BENAROYA COMPANY, a Wash�ngt corpo ation, hereinafter called "Grantor" , and the CITY OF RENTON, a municipal corpo ation of King County, � Washington, hereinafter called "Grantee." 0 WITNESSETH: (�1 � Grantor, for the sum of $10.00 paid by Grantee, and other valuable pconsideration, hereby grants, bargains, sells, conveys and warrants to Grantee, its successor and assigns, an easement for underground public � utilities (including water and sewer) with necessary appurtenances including existing surface and above ground facilities such as hydrants and meters, under, through, across and upon certain properties in King County, Washington, which right-of-way is more particularly described on Exhibits A and B annexed hereto. Grantee, its successors or assigns, shall have the right, without prior institution of suit or proceeding at law, at such times as may be reasonable and necessary, to enter upon the right-of-way for the purpose of maintaining repairing, altering or reconstructing said utilities, or making any connections thereto, without incurring legal obligation or liability therefor; provided the same shall be accomplished so that the private improvements existing in the right-of-way shall not be disturbed or damaged. In the event they are disturbed or damaged, they will be replaced in as good a condition as they were immediately before the property was entered upon by Grantee. Grantor retains the right to fully use and enjoy the right-of-way, including the right to use the surface thereof, if the use does not unduly interfere with maintenance of the utility lines. Grantor shall not erect buildings or like structures over, upon or across the right-of-.way during � the existence of such utilities. This easement is a covenant running with the land and is binding on the Grantor, its successors and assigns. Grantor covenants that it is the lawful owner of the above described property and has good and lawful right to execute this agreement. JACK A.
