The City has finished reviewing your proposed lot line adjustment and is now ready to approve .
.. and send the final version for recording. Please submit two sets of an original signed mylar
and a check for $15.73 made out toCD&L to meat the sixth floor counter of City Hall. .
Please verify that the mylars have been signed by alloYiners of record and have been
notarized with an ink stamp {not embossed) .. The ink stamp must be legible so that King
County will promptly record the lot lineildjustment.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have
the following comments:
Comments for the Applicant:
Remove references to concrete, gravel, etc., as currently shown on Lots 1,2 and 5 on the short
plat drawing (Sheet 2 of 2). Remove said items from the drawing because they have no direct
impact on the subdivision.
Remove "DEPARTMENT OF DEVELOPMENT AND ENVIRONMENTAL SERVICES" from
the "APPROVAL" block for the City of Renton.
Submit the "DECLARATION OF RESTRICTIVE COVENANTS" document with the short plat
for recording purposes, and reference said document on the short plat drawing, providing a space
for the recording number thereof.
Remove the City of Renton logo from the upper left-hand comer of both drawing sheets.
Note that the word "THEREIN" is misspelled in both of the acknowledgment blocks on Sheet 1
of2.
The same development agreement, between the City of Renton and Dalpay Properties, LLC and
others, is listed five times under the "EXCEPTIONS AND AGREEMENTS OF RECORD" block
on Sheet 1 of 2. Noting said agreement once (using the most recent title report order number) is
sufficient. NOTE: The word "AND" is missing a letter in the line beginning with
"DEVELOPMENT AGREEMENT".

The commercial lots (Lots 4 and 5) need to be provided with addresses, or an addressing scheme,
by the City's Development Services department, as required by RCW 58.17.280.
Make it clear on the "DECLARA nON" block that James Dalpay is signing for Dalpay
Properties, LLC, and that Louis Woodcock is signing for the Estate of Louis B. Woodcock (if
applicable).
Insert "IN THE CITY OF RENTON" after "W.M." in the Declaration of Restrictive Covenants
document "Exhibit A" legal description.
Comments for the Project Manager:
Did the City Attorney review the restrictive covenant document for form?

Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have
the following comments:
Comments for the Applicant:
Remove the references to concrete, covered area, rockery and gravel, as noted on proposed Lots
2, 1 and 5.
Remove "DEPARTMENT OF DEVELOPMENT AND ENVIRONMENTAL SERVICES" from
the "APPROVAL" block for the City of Renton. Replace with "CITY OF RENTON".
Since Mr. Woodcock is deceased, it would be better to preface his signature line
("DECLARATION" block on Sheet 1 of 2) with the words "ESTATE OF'.
A covenant between the applicant and the city is needed to provide for the access of Lots 4 and 5
over commercial properties adjoining on the north and east (of the subject lots) that are currently
owned by Dalpay and Associates. Said covenant should be recorded with the lot line adjustment
and referenced on the lot line adjustment, including the recording number thereof. This is
necessary to avoid the creation of landlocked properties.
Note the addresses for the residential lots as follows: Lot I is 4000 NE 1 t h Street, Lot 2 is 3916
NE 12th Street, and Lot 3 is 3900 NE Ith Street.

This letter is in response to your letter dated September 27, 2004. Attached please find a revised map reflecting
your comments.
Item number 14 refers to acx:ess for proposed Lots 4 and 5. Based on LLA map provided it appears that Lots 4 and 5
are land locked. This is not nec:essariIy the case. Dalpay and Associates own the commercial properties to the north
and the east of the site. Given the fact that the Lot Line Adjustment is subsequently establishing a boundary
between residential and commercial zones we would like you to consider an access alternative. Dalpay and
Associates would like to acx:ess Lots 4 and 5 off ofNE Sunset Blvd through their adjacent property to the North. I
have included a map depicting a larger area that might aid in our request. Om reasoning is that commercial access
should be through commercial zoning as to not disrupt residents north ofNE 121h.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced submittal and have the following
comments:
Comments for the Applicant:
Note the City of Renton land use action number and land record number, LUA-04-1 06-LLA and
LND-30-02B2, respectively, on the drawing sheets. The type size used for the land record
number should be smaller than that used for the land use action number.
Make ties to two City of Renton Survey Control Network horizontal control monuments. Both
the E 1,4 and the SE comer of Section 4 are vertical control only. Note the City of Renton
numbers for the monuments used to tie to the City of Renton Survey Control Network.
The geometry does not work.
Indicate what has been, or is to be, set at the comers of the proposed lots.
Note all easements, covenants and agreements of record on the drawing.
On the final short plat submittal, remove all references to utility facilities, topog lines and other
items not directly impacting the lot line adjustment.
The City of Renton Administrator of Planning/Building/Public Works is the official who
approves and signs this lot line adjustment. Revise the "APPROVAL" block noted on Sheet I of
2, as needed.
Change all references, on both drawing sheets, from "BOUNDARY LINE ADJUSTMENT" to
LOT LINE ADJUSTMENT.

All vested owner(s) of the subject properties need to sign the final lot line adjustment submittal.
Note that if there are easements, restrictive covenants or agreements to others (City of Renton,
etc.) as part of this lot line adjustment, they can be recorded concurrently with the lot line
adjustment. The lot line adjustment and the associated document(s) should be given to the
Project Manager as a package. King County will be instructed to record the lot line adjustment
first, with the associated document(s) following. References to the associated document(s) and
spaces for the recording number(s) thereof are needed on the lot line adjustment for cross-
referencing purposes.
The new access easement appears to be for the benefit of proposed Lots 4 and 5. How does said
easement provide access to NE 12th Street? Lots 4 and 5 appear to be landlocked.
Since the newly configured lots are under common ownership at the time of recording, there can
be no new access easement until owriership of the lots is conveyed to others, together with and/or
subject to specific easement rights.
Add the Declaration of Covenant language on the face of the subject drawing, !f. the previous
paragraph applies:
DECLARATION OF COVENANT:
The owners of the land embraced within this lot line adjustment, in return for the
benefit to accrue from this lot line adjustment, by signing hereon covenant and agree
to convey the beneficial interest in the new easement shown on this lot line
adjustment to any and all future purchasers of the lots, or of any subdivisions thereof
This covenant shall run with the land as shown on this lot line adjustment.
The private access easement (and utilities?) easement requires a "NEW PRIVATE EASEMENT
FOR INGRESS, EGRESS & UTILITIES MAINTENANCE AGREEMENT" statement on the
drawing. See the attachment.
The "APPROVAL NOTES" block, on Sheet 2 of 2, does not apply to the City of Renton.
Remove said block.

Is the noted width of 16' for the proposed access easement adequate?
