C. Project Description / Background:
The applicants, Emilio and Mary Mendoza, are requesting approval of an administrative
variance from the required front yard setbacks in-the R-8 zone (section 4-2-110A). The
subject site is located at 3731 NE 9th Street (parcel 0425200120). The variance request is
the result of a code violation for the construction of a covering over a previously existing
patio without a building permit. The Mendozas subsequently applied for a building permit.
The development standards of the R-8 zone require a front yard of 15 feet. The setback is
measured from the property line to the building footprint. The applicant is proposing a
reduction of the front yard setback to 12 feet in order to construct an addition to their single-
family residence consisting of a cover over an existing patio.
The applicant submitted a site plan showing the new addition on the site. The proposed 504
sq. ft. structure is a cover over an existing 240 sq. ft. patio. Lot coverage would be
approximately 33 percent. The variance proposal would maintain the required interior 5-foot
side yard and 20-foot rear yard setbacks.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant has requested approval for an administrative variance from
the required 15-foot front yard setback in the R-8 zone (section 4-2-110A) for the
property located at 3731 NE 9th Street. A 12-foot front yard setback is requested.

2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are entered as Exhibits 1 through 3.
3) Existing Land Use: Land uses surrounding the subject site include: North: single-
family residential; South: single-family residential; East single-family residential; and
West: single-family residential.
4) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone.
The development standards for this zone require a 15-foot front yard setback, 20-foot
rear yard setback, 5-foot interior side yard setback, and a 15-foot side yard along a
street setback. Maximum lot coverage is 35 percent or 2,500 sq. ft. for lots 5,000 sq.
ft. or greater.
4) Topography: The topography of the site is flat.
5) Lot and Building Size: The site area is 6,780 square feet. The existing single-family
home totals approximately 1,300 square feet and with a footprint of approximately
1,755 square feet, and the addition will add 504 square feet of footprint, which results
in a building lot coverage of 33 percent (33%).
CONSISTENCY WITH VARIANCE CRITERIA
Section 4-9-2S0B.S.a. Lists 4 criteria that the Zoning Administrator is asked to consider,
along with all other relevant information, in making a decision on an Administrative Variance
application. These include the following:
The Zoning Administrator shall have authority to grant an administrative variance
upon making a determination, in writing, that the conditions specified below have
been found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicants contend that special circumstances apply to the subject site, which
impose limitations on the lot. Specifically, the applicants indicate that the property
is constrained by its irregular configuration and unusual placement of the single-
family residence. The property is rectangular in shape with a triangular shaped
bump-out along the southern property line. The residence is placed at an angle
with respect to the property lines, creating little area for the applicants to add on to
their residence and comply with the City's setback requirements.
The applicants' proposal indicates that an existing 240 sq. ft. patio is currently
located below the proposed addition area, and that their proposal is to construct a
cover over the existing patio. This addition area will be open underneath and will
allow the patiO area to continue to function as a part of the existing front yard.

The 15-foot front yard setback limits the available building area. Therefore, the
applicant is requesting to encroach into the front yard setback by 3 feet in order to
construct their single-family residential addition as illustrated in Exhibit 2. In this
case, the hardship of the site is the irregularly shaped lot and unusual placement of
the residence, which constrains the remaining building envelope for the covered
patio addition.
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
A reduction of the front yard setback to 12 feet, would continue to provide adequate
distance from the residence to NE 9th Street as the property line is approximately
14 feet from the edge of the street pavement, therefore the addition area would be
approximately 26 feet from the edge of the street. The proposed addition will be
open underneath for an existing patio and the result will not create a reduced front
yard area as the previously existing patio area will continue to function as a part of
the front yard. Therefore, staff contends that the granting of the variance to reduce
the front yard setback from the required 15 feet to the proposed 12 feet would not
be materially detrimental to the public welfare.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:
The applicants are proposing to construct a structure to cover an existing patio
while blending the roofline of the proposed addition in with the roofline of existing
residence. The lot is irregularly shaped and the residence sits on the lot at an
angle making it difficult for the applicants to add on their residence and still
maintain the required setbacks. The proposed addition will be open underneath to
the existing patio and will continue to function as apart of the front yard.
d. That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
The applicants contend that the request is a minimum variance needed in order to
construct an addition to the existing single-family residence consisting of a cover
over an existing patio, as there is no other suitable option on their site to construct
a covered patio due to the irregular lot size and placement of the house.
Due to the patio cover being located 26 feet from the edge of the street, and the
patio cover being open underneath, thereby allowing the patio area to continue to
function as front yard, staff supports a reduction in the front yard setbacks from 15
feet to 12 feet for the construction of the proposed addition as the minimum
necessary to accomplish the desired purpose of covering the existing patio.
E. Conclusions
1. The subject site is located at 3731 NE 9th Street, within the Residential - 8 Dwelling
Units per Acre (R-8) zoning designation.

2. The R-8 zone requires a minimum 15-foot front yard setback from the property
boundary (section 4-2-11 OA). The applicant is proposing a 3-foot reduction of the
front yard to 12 feet.
3. The analysis of the proposal according to variance criteria is found in the body of the
Staff Report.
F. Decision
The Administrative Setback Variance for the Mendoza Variance, File No. LUA-04-150,
V-A, is approved subject to the following conditions:
1. The front yard setback shall be a minimum of 12 feet measured from the front property
line to the closest point of the building. The satisfaction of this requirement is subject to
the review and approval of the Development Services Project Manager and shall be
verified at ,the time of building permit issuance.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on January 12,2005. Any appeal must be accompanied by a $75.00
fee and other specific requirements.

may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the deciSion/approval date must be made in writing
