Variance Request: Variance to locate an off-premise sign on Benson Road South at Eagle Ridge Drive South. The Applicant: The Lodge at Eagle Ridge 1600 S Eagle Ridge Drive Renton, W A 98055 Project Description: The applicant is requesting a variance relief from Section 4-4-100E of the Development Standards for Direction signs, which limits the location of the sign. The applicant is proposing a two-sided directional sign partially within the Benson Road South right-of-way and partially within private property owned by Hong & Associates. II Board of Adjustment Minutes June 23, 2004 Page 2 VARIANCE CRITERIA City of Renton Development Regulations Section 4-9-25085 -The Board of Adjustment shall have authority to grant a variance upon making a determination, in writing, that the conditions specified below have been found to exist II 1. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the Vicinity and under identical zone classification: The applicant notes that the subject site does not contain any street frontage and instead is served by a long private access easement from South Eagle Drive; therefore, an on-site sign near a public street is not possible. In addition, the applicant notes that the topography of the site limits the buildings visibility from the public right-of-way, which causes potential customers to travel past the site. Moreover, as the site is not visible from the public right-of-way, there are no visual indicators for individuals looking for the subject retirement residence. Therefore, locating the sign on the subject site would defeat the purpose of the sign, as it would not be readily visible to individuals traveling in either direction along Benson Road South or South Eagle Drive. The applicant has demonstrated a hardship as the subject site does not have any public street frontage and the buildings are not visible from the public roadway. The Board supports the approval of a two-sided directional sign partially within the Benson Road South right-of-way and partially within the Hong & Associates property, as the subject sight does not have any public street frontage and because the complex is not visible from the public street. 2. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The applicant has proposed to locate a two-sided directional sign partially within the Benson Road South right-of-way and partially on private property. As such, the applicant was required to apply for a right-of-way use permit, which was granted by the City's Board of Public Works on April 14,2004. However, in order to ensure the sign will not be materially detrimental to the public welfare or injurious to the property or improvement in this area of the City, the Board of Public Works required the applicant to request utility locates before the installation of the sign and the sign be placed at least five feet from existing utilities. As such, staff does not anticipate the proposed sign to be detrimental to the public welfare. At this time the City does not have any plans to widen or otherwise utilize the existing right-of-way along this portion of Benson Road South. However, the Board supports a recommendation from staff conditioning the variance approval, which would require the applicant to remove the sign, at their own expense and within 30 days of notice from the City of Renton, should the City decide to utilize the right-of-way area in question at a future time. Nevertheless, the Board does not anticipate the proposed sign to be materially detrimental to the surrounding properties, as the Board of Public Works conditioned the sign to minimize any sight distance impacts that would have otherwise been generated by this proposal. 3. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: Board of Adjustment Minutes June 23, 2004 Page 3 The applicant contends that there are many other commercial/industrial uses in this vicinity of the City that have better visibility from the Benson Road South/South Eagle Drive corridors, as the majority of properties have some public street frontage. In this case, the applicant has contacted neighboring property owners and asked to utilize some of their existing sign space, which has not been permitted. In addition, the retirement residence buildings are not visible from the public right-of-way, which further limits the ability to notice the building from a moving vehicle. Therefore, the applicant is proposing to locate the two-sided directional sign partially within the Benson Road South right-of-way and private property, which would adequately identify the location of the subject site. The applicant notes that there are many other signs along Benson Road South and South Eagle Drive that are located much closer to the paved surface of that corridor. Therefore, the proposal to locate the sign off-site and partially within the public right-of-way (approximately 6 feet from the paved portion of Benson Road South right-of-way) should not be considered a grant of special privilege inconsistent with other nearby uses. The Board is in agreement with this conclusion and finds no reason to restrict the proposed location of the sign. 4. In that capacity, The Lodge has sponsored several Chamber events, both breakfast and late afternoon, and is referred from our Chamber office as a location for senior residence and public rentals. Although I had been to The Lodge several times, I missed the left tum onto Eagle Ridge Drive at our last Chamber After Hours event because the directional sign was gone. I have always depended on the sign to alert me to the tum. Benson Road is just too congested to safely slow down to gawk at street signs, especially with only one lane per direction. I would think it a hazard for drivers who have never been to the site to attempt finding Eagle Ridge Drive South. Compounding the challenge of finding the proper tum is the age of the residents and their friends. It benefits all of us when our streets are more senior-friendly. BACKGROUND The applicant, The Lodge at Eagle Ridge, is requesting approval of a Board of Adjustment variance, which would allow the placement of a freestanding two-sided directional sign partially within the public right-of-way of Benson Road South and within off-site private property. RMC4-4-100E allows commercial business to have freestanding signs, when located solely on the property the sign is advertising. In addition, the sign code stipulates that the freestanding sign cannot be located closer than 10 feet to a public right-of-way. In this case, the applicant has proposed to locate the freestanding sign partially within the Benson Road right-of- way and partially on private property that is not part of development being advertised, which requires a variance from the City's sign code. The applicant has indicated that the subject site is served via a private easement and does not have any street frontage to locate the proposed sign. In addition, the topography of the site in relationship to the existing buildings limit the visibility of the facility to individuals traveling on Benson Road South and/or South Eagle Ridge Drive. In addition, the applicant contends that if the sign were located 10 feet from the right-of-way (solely on the Hong & Associates property), the sign would be located to far from the paved street to assist individuals in locating the subject site. In addition to the sign code variance request, the applicant was required to obtain a right-of-way lise permit to locate a structure in the City's right-of-way. A right-of-way use permit was granted by the City's Board of Public Works on April 14, 2004. The permit stipulated five project conditions: 1) the applicant shall obtain a sign permit; 2) the applicant shall pay the fee as established by ordinance for a Temporary Use of Public Right-of-Way based on a current assessed value for the land in the vicinity, the fee is $10.00 per year (payable yearly in advance); 3) the applicant agrees to sign and record a Hold Harmless and Indemnity Agreement approved by the City of Renton; 4) the contractor shall request utility locates before the installation of the sign and the sign shall be placed at least five feet from existing utilities; 5) the applicant provides sufficient public liability and property damage insurance with limits of not less than one-hundred thousand dollars/three hundred thousand dollars ($100,000.00/$300,000.00) to cover public liability and not less than fifty thousand ($50,000.00) to cover property damage. 110. VARIANCE CRITERIA City of Renton Development Regulations Section 4-9-250.B.5. -The Board of Adjustment shall have authority to grant a variance upon making a determination, in writing, that the conditions specified below have been found to exist: 1. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant notes that the subject site does not contain any street frontage and instead is served via a long private access easement from South Eagle Ridge Drive; therefore, an on-site sign near a public street is not possible. In addition, the applicant notes that the topography of the site limits the buildings visibility from the public right-of-way (South Benson Road and Eagle Ridge Drive South), which causes potential customers to travel past the site. Moreover, as the site is not visible from the public right-of-way, there are no visual indicators for individuals looking for the subject II boarpt.doc retirement residence. Therefore, locating the sign on the subject site would defeat the purpose of the sign, as it would not be readily visible to individuals traveling in either direction along Benson Road South or South Eagle Ridge Drive. The applicant has demonstrated a hardship as the subject site does not have any public street frontage and the buildings are not visible from the public roadway. Therefore, staff supports the proposed sign, as it is a right and privilege enjoyed by other property owners in this area of the City and under identical zone classifications. 2. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The applicant has proposed to locate a two-sided directional sign partially within the Benson Road South right-of-way and partially on private property. As such, the applicant was required to apply for a right-of-way use permit, which was granted by the City's Board of Public Works on April 14, 2004. However, in order to ensure the sign will not be materially detrimental to the public welfare or injurious to the property or improvement in this area of the City, the Board of Public Works required the applicant to request utility locates before the installation of the sign and the sign be placed at least five feet from existing utilities. As such, staff does not anticipate the proposed sign to be detrimental to the public welfare. At this time, the City does not have any plans to widen or otherwise utilize the existing right-of-way along this portion of Benson Road South. However, staff recommends a condition of variance approval requiring the applicant to remove the sign, at their own expense and within 30 days of notice from the City of Renton, should the City decide to utilize the right-of-way area in question at a future time. As a result of this condition, the proposed variance would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the site is situated. 3. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that there are many other commerciallindustrial uses in this vicinity of the City that have better visibility from the Benson Road South/South Eagle Ridge Drive corridors, as the majority of properties have some public street frontage. In this case, the applicant has contacted neighboring property owners and asked to utilize some of their existing sign space, which has not been permitted. In addition, the retirement residence buildings are not readily visible from the public right-of-way, which further limits the ability for individuals to notice the building from a moving vehicle. Therefore, the applicant is proposing to locate the two-sided directional sign partially within the Benson Road South right-of-way and private property, which would adequately identify the location of the subject site. The applicant notes that there are many other signs along Benson Road South and South Eagle Ridge Drive that are located much closer to the paved surface of that corridor. Therefore, the proposal to locate the sign off-site and partially within the public right-of-way (approximately 6 feet from the paved portion of Benson Road South right-of-way) should not be considered a grant of special privilege inconsistent with other nearby uses. 4. The applicant, on behalf of the Lodge at Eagle Ridge, is requesting approval of a sign variance from Section 4-4-100E of the Development Standards for Direction signs, which limits the location of the sign. The applicant is proposing a two-sided directional sign partially within the Benson Road South right-of-way and partially within private property owned by Hong & Associates. 2. RMC4-4-100E allows commercial business to have one free standing sign per street frontage not to exceed 25 feet in height and 150 square feet in sign area. 3. The subject site is located within the Center Neighborhood (CN) zone. 4. The subject site is located within the Center Neighborhood (CN) Comprehensive Plan designation area. 5. The two-sided directional sign is proposed to be located approximately 6 feet from the paved portion of Benson Road South. 6. The applicant is proposing a 36 square foot (per side) sign; however, the sign code allows a significantly larger sign (maximum of 75 square feet per side). 7. The subject site is surrounded by other commercial and residential uses that are more readily visible from the Benson Road South/South Eagle Ridge Drive corridor. 8. The project was given a 2-week notification period (June 3 to June 18) during which no comments, neither in favor nor in opposition, were received. CONCLUSIONS: FROM THESE FINDINGS OF FACT, THE BOARD MAKES THE FOLLOWING CONCLUSIONS: Development Regulations Section 4-9-250.B.5. -The Board of Adjustment shall have authority to grant a variance upon making a determination, in writing, that the conditions specified below have been found to exist: 1) That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant notes that the subject site does not contain any street frontage and instead is served by a long private access easement from South Eagle Drive; therefore, an on-site sign near a public street is not possible. In addition, the applicant notes that the topography of the site limits the buildings visibility from the public right-of-way, which causes potential customers to travel past the site. Moreover, as the site is not visible from the public right-of-way, there are no visual indicators for individuals looking for the subject retirement residence. Therefore, locating the sign on the subject site would defeat the purpose of the sign, as it would not be readily visible to individuals traveling in either direction along Benson Road South or South Eagle Drive. The applicant has demonstrated a hardship as the subject site does not have any public street frontage and the buildings are not visible from the public roadway. The Board supports the approval of a two-sided directional sign partially within the Benson Road South right-of-way and partially within the Hong & Associates property, as the subject sight does not have any public street frontage and because the complex is not visible from the public street. 2) That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The applicant has proposed to locate a two-sided directional sign partially within the Benson Road South right-of-way and partially on private property. As such, the applicant was required to apply for a right-of- way use permit, which was granted by the City's Board of Public Works on April 14, 2004. However, in order to ensure the sign will not be materially detrimental to the public welfare or injurious to the property or improvement in this area of the City, the Board of Public Works required the applicant to request utility locates before the installation of the sign and the sign be placed at least five feet from eXisting utilities. As such, staff does not antiCipate the proposed sign to be detrimental to the public welfare. At this time the City does not have any plans to widen or otherwise utilize the existing right-of-way along this portion of Benson Road South. However, the Board supports a recommendation from staff conditioning the variance approval, which would require the applicant to remove the sign, at their own expense and within 30 days of notice from the City of Renton, should the City decide to utilize the right-of- way area in question at a future time. Nevertheless, the Board does not anticipate the proposed sign to be materially detrimental to the surrounding properties, as the Board of Public Works conditioned the sign to minimize any sight distance impacts that would have otherwise been generated by this proposal. 3) That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The applicant contends that there are many other commerciaVindustrial uses in this viCinity of the City that have better visibility from the Benson Road South/South Eagle Drive corridors, as the majority of properties have some public street frontage. In this case, the applicant has contacted neighboring property owners and asked to utilize some of their existing sign space, which has not been permitted. In addition, the retirement residence buildings are not visible from the public right-of-way, which further limits the ability to notice the building from a moving vehicle. Therefore, the applicant is proposing to locate the two-sided directional sign partially within the Benson Road South right-of-way and private property, which would adequately identify the location of the subject site. The applicant notes that there are many other signs along Benson Road South and South Eagle Drive that are located much closer to the paved surface of that corridor. Therefore, the proposal to locate the sign off- site and partially within the public right-of-way (approximately 6 feet from the paved portion of Benson Road South right-of-way) should not be considered a grant of special privilege inconsistent with other nearby uses. The Board is in agreement with this conclusion and finds no reason to restrict the proposed location of the sign. 4) That the approval as determined by the Board of Adjustment is a minimum variance that will accomplish the desired purpose: The applicant contends that the location and size of the sign is the minimum necessary, in order to assist individuals traveling to the retirement residence from Benson Road South. Specifically, the applicant has proposed a much smaller sign (36 total square feet per side) than the maximum allowed by code (75 square feet per side). In addition, the applicant has elected to locate the sign in such a manner that it does not interfere with traffic or sight distance for individuals operating motor vehicles or pedestrians traveling along Benson Road South (the sign is sufficiently setback from the paved surface of the roadway). Therefore, the approval of the proposed sign is the minimum variance necessary to accomplish the applicant's desired purposes. The Board also agrees with this conclusion and finds no reason to restrict the proposed location of the sign. DECISION: FROM THE FOREGOING FINDINGS OF FACT AND CONCLUSIONS, THE BOARD ENTERS THE FOLLOWING DECISION: The variance is hereby granted from the City of Renton Development Regulations, Section 4-4-100E, Free Standing Directional Signs Standards to allow for the location and construction of the sign partially within the Benson Road South right-of-way and partially within the Hong & Associates property as illustrated in the submitted plan. The variance is approved with the following condition: 1. The applicant shall be required to remove the sign from the Benson Road South right-of-way, at their own expense and within 30 days notice from the City of Renton, should the City determine the use of that portion of the right-of-way is necessary. OLD BUSINESS: 5. • NOISE VARIANCE EXTENSION, WSDOT, 1-405 Bridge Maintenance Deck & Expansion Joint Repairs -The applicant is requesting a Noise Variance Extension, from the 1-405 Maintenance Noise Variance granted in 2003, to perform maintenance work in the 3 following locations: 1-405 bridge on North Park Drive, the bridge on Benson Road South and 1-405 bridge over Talbot Road South. The request is for 16 (sixteen) nights to complete the work. Action: Moved by Kittrick, Seconded by Meckling, it was decided to grant the extension, subject to the following Mitigation Measures: 1. Lighting used for nighttime work shall, whenever possible, be directed away from oncoming traffic and residences, or be shielded. 2. All export haul vehicles shall have rubber bed liners to reduce noise impact. 3. All backup warning devices employed shall be the least obtrusive ambient sensitive type or the contractors may use a backup observer in lieu of backup warning devices as allowed by WAC Chapter 296-155- 610 (2) (E). 4. WSDOT shall conduct a training session on noise mitigation measures with WSDOT maintenance forces. WSDOT shall submit certification of the completion of said training. In addition to providing training, WSDOT shall grant the necessary authorization to have an acoustics expert/inspector onsite at all times to ensure immediate enforcement actions of all mitigation measures. 5. After two substantiated continuing complaints within the area of work are received and reviewed by staff, WSDOT shall perform noise measures in sleeping quarters or at property line of affected residents. If " noise levels are above allowed threshold, WSDOT shall provide additional mitigation measures such as, but not limited to shielding of noise source, reducing use of certain types of equipment, or providing motel accommodations. 6. A 24-hour complaint phone number shall be available to register complaints or voice concerns. 7. The contractor shall notify affected residents identified in the City of Renton application about the nighttime work at least (7) seven calendar days in advance of initiating nighttime work, to residents within the first and second line of receivers. 8. We are requesting pennission to place a directional sign at the intersection of Eagle Ridge Drive South and Benson Road South. The purpose of the sign is to allow visitors to find our site which is located off the main thoroughfares. Please see attached drawing of proposed signage. Justification for the Variance Request History 1600 South Eagle Ridge Drive was previously known as the Renton Elks Lodge. TF Corporation purchased the property in 1994 from the Elks and began development of its 99 unit elderly care facility in 1998. From 1998 until 2003 the City of Renton allowed TF to display a directional sign at the comer of Benson Road South and South Eagle Ridge Driye. In 2003 the City notified TF that the zoning laws had changed substantially and that we would be required to apply for a variance to use that location. The Lodge at Eagle Ridge caters to a population of elderly residents with an average age of 85 years.. Most of the residents require some form of nursing care. It is important that oUr residents, family and friends have a directional aide at the intersection of Benson and Eagle Ridge Drive to locate our facility. The Lodge is situated off Ecigle Ridge Drive and down a private easement property of Puget Sound Energy on an isolated 5 acre site. This location makes it extremely difficult for both elderly drivers as well as those much younger to find our facility. The ability to market our rental units has suffered as well. In 2002 our facility was continually realizing 95% occupancy. Today we sit at 88% in a market which has grown dramatically and is seeing large operators such as Merrill Gardens and Chateau Valley Medical entering the market. All of our competitors have street signage which directs 1600 S. Eagle Ridge Drive Renton. The Lodge has made extraordinary efforts to " piggyback" with existing signage locations on the intersection. We have asked both the Berkshire and Eagle Point as well at the Benson Townhomes for permission to put in a directional sign. The existing businesses do not feel comfortable sharing their locations. In summary we are experiencing undue hardships without a directional sign and would appreciate your consideration in granting this variance. The granting of the variance should not be detrimental to the public welfare or injurious to property and improvements in the area: The proposed sign, we believe, is an attractive and aesthetically pleasing addition to the surrounding properties. Designed by Bruce Barton Bailey it reflects the architectural detail ofthe Lodge building which was designed by NBBJ (architects for the original Elks Lodge and the SAFECO baseball stadium) in 1978. The building and its architecture form part ofthe history of Renton, generations of Renton families have enjoyed the community of the Elks during their existence, new generations are joining their families in the same building as we promote a new spirit of senior living and community involvement with our elderly popUlation .. The sign will be created from log timbers, much like the architecture of the Lodge itself. The location of the sign should not impact either public access or be a visual disturbance to drivers heading either north or south on Benson Road. There is an existing patch of three feet of asphalt and three feet of crushed rock between the sign and the white line denoting the edge of Benson Road. This distance allows ample room for pedestrians or cyclists pass easily. The backdrop to the sign to the west is a forested parcel, this backdrop carries through visually to the north and south. Property owners Hong and Associates have consented to this sign arfter reviewing its location and its impact upon not only their property but the surrounding easements, etc. The sign should not affect improvements to the area both existing or future. In the event the City of Renton or other contractors should want to access this area, the sign is designed to be lifted from its footings through a metal sleeve and can be moved on short notice. The sign is located 6 feet from the 8 inch water line in Benson and 14 feet from a sewer manhole. These are the only City utilities that would require access. Underground locators have confirmed the exact locations ofthese utilities. Approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicintiy and zone in which the subject property is situated: We visited twenty businesses and properties within 300 feet of the Lodge. Most of the businesses and properties share the same neighborhood commercial zoning. Our findings indicate that: 1) Many of these businesses are currently using City of Renton Right of Way property to display their signs, either partially Of. completely. Please see attached photos. 2) The immediate location of Benson and Eagle Ridge Drive currently have two signs displayed which partially utilize City of Renton Right of Way for landscaping or actual signage. The sign on the southeast corner of this intersection belonging to Eagle Point apartments has landscaped ten feet into the ROW. Additionally they have installed flagpoles which extend 15 feet above their existing signage. Which appears to be about 6 feet high. The signage on the northeast corner of Benson and Eagle Ridge Drive belonging to the Berkshire Apartments may also be extending into ROW. The Berkshire has been allowed a second sign 100 feet east on Eagle Ridge Drive which appears to extend into ROW. 3) Severa! business in the strip mall at the corner of Benson and Puget Park Drive have signage which is located on the ROW on the east side of Benson Road fronting the strip mall. 4) Eagle Point Dental Clinic has signage in the ROW about 100 feet north on Benson Road heading towards City Hall. Within the context of existing signage allowed for other properties in our same zoning and within our vicinity we do not believe that this would constitute a grant of special privilege. The approval, as determined by the Reviewing Official, is the minimum variance that will accomplish the desired purpose: The need to install this sign, its size and location ,were detennined by serveral criteria: I) Elderly residents attempting to locate our facility must have a landmark where to turn on Eagle Ridge Drive. To accomplish this we detennined a sign which featured our logo and the architectual detail would be the most helpful. Our proposed sign should accomplish this at a minimum. 2) The" Open" attachment pointing to Eagle Ridge drive will notify drivers that we are" open" 24 hours a day. The Lodge is staffed 24 hours a day and equipped to handle all needs of our senior population, including relatives who may want or need to visit their loved ones outside of nonnal business hours. 3) The height of our sign is approximately 12 feet, the height of adjoining signage including flagpoles is over 15 feet.
