Said temporary construction easement shall remain in force during construc-
tion and until such time as the roadway, utilities and appurtenances have been

Said heretofore mentioned rantee, its successors or assi ns shall hiv

the ri gh t, wi thout pri or noti ce or proceedi ng at 1 aw, at s uch ti mes as may be
necessary to enter upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said roadway and utilities ,
or making any connections therewith, without incurring any legal obligations or ,
liability therefore, provided, that such construction, maintaining, repairing,
altering or reconstruction of said roadway and util; ties shall be accomplished in
' such a manner that the private improvements e xisting in the right(s)-of-way shall
not be disturbed or damaged, they will be replaced in as good a condition as they
were imrnediately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the afo redescribed premises , including
the ri ght to retain the ri ght to use the surface of sai d ri ght-of-way i f such use
does not interfere with installation and maintenance of the roadway or utilities .
However, the grantor shall not erect buildings or structures over, under or across
._ the right-of-way during the existence of such roadway and utilities.

� This easement, shall be a covenant running with the land and shall be bind-
� ing on the Gr•untor, his successors , heirs and assigr�s . Grantors covenant that they
� are the iawful owners of the above properties and that they have a good and lawful
p right to eXecute this agreement.

That portion of the southwest quarter of Section 20, Township 23 North, Range 5 East,
W.M. in King County, Washington, lying northeasterly of Benson Road South, southerly
of South Puget Drive and southwesterly of the Bonneville Power Administration Covington-.
Seattle line 1 right-of-way except the following described parcel:
Beginning at the southeast corner of said subdivision; thence south 87°49'18" west
along the south line thereof a distance of 567.00 feet to the true point of beginning
of the herein described tract; thence south 87°09'18" west continuing along said south
line a distance of 745.70 feet to an intersection with the northeasterly margin of
Benson Road south; thence North 21°21'15" west along said northeasterly margin a
distance of 370.00 feet; thence north 51°13'S3" east a distance of 124.94 feet; thence
