ITHIS INSTRUMENT, made this 6th day of September, 1985,
by and between E&H Properties, a Sole Proprietorship of Eugene
Horbach, hereinafter called "Grantor", and the CITY OF RENTON,
a Municipal Corporation of King County, Washington, hereinafter
called "Grantee" .
WITNESSETH:
� That said Grantor, for and in consideration of the sum
� of $1. 00 paid by Grantee, and other valuable consideration,
�„� does by these presents, grant, bargain, sell, convey, and
c+� warrant unto the said Grantee, its successors and assigns, an
� easement for public utilities (including water and sewer) with
� necessary appurtenances over, through, across and upon the
� following described property in King County, Washington, more
� particularly described as follows:
The west 28 feet of the south 231. 37 feet and the
north 30 feet of the south 261. 37 feet, as measured
along and gerpendicular from the west line of the
following described parcel, and that portion of the
east 20 feet lying north of said south 261. 37 feet of
the following described parcel:
The south 660 feet of that portion of the NW 1/4 of
the SW 1/4 of Section 8, T 23 N, R 5 E, W.M. , in King
County, Washington, lying bettieen the northerly
projection of the centerline of Wells Ave. N (Main St.
N) and the east line of the west 293 feet as measured
perpendicular east from Northern Pacific Railroad
Right-of-Way.

Said heretofore mentioned grantee, its successors or
assigns, shall have the right, without prior notice or
proceeding at law, at such times as may be necessary to enter
upon said above described property for the purpose of
constructing, maintaining, repairing, altering or
reconstructing said utilities, or making any connections
therewith, without incurring any legal obligations or liability
therefore, provided, that such construction, maintaining,
repairing, altering or reconstruction of said utilities shall
be accomplished in such a manner that the private improvements
� existing in the right(s) -of-way shall not be disturbed or

damaged, they will be replaced in as good a condition as they
�+ were immediately before the property was entered upon by the
'� Grantee.

The Grantor shall fully use and en�oy the
� aforedescribed premises, including the right to retain the
� right to use the surface of said right-of-way if such use does
not interfere with installation and maintenance of the
utilities. However, the Grantor shall not erect buildings or
structures over, under or across the right-of-way during the
existence of such utilities.
This easement, shall be a covenant running with the
land and shall be binding on the Grantor, his successors, heirs
and assigns. Grantors covenant that they are the lawful owners
of the above properties and that they have a good and lawful
right to execute this agreement.

act of Eugene Horbach, in his capacity as attorney-in-fact for
Eugene Horbach; that he was authorized by Eugene Horbach to
execu.te the foregoing document; and that Eugene Horbach is
living, competent and has not revoked the power of attorney.
