Said heretofore mentioned grantee, its successors or assigns , shall
have the right, without prior notice or proceeding at law, at such tir��es as
may be necessary to enter upon said above described property for the purpose
of constructing� maintaining� repairing, altering or reconstructing said
utility, or makin9 any connections therewith , without incu��ring any legal
obl igations or 1 iabi 1 i ty therefore, provi ded, that such construction, main-
taining, repairing, altering or reconstruction of such utility st�all be
accomplished in such a manner that the prtvate improvements existing in the right
right(s)-of-way shall not be disturbed or damag�d� or in the event tfiey are
di s turbed or damaged, tl�ey wi 11 be repl aced in as good a condi tion as they were
immediately before tl�e property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises ,
including the right to retain the right to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the utility
line. Nowever, the grantor shall not erect buildings or structures over, under
or across the right-of-w�y during the existence of such utility.
This easement, shall be a covenant running with the land and shall be l,ind-
ing on the Grantor, his successors � hei rs and assigns. Grantors covenant tliat
they are the lawful owners of tf�e above properties anJ that they have a good and
lawful ri to execute 's agreement.
