necessary appurtenances over, through, across and upon the following described property

as follows:
Beginning at the intersection of the west right-of-way line of East Valley
Highway (Primary State Highway No. 5) with the south line of the north

Thence along said south line N. 89°52'00" W. a distance of 50.00 feet;
Thence parallel to said west right-of-way line S. 1°49'S6" West a distance
of 45.00 feet; '
Thence S. 34°16'32" East a distance of 84.81 feet to said west right-of-way

Sai d heretofore menti oned grantee, i ts successors or assi gns, shal l
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, alter°ing or reconstructing said
utility, or making any connections therewith, without incurring any legal
�bligations or liability therefore, provided, that such construction. main-
tai ni ng. repai ri ng, al teri ng or reconstructi or� of such uti 1 i ty shal l be
accomplished in such a manner that the private irt�rovements existing in the right
right(s)-of-way shall not be disturbed : or damaged, or in the event they are
dis turbed or damaged, they wi11 be repiaced ir� as good a condition as they were �
imnediately before the property was entered upon by the Grantee.
d�+ The Grantor shall fully use and enjoy the �aforedescribed premises,
� including the right to retain the right to us� the surface of said right-of-way
� if such use does not interfere with installation and maintenance of the utility
� line. However, the grantor shall not erect baildings or structures over, under

� This easement, sAall be a covenant runnir�g with the land and shall be bind-
ing on the Gra or, his successors, heirs and assigns. Grantors covenant that
