on my lot
back there, I don't see windows. I see the roof; I don't see windows. So, if there is any
impact I would anticipate it to be very minimal at all. And plus again, the only thing that's
illuminated on this sign are those elements, nothing else. There's nothing outside of
those elements on that sign that's illuminated.
Mark Rigos: Then a second question regarding variance criteria number four: Have you considered
a second sign in either the southwest corner or northeast corner of the property, or is
this the best possible place for the view corridor?
Bob Bridge: This view corridor for Hardie is the only shot that you have for the people, what my
anticipation is, and my architect, is as they come through that light at Grady heading
North if we can just have it so it's in their line of sight without them taking their eyes off
the road, this is the only corner that would accomplish that.
Mark Rigos: Thanks.
Chair. Wallace: I have a question for you too, as long as you're up there, Mr. Bridge. Somewhat in
regard to Mark's question. As a requirement of the application, you have to notify
neighbors in a, what is it, three hundred foot circle from around your site? It looks like
that would have picked up some of the housing that's nearby, and folks would have had
timely notification to come down and complain about that sign if they felt like it was
going to block their view, and I just don't see any of them here, so. Just for the record, I
wanted to note that.
Bob Bridge:
But also, was there ever any question about the area of the sign, because given the
unique design of the sign it is kind-of hard to tell what's sign and what's normally pole I
guess. And I understand the top three modules really represent the sign element
formally, but...
Not, it's not the modules, see if you take the top module that's curved that has the
Toyota logo on it, when this sign illuminates, only the actual logo, not anything behind it
illuminates. Just the logo, and then just that little curved piece in the sign. Just those

four elements, what you see is the sign where those elements are sitting does not
illuminate.
Chair. Wallace: Right. I'm just saying that kind-of the monolithic nature of the sign is somewhat unique,
where a pole sign ...
Bob Bridge: I can explain that. What they're doing is, I'll submit to the building department, here in
about June, where basically I'll be, when you drive up 7th to my dealership you see two
sides of the showroom, you don't see the other two sides from anywhere. I'll basically
be tearing those two sides off and, if you imagine taking that sign and making it wider
and much shorter, maybe twenty feet high, twenty-five feet, having those same
elements at the top and right in the middle is the front door. That will be the centerpiece
of the new remodel so as you turn down th coming toward my dealership, as you'll see
the sign with it's elements and then you'll see that exact kind of visual as the front
centerpiece of the entryway into the showroom. With complete new outside on those
two sides, and a completely new inside. They're requiring we gut the inside and redo it
completely with a much more up-to-date envelope so to speak. It'll be probably just
short of a million dollar improvement. And again, what they do, as I know you folks
know, is they have the notion that they want all twelve hundred stores in the nation to
look the same, so that there is some continuity or synergy to the brand, much like if
you're in a brand-new city and you see the McDonald's sign you know pretty-much what
you're going to get and what it's going to cost you and so on, so this is their -every ten
years, Toyota has a very conscientious corporate identity program, and the dealers for
Toyota are the most aggressive in dping it for the factory and not fighting it, because
you could say "no I'm not doing it" but the reason we do is because it's such a fabulous
brand and Toyota's such a fabulous partner to us, so you're ... the other thing that's
good in this timing right now in fact some of us dealers who've been long-term dealers
encouraged the executives down in LA to do it now, because interest-rates are at forty-
six year lows, so the monthly payment to lock in financing for a million dollar
improvement is most efficient at this time.
Chair. Wallace: Thank you. The highlighting that we're seeing is just that, right? It's really a white sign;
it's not yellow.
Bob Bridge: Yes, it's a white sign.
Chair. Wallace: Were there any other questions for the applicant?
Ralph Evans: Not for the applicant. I have a question for Kristina. If my memory serves me correctly,
there's a Dodge dealership across the street -across Hardie Avenue there. I wonder if
you know offhand the height of their sign?
Kristina Catlin: I don't know the height of their sign.
Ralph Evans: If this Variance is granted, tonight, and the Dodge dealer's sign is shorter, lower,
whatever you want to call it. I imagine that the city would be pretty well obligated to
allow them to put up a forty-eight foot high sign as well. Would that make sense?
Kristina Catlin: They would have to show that they had a hardship. The same as the Variance before
you tonight, needs to prove that they have a hardship the same would hold true with our
codes as they exist today. They would need a Variance from this Board in order to do
so.
Ralph Evans: And, precedence would come into account there, I would imagine.

Kristina Catlin: I think that that's fair.
Ralph Evans: Mr. Bridge, you have a question?
Bob Bridge: No, just a comment. I have a thirty-two foot sign right now. And the Dodge sign is
substantially higher than mine. I don't know the exact height but it's substantially higher
than thirty-two feet I wouldn't be surprised if it was ...
Ralph Evans: Oh. They would be allowed to be forty, and you're wanting to go eight feet higher than
that, so that was the reason for my question. That's all then. Thank you Kristina.
Chair. Wallace: So, Kristina, I had a question for you. I was trying to get at the area of the sign and as I
was saying, given the somewhat monolithic nature of the support structure as opposed
to the sign age and graphics part, they don't necessarily -it's hard to say where the sign
stops and where it starts. If you start from the top going down, if you look at the old
sign, it's a pole sign and it's very clear that the area of the sign is the part that's
supported by the pole, and then the pole is the pole. But in this sign, it's hard to tell
what's sign and what is pole. Have you guys done any studying for that? This looks
more like the kind of signage that we see in a monument sign than a pole sign.
Kristina Catlin: We would take into account the area that's illuminated, so likely the easiest way for us
to calculate that would be to draw a box around that copy area.
Chair. Wallace: Is that the same considerations we give to a monument sign?
Kristina Catlin: Yeah, that's our practice for evaluating those signs. Another example I can think of for
that would be, because measuring sign, which part is the sign and which part is
architecture feature can be tricky. I'm thinking when we have awning signs measure
around the area of the copy.
Chair. Wallace: Okay. Thank you. If there are no other questions, then I'd like to close the public
hearing portion and go to our private Board discussion of the matter.
DECISION
Motion made by Board Member Steve Maxwell to grant the variance with the condition that the sign runs
with the dealership and not with the land. Board Member Ralph Evans seconded the motion.
Based on the hardship suffered by the applicant, the variance is hereby approved from the City of Renton
Development Regulations, SectiQn4-4-100E.3, to allow a freestanding sign exceeding the 40-foot height
limitation in the Commercial Arterial zone, subject to the following condition:
1. The variance shall apply to the site for as long as the site remains an auto dealership. If the use
of the site is altered in the future to a use other than auto sales, this variance shall no longer
apply to the property and the applicable sign regulations of the underlying zone shall prevail.

Chair. Wallace announced that the variance is hereby granted, to approve the motion, which stated that
we would accept the application along with the condition of it being required to be removed should it no
longer be an auto dealer.
An appeal of the Board of Adjustment decision is governed by Title IV, Chapter 8, Section 110.G., which
requires that such appeal be filed with the Superior Court of Washington for King County within 21 days
from the date of issuance of the decision. The land use decision is considered issued three (3) days after
the City mails a written decision. The appeal period for this variance will end at 5:00 PM on April 19,
2004.

FINDINGS OF FACT, CONCLUSIONS AND DECISION
FINDINGS OF FACT:
1. The applicant, Bob Bridge of Bob Bridge Toyota, is requesting approval of a variance from
Section 4-4-100E.3 of the Renton Municipal Code in order to allow a sign in excess of the 40-
foot height limit.
2. The site is located at 150 SW yth Street in Renton, approximately 450 feet from Rainier
Avenue South.
3. The proposal is to allow a 48-foot tall freestanding sign to replace the existing 32-fooot tall
sign.
4. The subject site is located in the Commercial Arterial (CA) zoning designation and the
Employment Area Valley (EAV) Comprehensive Plan land use designation.
5. The subject site is located in the Automall Improvement District Area B.
6. The subject property is developed with an auto dealership and associated office buildings.
7. Sign height is limited to 40 feet in Commercial Arterial zone.
CONCLUSIONS:
FROM THESE FINDINGS OF FACT, THE BOARD MAKES THE FOLLOWING CONCLUSIONS:
Development Regulations Section 4-9-250.B.5. -The Board of Adjustment shaH have authority to
grant a variance upon making a determination, in writing, that the conditions specified below have
been found to exist:
1) That the applicant suffers undue hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape,
topography, location or surroundings of the subject property, and the strict application
of the Zoning Code is found to deprive subject property owner of rights and privileges
enjoyed by other property owners in the vicinity and under identical zone classification:
The location of the dealership does not provide the same visibility for signage that
other auto dealers in the area enjoy. Approval of a variance from the Renton
Municipal Code to allow a 48-foot tall sign where 40-feet is the maximum height
permitted would help the advertising for the Toyota dealership to be visually
competitive with the signs of other dealerships in closer proximity to Rainier Avenue
and Grady Way and compensate for the undue hardship that t he applicant suffers
due to the location of the dealership.
2) That the granting of the variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in the vicinity and zone in which subject
property is situated:
The sign is proposed on a parcel that is located in a commercial zone within the
Automall Improvement District, an area specifically designated for auto-sales and
related activities. The proposed sign is shorter than the maximum building height
established for the zone. The subject sign is proposed to be located in the southeast
corner of the site, thereby maximizing the distance from the nearby residential
properties. Due to the proposed location of the sign, the commercial nature of the
surrounding area, and the permitted building height of the CA zone, granting of the
requested variance for increased sign height is not anticipated to have a detrimental
impact on the public welfare or any surrounding properties.
3) That approval shall not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated:
The majority of the auto dealerships in the area enjoy the benefit of signs that are
visible from Rainier Avenue South, which is a main travel route used by driver
entering Renton from Highway 167. Dealerships located off the main travel route
benefit from taller signs that increase visibility from the main travel routes. Other
properties with a demonstrated topographical hardship would likely receive staff
support for a sign height variance.
4) That the approval as determined by the Board of Adjustment is a minimum variance
that will accomplish the desired purpose:
The proposed 48-foot tall sign is the minimum height needed to increase the visibility
of the sign from surrounding streets and improve the visual competitiveness of the
dealership among the many auto dealers in the surrounding area.
DECISION:
FROM THE FOREGOING FINDINGS OF FACT AND CONCLUSIONS, THE BOARD ENTERS THE
FOLLOWING DECISION:
Based on the hardship suffered by the applicant, the variance is hereby approved from the City of
Renton Development Regulations, Section4-4-100E.3, to allow a freestanding sign exceeding the 40-
foot height limitation in the Commercial Arterial zone, subject to the following condition:
1. The variance shall apply to the site for as long as the site remains an auto dealership.
If the use of the site is altered in the future to a use other than auto sales, this
variance shall no longer apply to the property and the applicable sign regulations of
the underlying zone shall prevail.

An appeal of the Board 0 f A djustment decision is governed by Title IV, Chapter 8, Section
110.G., which requires that such appeal be filed with the Superior Court of Washington for King
County within 21 days from the date of issuance of the decision. The land use decision is

Project Description:
The project is just north of SW 3rd Street off of Earlington Ave SW. There is an existing home on the
property located on the west side of the property. The driveway is existing and appears to have a
grade of approximately 20 percent in the highest portion and comes out to be about 19.7 percent
grade. The applicant h as applied f or and received preliminary approval f or a short plat. T he G .
Taylor Short Plat. It was approved under the City of Renton file number LUA03-080. It is a two lot
short plat allowing for another lot in front of the existing house on the eastern portion of the site. In
order to approve that short plat, it was required as a condition of the approval that the applicant either
brings the driveway into compliance with City code or receive a variance showing hardship. So they
are seeking a variance from the Board of Adjustment.
In order to receive a variance they need to show that they meet all four of the decision criteria.
VARIANCE CRITERIA
City of Renton Development Regulations Section 4-9-25085 -The Board of Adjustment
shall have authority to grant a variance upon making a determination, in writing, that the
conditions specified below have been found to exist
1. That the applicant suffers undue hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape, topography,
location or surroundings of the subject property, and the strict application of the Zoning
Code is found to deprive subject property owner of rights a nd privileges enjoyed by
other property owners in the vicinity and under identical zone classification:
The applicant in this case is the Abbey Road Group; they are representing the owners, Greg and
Sandra Taylor. They showed, as the justification for their variance is that they intend to bring the
driveway into compliance with code. They would just like to do that at the building permit stage of the
process. In order for a building permit to be approved the short plat needs to be recorded. We need
to have a separate legal lot before we can approve a building permit. And so we are in this middle
ground here where there are conditions of approval associated with the short plat that need to be met
before it can be recorded. And before they move to the building permit they need to have a recorded
short plat. They would like to postpone these improvements.
The topography information provided by the applicant is shown here on some larger drawings. This
is a driveway profile to give us a sense of change in topography from one property line to the other.
This is the eastern property line and this is the west property line. There is a change of
approximately 10 vertical feet over the course of the property. The property line is approximately 120
feet long. If we were to just run a slope from one end to the other, we can come up with a driveway
that is less than 1 0 percent grade using t he vertical change over the horizontal distance. In this
drawing we can see that this portion is steep and does exceed the 15 percent allowed by the code.
Because the applicant has indicated that they do wish to bring this into compliance -0 nly at the
building permit stage. They have not shown us a hardship. And we do not have any grounds to say
that there is an undue hardship upon this property. It appears to us to be more of a timing issue.
There is a process for them to pursue, namely a deferral from the Board of Public Works. That
would allow them to ask the Board of Public Works if they could postpone the required improvements
until after the recording of the short plat. Based on this information of the topographic change from
the east to the west property line and the indication of the applicant that they do intend to bring the
driveway into compliance, staff does not find a hardship. Staff recommends that this variance not be
approved based on these criteria, but instead encourages the applicant to apply for a deferral.

2. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property .or improvements in the vicinity and zone in which subject
property is situated:
Lot two of the G. Taylor.Short Plat, which is the new lot that is proposed, is the front lot on the eastern
side of the property. The yellow shows the proposed/accepted building envelope allowed on the new
property. Lot two is approximately 10 feet above Earlington Ave SW. There is a steep drop along
the northern portion of the property line where the driveway cuts in. There are some limitations, such
as t he s lope a nd that portion 0 f the side is vegetated 0 n that slope. That would prohibit the fire
department and other emergency vehicles from accessing this proposed building envelope from the
public right of way. The fire department does not support this variance request and they do indicate
that it is imperative, that they be able to access the project. They concur with the development
standards of maximum steep slopes of 15 percent. This slope runs along the north side of the
eastern property line.
3. That approval shall not constitute a grant of special privilege inconsistent w.ith the
limitation upon uses of other properties in the vicinity and zone in which the subject
property is situated:
The third criteria that the approval is that it should not constitute a granted special privilege,
inconsistent with use of properties within the vicinity of the zone in which the property is located. We
are here in the R-8 zone. Driveway grades are done by use. Residential driveways all have the
same grade requirements. It does not necessarily apply to the ~one, but rather to the residential use.
All residential driveways are required to meet the same design standards. Approval of this variance,
in the absence of a hardship being shown, would constitute a grant of special privilege.
4. That the approval as determined by the Board of Adjustment is a minimum variance that
will accomplish the desired purpose:
The fourth criteria in this case is that the approval as determined by the Board of Adjustment is
the minimum variance that would accomplish the desired purpose. In this case the applicant
wishes to keep the existing driveway for the time being. We ran some calculations and were
finding that 20% is the minimum that they would need to ask for, allowing for some middle room
of a bout 3 tenths 0 fa percentage for calculation error. I got this off of the driveway profile,
provide by the applicant, and we are just under 20%. So we agree that 20% is the minimum
driveway grade variance that would accomplish their desired purpose.
Staff is recommending denial of this variance based on the lack of proven hardship. And we do recommend
that the applicant pursue another option, namely a deferral from the Board of Public Works. And this
concludes the staff report. Are there any other questions?

Mr. Hulsmann: Good evening. Thank you for your time this evening. It doesn't look like a lot of
people are here. I know that it is more difficult to show up on evenings. My name is Gil Hulsmann,
and I am the director of land development services for the Abbey Road Group, representing the
Taylor Short Plat this evening. First of all I want to thank staff for their support. We are at the end
process 0 n a short plat that we started with our preapplication meeting. We have already gone
through a Public Works committee in regards to sidewalks. We have already gone through a
. variance in regards to the existing building setbacks. We have already discussed, with staff,
regarding the 12 foot driveway. The reason that we are here this evening is for condition number 11.

driveway grade in excess of 15 % or alter the driveway to comply with the Renton municipal code
driveway standards prior to the short plat recording. I have a document here, if you would like to
basically see, and it does show. Number one there are a couple of aerial photos. You can get an
aerial view of the ground and get a better feel for the driveway itself. Then we also have done a
complete survey of the sight. And we have had it analyzed out and our drawings are just a little bit
different. Basically the bottom part of the road, which we are bringing up here has a 17% slope
coming from the property line up to this high point. Then it is approximately another 10% slope from
this high point. Then as you can see it kind of levels out. If we were to go ahead and pull out
basically the hump of the road which has the existing water and sewer lines for the existing building
on site, we could bring that down to 13.4% which would bring it under the 15%. The reason that we
are here again tonight is the condition that was set forth in the city that basically told us that if we
needed this variance, basically to come in front of your Board. Our hardship on this individual and
his client is that he is trying to create two individual lots. As most of us know, and I know that a lot of
you are builders or engineers is that if he pulls a construction loan for his construction of his road,
his utilities, the grading, and his building permit for this individual item. Where we are at right now is
that he cannot get the legal lot status to submit the building permit with the grading permits because
of a couple of the conditions that are attached to the individual short plat itself. This evening, the
staff has brought up the option of a deferral. The deferral portion came up after we had submitted
our variance to you. And staff has, inmy discussion with them, especially this evening, they say that
they are willing to support a deferral. The hardship on this is that we have existing utilities to another
home that is on that road. To bring the road down would require a grading permit, a utility permit
and relocating utilities. And then we would have to come back in after this was all done and we
record our short plat. We would have to come back in to the City for another grading permit, another
utility permit and then go ahead and lay the utilities in for the new building. Tearing up the asphalt in
the road that we would need for the new building. When this was first discussed, the deferral
process did not come up. And so the only thing that was there was basically the variance process.
So again, looking at the hardship for the individual is that they would have to go in for two separate
grading permits, one for the building permit and one for the preliminary conditions. They would have
to remove the existing utilities at this time and bring them down without bringing in the other utilities.
And again the money factor. It's an individual. This is where he lives. He is trying to subdivide the
property to get another house built -to kind of move on for them. Subject to your questions, and
again I want to thank staff for their support, as we are at the tail end of this short plat. But we kind of
fell between the catch 22 of what to do. To get the plat approved. To get the legal lots so that we
can come in for the building permit. And so in closing, what I would ask is that again we are looking
at a 17% slope. We do have these drawings that we can pass out if need be. Right now we are
looking at 17.8% for the first portion of it. And that would be our variance request for this evening.
Or if the group was unable to approve the variance and talk to the staff, then we would ask that you
would table this, as we have had earlier discussion with staff as they brought up this evening and
last week, the possibility of deferring it until the building permit. The owner would then at that time
would not have a hardship, because he has to tear the road up anyway to put in his new utilities.

Chairperson Wallace: It looks like that is all that we have here tonight. There would not be any
others in favor or opposed to the application. So questions from the Board.
Ralf Evans: I have a question for Kristina. Although I think that it may have already been answered.
This deferral request to the Board of Public Works. Apparently that was not made known to the
applicant previous to the time that they submitted this variance request.
Kristina Catlin: There were several discussions regarding the choice between the deferral and the
variance request. When this variance was originally submitted we, in talking with staff at the Abbey
Road Group, held off on actually processing the submittal to give them a chance to decide between
a deferral and a variance. Once we route it around our department, it removes the chance of a
refund. So we wanted to let them choose which way to go before sent it around and spent their
money. The choice was made to go forward with the variance. Staff anticipated at that time that the
deferral request would be made simultaneously, so that if the deferral was denied, that we would still
have the variance marching forward. A deferral request has not been specifically made for the

driveway grade. A deferral request was made previous to the short plat being applied for to cover
the public improvements such as sidewalks. But we have gone forward with this variance at the
request of the Abbey Road Group. And they were notified prior to even routing this variance, of the
option of a deferral. And then again throughout the process.
George Feighner: Could I ask a question? Why?
Gil Hulsmann: Yes, sir, there were two things. We had submitted the variance application. She is
correct We had submitted it to the City and after the City started to look at the variance application.
It had already been prepared and submitted, they asked us if we wanted to hold or pull it and then go
for a deferral at that time. Two things came into play. Number one was that if we did not go forward
with the variance at that time, we would have missed this opportunity for this evening. And then we
would have been pushed on to a later date for that. And so in our discussion with the owner and
also our discussion with the staff, since we would have been delayed further if we did not go through
with it. It was our recommendation that we move forward, since all of the paperwork and everything
had already been submitted for this. The other piece to that was that there was also a driveway
width issue that was also going to be coming forward for a variance. We have also been told the
staff has looked at that and that they might be supportive of a deferral of this. Staff did tell after we
did submit. But based on the timing of this meeting, if we did not push it through at that time then we
would have been 2 to 3 meetings later.
Kristina Catlin: That is correct. Into November.
Gil Hulsmann: Into November/December. So that was our justification for moving forward on this.
Chairman Wallace: Okay Thank you.
Jim Jacques: I have a question. So when you went to the Board of Public Works the first time for
your, was it some sidewalk deferral and some street...
Gil Hulsmann: We went to the preapplication meeting. During the preapplication meeting with staff
who did our preliminary review, basically the only concern that they had at that time was the
sidewalks. And so we had gone through the Board of Public Works, even before we had submitted
our short plat to review and cover that issue. At that time the driveway was never brought up and
the slope was never brought up.
Jim Jacques: So you did not know that your driveway was too steep and that you had some slope
issues on your driveway at that time.
Gil Hulsmann: No and I think that part of it was that they did ask us if we were going to build and
what we were going to do. We plan on building a new house and making everything, you know,
wider and everything else like that. And we anticipated, based on that meeting, and no comments
that that would all be part of the building permit. Which on this site, you basically have to grade it
back and do some things to get into the site. It wasn't until we got the initial conditions back that
said that you now have to do these before we can approve your short plat.
Jim Jacques: So you didn't have a topog done at that time yet.
Gil Hulsmann: Yes, we did. We did have a complete topog done.
Jim Jacques: But you just didn't know that there was a 15% maximum at that time.
Gil Hulsmann: No, I think that we were looking at the overall slope, and maybe they were too, that
from one end to the other, which were under the 15% slope. It is just that first 20 feet or so that we
are hitting 17%.

Ralph Evans: Again a question for the same gentleman. What was it that you said about the
deferral request to the Board of Public Works? You say that is in work now? Or is that on hold, or
where is that?
Gil Hulsmann: We were 0 n hold, pending the results 0 f this meeting. A nd then we have even
discussed further on this evening, that staff is, my understanding is now from staff, is that they are
very supportive of the deferral process. And so that is why we had a little huddle before this meeting
and kind of discussed a little bit more. But then again, I think that the main objective, not to get you
here on a meeting, that probably would have been cancelled if I wasn't here. But was the fact that
since we did not have any evidence of their supporting deferrals, at that time, we would have been
pushed into a November/December time frame.
Ralph Evans: Thank you. Kristina what does it look like from the staff standpoint as far as this
deferral request? D 0 you think that there is a possibility there? 0 r do you think that it is good
looking or is it -how does it appear to you?
Kristina Catlin: I can't speak on behalf of the Board of Public Works, but on behalf of Development
Services I think that staff would be supportive of them asking for a deferral request for this driveway
grade. The way that the application was submitted reads very much like a deferral request. They
also have the option of asking for a variance. You gentlemen have the option of approving a
variance if they can show a hardship. And so that is where we are at currently. Through the short
plat process we want to leave the options open for the applicant to either show hardship and ask for
a variance, or make the changes to the driveway to bring it into compliance.
Ralph Evans: Okay, thank you.
Chairperson Wallace: Any further question? This concludes the public hearing portion for this
application and opens discussion amongst the Board Members.
DECISION:
Motion made by Board Member Wayne Jones to grant the variance with the condition that the Proposed
Driveway Grading Plan Profile submitted as Exhibit 6 be attached to a restrictive covenant to be placed on the
plat. Board Member George Feighner seconded the motion.
Based on the hardship suffered by the applicant, the variance is hereby approved from the City of Renton
Development Regulations, Section 4-4-080.1.6.a, to allow a residential driveway exceeding 15-percent grade
subject to the following condition:
1. That a restrictive covenant be recorded on Lot 2 of the G. Taylor Short Plat stating that the existing
driveway will be altered to a grade not exceeding 15-percent prior to final inspection of a building permit
for a new single-family house.

BACKGROUND ....
The Bob Bridge Toyota dealership is located on the northwest corner of SW th Street and Hardie
Avenue SW. The site is located in the Commercial Arterial (CA) zone and within. the Automall
Improvement District. Access to the dealership is provided from both SW th Street and Hardie Avenue
SW. There are 12 Toyota markets located between Everett and Tacoma. The Renton market is the th
largest of the 12 markets, but consistently ranks 3rd in sales volume.
The applicant asserts that although Bob Bridge Toyota outperforms most other Toyota dealers in
Western Washington, hundreds of customers over the years have reported purchasing vehicles from
other Toyota dealerships because they did not know where Bob Bridge Toyota was located. The
applicant has stated that the primary problem for the Bob Bridge Toyota dealership is lack of visibility.
People traveling north on Rainier Avenue are not able to see the current 32-foot high Toyota sign .
. Renton Municipal Code Section 4-4-100E.3 states that the height limitation for freestanding signs is the
maximum height of the zone or forty feet (40'), whichever is less. Although the maximum building height

foot height limit, a variance from the Board of Adjustment is required.
The applicant, Bob Bridge, is requesting approval of a variance to allow a 48-foot tall freestanding sign.
The proposed sign would replace the existing 32-foot high sign at the northwest corner of SW th Street
and Hardie Avenue SW.
City of Renton Development Regulations Section 4-9-250.B.5. -The Board of Adjustment shall have
authority to grant a variance upon making a determination, in writing, that the conditions specified below
have been found to exist:
1. That the applicant suffers undue hardship and the variance is necessary because of
special circumstances applicable to subject property, including size, shape,
topography, location or surroundings of the subject property, and the strict
application of the Zoning Code is found to deprive subject property owner of rights
and privileges enjoyed by other property owners in the vicinity and under identical
zone classification:

The applicant feels that the location of the existing facility qualifies as an undue hardship.
The location of the dealership places it at a disadvantage when compared with other auto
facilities visible from Rainier Avenue and Grady Way. According to surveys conducted by
the Toyota factory, consumers often purchase from other Toyota dealerships because
they do not know that there is a Toyota store in Renton. The applicant believes that the
proposed 48-foot tall sign with the Toyota logo prominently displayed at the top would be
seen by most northbound Rainier Avenue drivers and attract consumers that might
otherwise be unaware that there is a Toyota dealership in Renton.
Staff concurs with the applicant that the location of the Toyota dealership places it at a
disadvantage to dealerships located along the primary Automall arterials of Rainier
Avenue and Grady Way. The location of the .dealership does not provide the same
visibility for signage that other auto dealers in the area enjoy. Approval of a variance from
the Renton Municipal Code to allow a 48-foot tall sign where 40-feet is the maximum
height permitted would help the advertising for the Toyota dealership to be visually
competitive with the signs of other dealerships in closer proximity to Rainier Avenue and
Grady Way. .
2. That the granting of the variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in the vicinity and zone in
which subject property is situated:
The sign is proposed to be located in the southeast portion of the site. The
granting of the variance would not be materially detrimental to the public welfare.
The sign is proposed on a parcel that is located in a commercial zone within the
Automall Improvement District. The area is specifically designated for auto-sales
and related activities. The permitted building height on the site is 50-feet. The
proposed sign is shorter than the maximum building height established for the
zone. The northern property line of the subject site is adjacent to residentially
zoned property. The subject sign is proposed to be located in the southeast
corner of the site, thereby maximizing the distance from the nearby residential
properties. Due to the proposed location of the sign, the commercial nature of
the surrounding area, and the permitted building height of the CA zone, granting
of the requested variance for increased sign height is not anticipated to have a
detrimental impact on any surrounding properties.
-3. That approval shall not constitute a grant of special privilege inconsistent with the

The approval of the requested variance would not constitute a grant of special privilege
inconsistent with the limitation upon the uses of other properties in the vicinity. Many of
the other properties in the vicinity are used for auto sales. The majority of those properties
enjoy the benefit of signs that are visible from Rainier Avenue South, which is a main
travel route used by driver entering Renton from Highway 167. The Bob Bridge Toyota
dealership is located one block west of Rainier Avenue South. The granting of the
requested variance would allow Bob Bridge to install a sign that would make his dealership
visible from Rainier Avenue South.

4. That the approval as determined by the Board of Adjustment is a minimum variance
that will accomplish the desired purpose:
The applicant has indicated that the proposed sign is the first step of the Toyota factory's
new dealership image program, which will include an interior and exterior remodel of the
showroom. The proposed 48-foot tall sign is the minimum height needed to increase the
visibility of the sign from surrounding streets and improve the visual competitiveness of
the dealership among the many auto dealers in the surrounding area.
II E. RECOMMENDATION"
Staff recommends approval of the proposed sign variance to allow a 48-foot tall freestanding sign, which
requires a variance from 4-4-100E.3 of the Renton Municipal Code.

The subject site is located in the Employment Area -Valh!y land use designation as shown on the
Comprehensive Plan Land Use Map and zoned Commercial Arterial (CA). The site is also
located in Area B of the Renton Auto Mall. The existing land use policies for the Employment
Area -Valley land use designation do not address signs specifically. They do however address
streetscape and ensuring quality development within this land use designation (Policy LU-
212.19).
Analysis:
Staff believes that an argument could be made for a variance for this site given that it is off the
"beaten path" so to speak. Whereas virtually all other dealerships in the area are either on SW
Grady Way or Rainier Avenue S, this dealership is located more than 300 feet off Rainier Avenue
South and more than 1,100 feet off of SW Grady Way. In order to have the same "targetability"
as its competitors the applicant would need either a larger sign face, everything else being equal,
or a higher allowed height, or both. In this case the applicant is requesting an eight-foot increase
in height rather than an increase in sign area. Their proposal is to increase the allowed height of
their sign from 40 feet to 48 feet.
Recommendation:
Support this sign variance to increase the maximum allowed height from 40 feet to 48 feet.

Bob Bridge Toyota Renton
Bob Bridge Toyota is an existing 4.06-acre Toyota dealership at SW 7th Street and
Hardie Avenue SW. Land use permit required is a variance for sign height for a new
signage and image program required by Toyota USA. New sign would replace existing
pylon sign for Toyota.
Current zoning is CA (Commercial Arterial), Auto Mall Area B. Adjacent properties to
west, south, and east are CA zone with property to the north zoned RM-T (Residential
Multi-Family, Traditional), which is separated by an existing, elevated railroad track.
• Site is already developed with no special environmental features.
• Soils types are typical valley soils with existing paved drainage system.
• Existing use remains the same.
• Access exists off SW 7th Street and Hardie Avenue SW.
• All off..;site improvements exist.
• Estimated construction cost for sign is approximately $12,000.00 and same for
market value.
• Negligible excavation would be required to remove old footings and replace new
footings for sign.
• No trees to be removed, new landscape highlights would be installed under sign.
• No land dedication required.

Bob Bridge Toyota
The purpose of this communication is to present important reasons why the City of
Renton should consider approving a new 48 foot Toyota factory brand sign for Bob
Bridge Toyota. This sign would be located at the same location as the current 32 foot
Toyota brand sign at the northwest comer of 7th and Hardie.
Background
From Everett through Tacoma there are 12 Toyota locations. The Renton market (Bob
Bridge Toyota) is the 7th largest of the 12 markets. However, Bob Bridge Toyota
consistently is the 3rd largest sales volume dealer and number one in customer
satisfaction.
That means Bob Bridge Toyota is consistently successful in driving Toyota buyers to
Renton particularly from the Seattle market. (See attached pin maps of sales for past
years.) The result is in 2003 Bob Bridge Toyota had sales "of $63,000,000, which
generated tax revenues for the City of Renton of $536,000.
Benefit of 48 Foot Sign
Even though, Bob Bridge Toyota outperforms most other Toyota dealers in Western
Washington, hundreds of customers over the years reported they bought at another
Toyota dealership because they did not know exactly where we were located. The
primary problem is the 50,000 plus traffic count proceeding north on Rainier from Grady
Way past 7th Avenue can not see my current 32 foot Toyota sign. Unfortunately for me
they can see the 48 foo~ high Dodge sign. If you will review the new 48 foot Toyota
factory sign, you will' see there are only 3 elements. The Toyota logo, Toyota name and
the all new Scion name.
Result of the City's Approval
Approval of the new '48 Toyota brand sign will result in $9,000,000 additional sales
dollars in the fIrst 12 months after installation. This would result in an annual $76,500

Undue Hardship
Property is an existing auto facility, which is away from Rainier Avenue and requires a
higher sign to identify facility in relation to other auto facilities with direct exposure off
Rainier Avenue and Grady Way.
Not Materially Detrimental to Public Welfare

The public welfare would be served by this sign as increased revenues from the City "
generated by Bob Bridge Toyota could ease individual property owner's future tax
increase. Granting of this variance would not be materially detrimental to public welfare,
zone is commercial and numerous other similar signs are already established in this area
for commercial identification. Residential areas are remote with railroad track buffer at

contrary, it would level the playing field as Bob Bridge Toyota is being discriminated
against in light of the' 48 Dodge sign curr~ntly in place on the same street (Hardie)
